We have addressed all issues raised in Mr. Semon's Site Inspection Report dated October 6, 2006. We would appreciate your endorsement of the final site plan so that there is no further delay to our application for a certificate of occupancy from the building department. In your letter dated October 11, 2005, you have indicated that you are unable to recommend a certificate of Occupancy based upon Mr. Semon's inspection, because the site work does not match the approved site plan as amended March 21, 2005. We would like to bring to your attention the discrepancies and errors in Mr. Semon's report as follows: i. "Parking configuration as approved is different. The site plan was approved with 16 parking spaces required and the as built condition will be less." The report is incorrect. There are 16 panting spaces. We are not sure how Mr. Semon made this determination. We met with Mr. Semon in his office prior to the Planning Board Meeting and showed him that we removed one parking spot that was very close to a tree and added another spot close to the building. At the same time we created a shaded area for people to sit and relax. We invited Mr. Semon to come back and measure the space to see that in fact there are 16 spots, 9 feet each with an additional 5 feet for handicap access. Mr. Semon, assured us that he believed us, there was no need for him to come and measure and yet proceeded to include the assertion that the space is less in his report to you. We question why your inspector would take such a position. We assume that if his job is to make accurate and truthful statements to you and the rest of the planning board, he should resolve a discrepancy when brought to his attention rather than issue an erroneous report. As to the movement of the space, we were not aware that such a minor change required a new site plan. We don't understand why we were not able to indicate such a minor change on the existing site plans without the added expense and delay of another iteration of the site plan. 2. "Parking spaces 9 $ 10 has been eliminated and replaced with a landscape island." Again the report is incorrect. The parking spaces were not eliminated. Parking space 9 is there as per the plan and parking space 10 was moved to the other side of the parking lot to protect the tree as noted in the explanation above. 3. "Parking spaces 14, 15 and 16 have changed." This statement is partially correct and partially incorrect. Parking space 16 is unchanged. We changed the designation of the handicap parking from parking space 14 to 15. We also created a small buffer between the ADA ramp to protect it from cars parking too closely. This change is reflected in the site plan submitted. 4. "The ADA space is now in location 16 and may not meet the requirements of the standard." As noted above the space is not 16 but 15. The inspector assumed that there was only one space where there are actually 2 spaces. 5. " The ADA sign is less then (than) the required 60" in section 502.6 of the standard." We appreciate you're pointing this out to us, we have corrected this. However, the height of the sign is not noted on the site plan for purposes of approval. Neither is this an as built issue. Just a sign that is too low. 6. "No ADA ground markings was (were) observed at the site WSW, Again, we will correct this as required by the ADA standards. Also not an inconsistency with the site plan. 7. "Driveway entrance was widened/changed and a 6" diameter tree was removed from Town property." The driveway entrance was reconfigured per the final site plan attached. The tree that was removed was diseased. Per Town code section 100.259 (attached), we have the right to remove diseased or dead trees without first having to obtain site plan approval. Nevertheless, we first checked with the head of the building department before removing the trees. We have also attached a letter from Joseph P. Shipman, noting that the trees he removed (4 of 32) were "badly diseased or grossly infected with carpenter ants." Again, knowing the Town Code, and having spoken with us regarding these trees, we question the inclusion of this issue in the inspector's report for approval purposes. Again, we question the motivation of such actions. 8. "The gravel topcoat appears to (be) much less then (than) the 2" thick requirement, which was incorporated in the approval." Attached is a letter from East End Asphalt certifying that the gravel has a 2- inch top coat. 9. NOT IN THE REPORT BUT IN YOUR DISAPPROVAL LETTER OF OCTOBER 119 2005 - roof overhang on west side of building. We have attached a photo from the library's archives showing that the West- side overhang was present in older photos. We've also attached a 2002 photo showing that all overhangs had been removed when the Town put on the vinyl siding. Since the site plan reflects all the wood decks in the same manner, we can only assume that the Planning Department is suggesting that we altered the original appearance of the house, which we did not. Again, we question the assumption of wrong-doing vis-A-vis, making an effort to verify that issues raised are valid. In summary, the only valid issue that needed to be addressed in the site plan was the movement of the parking space from one side of the parking area to the other. Do you honesty believe that this was sufficiently serious enough not to approve the site plan and cause us to have a further delay and expense in securing the C of O and our mortgage financing? Especially since "Me Planning Board may allow or require landscaping to be installed in place of specified parking spaces." Code section 100-254 B (5) attached. Is this also sufficiently serious enough to cause us to be fined or sued by the Town? it is our belief that the Planning Board was given an erroneous report upon which it based its decision. We can understand honest mistakes but we cannot understand a deliberate effort to misrepresent the facts, especially when it was within the purview of the inspector to verify the information given him. The Planning Board issued conditional final approval on April 11, 2005 for an alteration of an existing two-story building of 2,177 sq. ft. to an office of 1,373 sq. ft. on the first floor and two accessory apartments on the second floor. The subject property is HB-zoned and is located on the southeast corner of NYS Road 25 & Horton's Lane in Southold. During the site plan review process, the project was classified as a Type II action and was therefore not subject to SEQRA. The proposed project: is not expected to have significant environmentally damaging consequences. 2. The subject property is located within Southold's designated "Hamlet Center." The proposal for a mix of office and residential uses is consistent with the recommendations made in the Hamlet Study, including provisions to provide affordable housing. In addition, it is within the designated Hamlet Centers and HALO Zones that higher density development is most appropriate. 3. The subject property is located within a district that contains adequate resources and public facilities to support increased development. 4. The Planning Board referred the site plan to the Southold Fire District on February 9, 2005. In a letter dated March 9, 2005, the Southold Fire District indicated that fire protection for the site is adequate. 5. The transfer of sanitary flow credits is needed in order to obtain Health Department approval for the project. There are no other agencies for which approvals or permits are required at this time. Based on the above assessment, the Planning Board supports the transfer of sanitary flow credits onto the subject property for the purpose of constructing two affordable rental units on the second floor of the existing structure. The water line was moved and reinspected. The location was approved. However, we have been told that it will take 2 months for water hook up because this is being treated as new construction. This is not new construction, we have been forced to move the water line because of something that is beyond our control. To be without water for two months is a major hardship for us. We have given notice in our current office (since we had no idea that this problem would crop up) and must move by August 1st or we will be without an office. The proposed curb cut entrance to the site is preexisting and considered satisfactory. The "Proposed Gravel Parking Area" should consist of a minimum two (2") inch thick blue stone blend top-coat. Drainage Calculations have been provided for both the parking area and the renovated building. As proposed, the site appears to be graded to maintain all surface water run-off within the parking area and Inlet Grate elevations should be established to accommodate this requirement.
