SOUTHOLD TOWN BOARD OF A?PEALS
June 20, 1968
A regular meeting of the Southold To~.~ Board of
Appeals was held at 7:30 P.M., Thursday, June 20,
1965, at the To~n Office, Main Road, Southold, New
York.
There ~,~ere present: Messrs. Robert W. Gi!lispie,
Jr., Fred Hulse, Jr., Charles Grigonis, Jr.
Absent: Messrs. Robert Bergen, Serge Doyen, Jr.
At 7:30 P.M. the Board of Appeals took up the
matter of Appeal No. 1104, Upon application of Robert
H. 0hlmann, Bayview Road, Southold, New York, for a
variance in accordance with the Zoning Ordinance,
Article IIIs Section 307, for permission to construct
an addition to a d~elling ~ith insufficient side yard.
Location of orooerty: north side Bayview Road. Southold~

The Chairman opened the hearing by reading the appli-
cation for a variance dated June 1, 196~, legal notice
of hearing~ affidavit Eo its publication in the official
newspapers, and notice to the applicante
THE CHAIRMAN: ~e map indicates ~h~ the proposed
addition is to be place~ on the easterly side o~ ~he
residence on Lot #7~ wh~chwill leave ~ feet to the
right of ~ay and will leave a distance of 56 feet to

THE CHAIRMAN: (Speaking to Mrs. 0hlmann) You are here to
speak for the application?
MRS. 0HL~NN: Xes,° I am. My husband works nights and that's
why I~m here. The o~meu of the right of way is Mr. Eichorn and it
runs to property in the rear. It's marsh land.
MR. HULSE: Do you have rights over the right of way?

MR. H~LSE: Do you live here the year round?
MRS. 0HLMANN: Yes, we do.
THE CHAIRMAN: I looked at it, and I can see no objection.
I think this provides sufficient open space, particularly in view
of the fact that the next residence is 36 feet away and the right
of way itself is 25 feet. I believe the land back there is filled,
isn't it? How ~uch land is back there?
BUILDING INSPECTOR: Just a good sized building lot.
THE CI~IR~N: If there are no further questions, I will
move that this application be approved b~caume it will not change
the charactcr of the property. All those in favor? Seconded ~¥

At 7:40 P.M., the Board of Appeals took up the matter of
Appeal No. 1105, Upon application of Frank W. Fanning and Alicia
V. Fanning, Main Road, Southold, New York, for a special exception
in accordance with the Zoning Ordinance, Article'III, Section 300,
Subsection 5 (a) for permission to convert existing dwelling to
two fm~ily use. Location of property: north side Main Road,
Southold, New York, bounded north by S. B. ~ischer, east by R.
Terry, south by Main Road, west by M. W. Newbold.

THE CHAIRMAN: The application is accompanied by a survey indicating
that there is a two-story frame house with porch on front facing Main
Road. The lot is approximately 202 feet in depth and 69 feet in width
according to survey ~y Van Tuyl dated July 21, 19~5. The closest point
on the westerly side of t~e house is approximately 18 feet to the west-
erly line and the easterly Bide is approximately 9 3/4 feet; and there
is a garage here now?
RENSSELAER G. TERRY, JR.: The garage was added on on the easterly side
and comes right to the line.
THE CHAIRMAN: Is there anyone here who wishes to speak for this application?
R. G. TERRY, JR.: I appear on behalf of Mr. and Mrs. Fanning and ask for
favorable consideration of the application for the reason that they are
elderly people who for many years used the property as a two-family resi-
dence and they discontinued this use when their last ~nant moved out and
at that time they didn't have any other tenants and they did not continue
to use it as such. The facilities are all there. There has been no change
since the tenants moved out and the property could be used without any furthe~
conversion. The only change, which the survey which I brought along to show
that they acquired title back in 1945, is that they did add the garage to
the east side of the premises. I think that the premises are equipped to
two family use and I would think that that would not be prejudicial to the
neighborhood.
THE CHAIRMAN: You say there is a garage?
R. G. TERRY, JR.: Yes, the garage was added right here so that this was
extended right to the line.
THE CHAIRMAN: And you have no objection?
R. G~ TERRY, JR.: No, I have no objection.
THE CHAIRMAN: Are there any other questions? These kennels no longer
exist do they?
R. G. TERRY, JR.: I think they might be there, but they are no longer used.
THE CHAIRMAN: This land of Elizabeth A. Terry is a separate lot?
R. G. TERRY, JR.: Yes, it's a 50 foot lot. Marion A..Terry actually has
title to that and I don't ~oubt that iS this property was ever sold out-
right, we could ~ve her an additional 25 feet to give her lot more size.
THE CHAIRMAN: (Looking at the survey) Is this property actually only 69
feet wide? It looks wider.
R.G. TERRY, JR.: It looks wider from the street, but - it might be
difficult to show here - the line actually is there, because my line comes
right up to here.

1~. HULSE.~' This shows only a single-cm" garage.
R. G. TERRY, JR.: Arrangmments would have to be made for parking. The
owner would have to make arrangements for any tenant. They do have 18
feet, so they could ~sta~llsh a driveway. The elm trees are no longer
in eXistence.
THE CHAIRMAN: Is this garage entered from the rear now?
R. G. TERRY, JR.: No, it is entered from the street. There is room to
put a driveway in if he had to.
MR. HULSE: Just so they understand that there has to be offstreet parking.
THE CHAIRMAN: The condition of granting this would be that any tenant
would park off the highway in the rear yard area. Are there any other
questions?
(No response)
THE CHAIRMAN: Is there anyone who wishes to speak against this application?
(No response)
M~ion was made and ~carried that the Board grant this application on
cSndition that any tenant or tenants shall park in the rear yard area
of what is now known as the Fanning property.

Motion was made and carried that the minutes of the Southold Town Board
of Appeals dated June 6, 1968 be approved as submitted.

At 8:00 P.M., the Board of Appeals took up the matter of Appeal No.
1186, Upon application of H. M. Demarest & Sons, Main Road, Orient, New
York, for a special exception in accordance with the Zoning OrdinawQe,
Article X, Section 1003A, for permission to operate an existing labor
camp. Location of property: south side of Main Road, Orient, New YOrk,
bounded nSrth by Frank J. Miller, and others, east by.other lands of
Demarest, south by Narrow Ri~er Road, west by W. Freeman and others.
The Chairman opened the hearing by reading the application for a special
exception dated May 31, 1968, legal notice of hearing, affidavits attesting
to its publication in the official newspapers, and notice to the applicant.
THE CHAIRMAN: Is there anyone present who wishes to speak against this
application?
(No response)
THE CHAIRMAN: If there are no questions, I will offer a resolution

that this application be granted for a period of one year. All those
in favor?

At 8:15 P.N., the Board of Appeals took up the matter of Appeal No. 1187,
Upon application of Herman Blum, Bay Avenue, Mattituck, New York, for a
special exception in accordance with the Zoning Ordinance, Article IV,
Section 408 Subsection (a), for permission to erect an off premises di-
rectional sign 48 x 48 inches. Location of property: corner of Main
Road and Bay Avenue, Mattituck, New York, bounded north by Main Road,
east by Bay Avenue, south by G. McCarthy and west by G. McCarthy.
The Chairman opened the hearing by reading theapplication for a special
exception dated May 27, 1968, legal notice of hearing, affidavits attest-
lng to its publication in the official newspapers, and notice to the
applicant.
THE CHAIRMAN: The application is accompanied by a letter "To Whom It
May Concern" giving permission to Herman Blum, owner of the Mattituck
Motel, to erect a sign 48 x 48 inches, signed by George McCarthy, who
is the owner of the property. The sketch indicates that the sign will
be 4' by 4' and 3' above ground level. Is there anyone present who
wishes to speak for the application?
MR. BLUM: I have nothingnfurther to add, only that it is very important
to us and our business that we need a sign on this particular corner.
THE CHAIRMAN: Is there anyone else who ,~'~ishes to speak for this appli-
cation: (No respond) Is there anyone here who wishes to speak against
this application? (No response)
Motion was made and carried that the application be granted as applied
for and that the sign be located at least 5' from any property line and
10' from the mil~g machine.
AYES - All
THE CHAIRM~: Of course, you understand that this is
one year regulation.

An informal discussion was had with Mr. William Schriever of Orient,
New York, regarding a location in Orient for the storage of gravel.
Mr. Schriever was advised that under the Zoning Ordinance if he were
to place the gravel as fill on a lot in a residential zone he would not
be allowed to take it away, because then he would be conducting h~s usual
business.
