JuStice Tuthitl; seconded by Councilman Demarest; That the Town Board agrees to the following permit: PERMIT · BY THESE PRESENTS, that whereas BERNHARDT'S SHORES, INC., .~' ~orpor~tion of the s~ate of New York, having an office ~nd place ~ss at Duck Pond Road, Cutchogue, Town of Southold, Suff, olk County, applied in writing f~r permission to lay and ~intain water pipe under the T~n highway in front of ~its permises as hereinafter more particularly described and_whereas the ~f' the Town of Southold has duly~,~consented to the granting of Ehis indenture witnesseth, that HAROLD-PRICE, the duly Town superintendent of Highway of the Town of Southold, New York, does give and grant unto the said Bernhardt'~ shOres; lnC~' of-Duck Pond Road, Cutchogue, N.Y. ~in the Town-of Southold, and its successors and assigns, the permission and right to maintain a well ~ater pipe not exceeding two (2) incheS in diameter under a Highway known as Duck Pond Road, said well point to be lo- cated under'said Duck Pond Road near the westerly side thereof at a point ~-~23 feet southerly of New York Telephone utility pole ~5 and said ~iPe'to extend northerly under the said Duck Pon~ Road for a distance of approximately 59 feet to the premise ofthe said Bernhardt's Shores, Inc. adjacent to said Highway all in accordance with the drawing attached hereto. The permission and right hereby granted is only upon the 308 conditions hereinafter set forth and the said Bernhardt's by its acceptance of this permit does for itself, and its ~d assigns,/covenant and agree that such conditions shall be and that this permit may be revoked, and,the well point and pipe:main~ta ~e~ ..in such highway removed by the Town Superintendent of High.ways notice upon the failure of performance of any such conditions, the condit- ions being the following, to wit:- 1. The well point and water pipe hereinbefore apeci.fied shall be .laid under the ground at a depth of not less than two and one half' (.2%') feet. The. same shall be laid in a manner satisfactory to the~T0Wn.. Superintendent of Highways under his supervision. . 2. The well point and water pipe permitt'ed to be shall be so laid as not to interfere or interrupt public travel uponl.t~e said hi~q~way, and the applicant shall replace all earth removed~ >and: resur- face the pavement and leave the~said highway~ in all respects in a condition as before the laying of said well point and water pipe~ . applicant shall keep the said well point and water pipe in repairs-and maintain ~he traveled portion of the highway and the highway premises free from any defects which might otherwise be occasioned by_the install. ation of such well point and water pipe. 3. The said. Bernhardt's Shores, Inc.., its successors a~d assigns, shall forever save the Town of Southold harmless from all damages which may accrue by reason of the installation of said well point and water pipe in said h.'~way as aforesaid. 4.. The said Bernhardt's Shores, Inc., its successors and ass~igns, upon.notice by the Town Superintem~nt of Highways of the Town. of Sou.thold, shall forthwith make any repairs required for the protection. Or preservat- ion of such highway and rendere~a necessary by reason of the '~nStalla~ion3 of said well point and water pipe as aforesaid. 5. In case the said Bernhardt's Shores, Inc. or 4-t"S successors or assigns, shall fail to make such repairs to the town ~hway .as. are required tO be made by the conditions of this permit, the necessary repairs may be made without notice by the Town Superintendent of 'High~ay ~f. ~ th~~'. .' -- Town of Southold, at the expense of the said Bernhardt's _Sh0~es,~ !~C./_ its successors or assigns, and the cost thereof shall be a lien prior~,~ ~y lien upon the land benefited by the use of the highway for the laying of the pipe herein provided for. 6 If in the judgment of the Town superintendent 0~' Highways,' it shall be necessary to remove, relocate or/and replace said well point and water pipe by reason of the _repair, relocation or change in grade or othe=wise of said h~hway, it is specifically understood and agreed that the said Bernhardt's Shores, Inc. or its successors and assigns at its own expense sha!l remove said well point and water pipe and a~purtenances and shall ~e_Dlace the same in conformity with the directions of the~ said Town Superintendent of Highways. H. H.
