HomeMy WebLinkAboutTB-01/14/1964280 MEETING OF JANUARY 14, 1964. The Southold Town Board met at the office of Supervisor Lester M. Albertson at Greenport, New York, on Tuesday, January 14,1964. The meeting was called to order at 3:00 P.M. with the following present: Supervisor Albertson; Councilman Valentine;~ Justices Tuthill and Clark~. Town Attorney Tasker; Supt. of Highways Price and Town Clerk Richmond. Moved by Justice Clark; seconded by Councilman Valentine; RESOLVED: That the minutes of the Annual Meeting of. January 2, 1964,~be and they are hereby approved. Vote of Town Board: Ayes-Supervisor Albertson; Councilman Justices Tuthill and Clark. Moved by JuStice Clark; seconded by Justice Tuthill: RESOLVED: That the next monthly meeting of this Town Board will be held at the office of Supervisor Lester M. Moved by Justice Clark; seconded by Councilman Valentine: ~ ~ RESOLVED: That Bond No. 73S-688BC, issued by the Aetna Casualty and Surety Company in the name of Raymond .Doyen, Fishers Island, N.Y. Town of Sout~ old, as Commissioner-Secretary of Fishers ISland Garbage & Refuse District in the sum of $t000.00 be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Moved by Justice Clark; seconded by Justice Tuthill; WHEREAS, the ~Board of Commissioners of the Fishers Island Ferry District has by contract retained the firm of Johnson and Williams, Public Account- ants, of 774 Broad Street, Waterford, Conn. to perform auditory and accounting service for said District effective as of January 1, 1964 to December 31, 1964 at the annual fee of $1100.00 to be paid quarterly, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Board approves said contract. vote of Town Board: Ayes-Supervisor Albertson; Councilman Valentine; Justices Tuthill and clark. Moved by Justice clark; seconded by councilman Valentine; W/qEREAS, Charles Christiansen, purser for the Fist~s Island Ferry District is physically unable to serve at this time, and WHEREAS, Fishers Island Ferry District requests permission to hire William A. McLeod as Relief Purser, NOW, THEREFORE, BE IT RESOLVRD: That the Town Board approves the action of Fishers Island Ferry District in hiring said WiltiamMcLeod as Relief Purser. Vote of Town Board: Ayes-Supervisor Atbertson; Councilman Valentine; Justices Tuthill and Clark. Moved by councilman Valentine; seconded by Justice Tuthill: WHEREAS, John Tillinghast has served the children of Southold Town for the past twenty years in his capacity at the American Legion Skating Rink, and WHEREAS, John Tillinghast has kept the rollerskates in so good a repair as to have no major accidents to the youth of the community due to faulty skates, and WHEREAS, Mr. Tillinghast has done this for the past t~enty years at a very nominal fee and because of hi~ services the children of South~ld Town have had a good place to enjoy themselves, BE IT RESOLVED: That this Southold Town Board, sitting in its regular session, does hereby commend Mr. John Tillinghast for the splendid job that he has done for the children of the Town of Southold. Moved by Justice clark; seconded by Councilman Valentine: WHEREAS, the Town Board of the Town of Southold, by resolution, did on April 25, 1955, appoint a Planning Board for the Town of Southold, and such resolution provided that said Board shall~have all the powers granted by the Town Law, and WHEREAS, at ~he time of the adoption of the foregoing resolution it was intended to give to such Board the authority to approve Plats, pursuant to Section-276 of the Town Law, and said Planning Board has, since it's appointment, exercised its authority to. approve~ Plats, and ~S, it now appears that there is a question of whether the afore- mentioned resot~%ion specifically granted authority to the Planning Board to approve Plats, NO~;3~'~ T~EREFORE, BE IT RESOLVED: That the Planning Board of the Town of Sou~hold shall have the power to review and approve new subdivisions of land. in the Town of Southold. consistent with the requirements of Article 16 of the'Town Law, and BE IT FURTHER RESOLVED: That the Planning Board of the Town of Southold is hereby authorized and empowered to review and approve previously filed Plats covering land in the Town of Southold which are wholly or partially undeveloped as provided by Article 16 of the Town Law, and BE IT FURTHER RESOLVED: That the Planning Board of the Town of Southold is hereby author ized and empowered to confirm or modify the zoning regulations of the land shown on a subdivision Plat under its review (as more partic- ular~ly specified in Section 281 Article 16 of the Town Law) provided all such modification shall be limited by the following: 1. Moved by Justice Tuthill; seconded by Councilman Valentine: WHERE~S, the construction of a jetty at.the northerly terminus of Mill Road at pecohic, in the Town of Southold,. will afford increasing use of the area ~by the public, and will require greater facilities than presently available, and WHERE~S, ~it appears in the public interest that the~Town acquire by purchase ~or' by condemnation in the manner provided by law the premises immediately adjacent to the northerly terminus of said Mill Road and on the westerly side thereof, more particularly knoWn and designated as "ALL that tract or parcel of land, situate, lying and being at Peconic, in the Town of southold, County of Suffolk, and State of New York~ known and designated as Lots numbered One (1) and ~o (2) on a certain map' e~titled "Map of Peconic Shores", located at Peconic, Long Island, Property. iOf William B. Codling", surveyed September 1922 by J. W. Weels, C.E., and filed in the Suffolk County Clerk's Office, on August ~, 1924, under ~File No. ~117. TOGETHER~'withl-the beach, ~aters and lands under water in front of and abutting said premises." WHEREAS, said premises appear to be presently owned by Jalal Elahi, re- siding at.ll East Williston Avenue, East Williston, New York, NOW, THEREFORE, BE IT RESOLVED: That the Town of Southold acquire th~ aforesaid real property for public use bypnrch~ase or by condemnation in the manner by law, and be it further RESOLVED: That Supervisor Lester M. Albertson be and he hereby is authorized and directed to proceed with negotiations for the purchase of saidreat property, and in the event of his inability to agree with the owner of said premises as to the f~ir market value, or if the owner re- fuses.to grant the Town the use thereof, then in s~ch event the supervisor is hereby authorized and directed to proceed with the acquisition of said premises for the Town of .Southold ~ condemnation in the manner pro- vided by law, and be it further RESOLVED: That the Supervisor be and he hereby is authorized to ret&in Rensselaer G. Vote of Town Board: aYes-Supervisor Albertson; Councilman Valentine; Justices Tuthill and Clark. 282 Moved by Justice T~hill; seconded by Justice Clark; WHEREAS~.Article 14 of the General Municipal Law and Article 14 of the Town Law, authorize a Town Board by resolution, subject to a permissive referendum, to establish, construct, equip., maintain, and operate for such town an airport or landing field for the use of aeroplanes and other aircraft and to lease r~l property for such p~rpose, and. ~EAS, the owners of the airport located at Mattituck, in the T~n o~ S0uthold, have offered to lease the landing field at said airport to the Town of Southold for the purpose of establishing an airport or landing field.for the Town of Southold, and WHEREAS, the Town Board deems it~ in the public interest, that an~airport or landing field be established in the Town of S0uthold, . ~ NOW, THEREFORE, BE IT RE$OI~ED:~by the Town Bcmrd of the Town of SouShold as follows: Section 1. The Town Board does hereby determine to establish, construct, equip, maintain and operate for the Town of ,Southold an airport or landing field for the use of aeroplanes and other aircraft. Section 2. The Supervisor of the .Town of ~Southold is hereby. authorized and directed to lease for such purpose, the real property herein~bove described, provided, however, that the terms and conditions of.~said lease ~hall be approved by this Board. Section 4. This resolution shall take effect immediately .and shall ~be subject tO a permissive referendum. Terry~ Building Inspector, for the month of December be accepted by the Town Board and placed on fil~e. Terry, Building Inspector, were presented and the annual report of Howard M. Terry for the fiscal year 1963 was filed, NOW, THEREFORE, BE IT ~RESOLVED: That such annual statement be entered in detail in detail in the minutes of this meeting by the Town Clerk as required By Section 105 of the Town-Law. Feesreceived and turned over to the Supervisor for building permits $2,297.42 2. Fees received and turned over to the Supervisor for change of Zone. 150.00 3. Ohlmann, has applied to the Town Board for a-single trailer renewal permit dated Jan. 14, 1964, ~OW, THEREFORE, BE IT RESOLVED: That the application of Robert H. Ohlmann to locate a single trailer on his own property, Bay Road, South- old, N.Y. ~ud hereby~is granted until May 15, 1964. Moved by Justice Clark; seconded by Councilman Valentine; WHEREAS, Burton Potter Post $185, Greenport, N.Y. applied to the Town Clerk for a Bingo License Amendment, and WHEREAS, the Town Board has examined the ~oplication and after invest- igation duly made findings and determinations as required by law, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is authorized and directed to execute on behalf of the Town Board the find- ings and determinations required by law mnd it is further RESOLVED: That the Town Clerk be and he hereby is directed to issue an amended Bingo License to tt~ Burton Potter Post $ 185 of Greenport, N.Y. Terry, Building Inspector, Town of Southold, be and he hereby is authorized to attend Eastern State School for Build- ing Inspectors at Hotel New Yorker on Feb. 20 and 21, 1964, and be it F~RTHER RESOLVED: That registration fees not exceeding $10.00 and all actual and necessary expenses of travel, meals and lodging incurred while attending said school be a legal charge against the Town. Moved by Justice clark; seconded by councilman Valentine: WHEREAS, the Town of Southold is commencing the preparation of a Master Plan for the future development of the TOWn of Southold, which program is to be paid in part by the Federal Government and the New York State Government, and WHEREAS, in order to comply with the requirements of the New York State Department of commerce it is necessary for the Town of Southold to pro- pose to the Department of Commerce a firm of planning consultants which the Town of southold would like to engage for the preparation of such study, NOW, THEREFORE, BE IT RESOLVED: That the Town of Southold does ~reby pr~- pose to the New York State Department of commerce the firm of Raymond and May of White Plains, New York as the consulting firm to perform such services. Burns of Southold and Miss Hall of the County Welfare Department appeared before the Town Board stating the need for a program to assist those in our T~wn who have not had the opportunity for a formal elementary education. Theyare asking for vQlunteers to learn to teach this ~thold and have trained personnel ready to instruct volunteer teachers, The~ Town Board is ver!~3~much in favor of this program. Adjournment.
