Gillispie, Jr., Chairms_u; Robert Bergen, Fred Hu!se, Jr.~ Charles Grigonis~ Jr. Absent: Serge Doyen~ Jr. PUBLIC HEARING: Appeal No. 1218 - 7:B0 P.M.(B.S,T.)~ Upon application of Inl~.~nd Homes,~Inc-4B2 ~,~ddle Country Road~ Selden~ New York, a/c Fred ~ttler, Village Lan~, ~ttituck, New Yozki for a'variancein accordance with the Zoning Ordinance, Article III~ Section B07, for per- mission to construct an addition to existing building with insufficient side yard. Location of property: lot ~22 Village I~anor~ east side of Village Lane~ Mattituck, New york, ~ounded northby privK.te Raad, east by Ru!~nd, south by McBride~ west by Village Lane. Fee paid $5~00. The Chai~mmn opened the hearing by rea'ding the application for a variance~ legal notice of hearing~ affidavit attesting to its publication in the official ~ewspaper, and notice to the applicant. (There was no respon~) ~ter investigation ~ndinspection the Board finds that the s~oplicant requests permission to construct an addition to an existing building with insufficient side yard. The applicant proposes to add onto the present garage. The Dpplicant is the owner of a corner lot and must adhere to a.deed restriction of a 50 foot setback from both streets. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship~ the hardship created is unique ~and would not be shared by ali properties alike in the immediate vicinity of this property and~ the same use district~ and the variance does observe the spirit of the Ordinance ~nd will not change the character of the district~ On motion by Mr. Bergen~ seconded by Mr, Grigonis, it was RESOLVED Inland Homes, Inc.~ 432 Middle Country Road, Se!den~ New York~a/c Fred F~ttter, Village Lane~ ~attituck, New York, be gr'_ted permission to construct an addition to exisiting building as applied for. (There was no response.) ~ter investigation and inspection the Board finds that the application requests permission to build~ a new one fs/~ily dwelling with reduced side yard area. The Board finds that ~he applican%~s lot is a narrow lot:and,tha~ other lots in the area are larger. In making this decision the Board is not influenced by the applicant's implication of the financial value of the proposed structure.
