L.I., N.Y. 119'71 TELEPHONE (516) 765-1809 MINUTES SPECIAL MEETING FRIDAY, APRIL 1, 1983 A Special Meeting of the Southold Town Board of Appeals was held on Friday., April 1,. 1983 at 7:20 p.m. at the Southotd Town Hall, Main Road, Southold, New York. Present were: Gerard P. Goehringer, Chairman; Charles Grigonis, Jr. and Robert J. Douglass. Absent were: Joseph H. Sawicki and Serge Doyen (Fishers Island). Also present were: Mr. Victor Lessard, Administrator (Building Department) and Mrs. Shirley Bachrach (League of Women Voters). The Chairman opened the meeting at 7:20 o'clock p.m. PENDING SEQRA DETE~4INATION: APPEAL NO. 2956. PARKSIDE HEIGHTS CO. (Also known as Gardiners Bay Condominiums). WHEREAS, on February 26, 1982, the subject application for Special Exception for 20 condominium units with accessory garages was filed with the Town Clerk and this board; WHEREAS, on March 4, 1982 this file was held in abeyance pending receipt of approvals from the D.E.C., Planning Board, and Army Corps of Engineers, if necessary for this project; WHEREAS, on May 24, 1'982, the subject application was approved by the Sou~hold Town Planning for 19 condominium units; W~EREAS, on November 17, 1982, this application for a Special Exception was amended by applicant for 18 condominium units and setbacks adjusted accordingly; and WHEREAS, on January 21, 1983, this board received written approval from the N.Y.S. D.E.C. and stamped approval from the County Health Department (for 18 condominium units'and accessory garages) pursuant to our March 4, 1982 request; and Southold Town Board ~-Appeals -2- April 1, 183 Special Meeting (Environmental Declaration - Appeal No. 2956~ PARKSIDE HEIGHTS CO.~ WHEREAS, on January 29, 1983, this board declared itself lead agency and required submission of a Long Environmental Assessment Form by applicant; WHEREAS, on February 3, 1983, applicant filed the requested Long Environmental Assessment Form; and WHEREAS, on March 22, 1983, the Conservation Advisory Council of the Town of Southold indicated that they did not feel this project as proposed would have any environmental problems; NOW, THEREFORE, on motion by Mr. Goehringer, seconded by Mr. Douglass, BE IT RESOLVED, that the Board of Appeals as lead agency determines that the project as proposed for 18 condominium units and accessory garage will not have significant adverse effects upon the environment; that it is the understanding of the board that applicant will comply with all rules and regulations of the Flood Plain Management Law of the Town of Sou~hold; that the setback from the ordinary highwater mark will be a minimum of 250 feet for the proposed construction; and that any and all other rules and regulations pertaining to this project will be complied with. Location of Property: Right-of-Way located at the West Side of Shipyard Lane, East Marion, NY; Minor Subdivision of E. Konto- kosta, Map ~171, Subdivision Lot No. 3; County Tax Map Parcel ID No. 1000-38-07-004.2. Vote of the Board: Ayes: Messrs. Goehringer, Grigonis and Douglass. (Members Sawicki and Doyen were absent.) This resolu- tion was unanimously adopted.) The board members agree to table the decisions on the following for the reasons stated below: Appeal No. 3090 - Chester M. Mayer. Await full board for deliberations. (Hearing was held 3/23/83) Appeal No. 3085 - Ann O'Sullivan (Rehearing was held 3/23/83) Await Jack Davis' report on road improvements. Appeal No. 3086 - Port of Egypt Enterprises, Inc. Await full board for deliberations. Apri.1 20, 19.~3 at the Southold Town Hall, Main Road, Southold, NY, and that the same be advertised in the local and official newspapers pursuant to law: Appeal No. 3106 - Andrew Kru~ski and Sophie Zimmerman. Variance to obtain permission for lots with insufficient area and width at Town Harbor Lane., Sou~hold (Pounders Landing Subdivision). Appeal No. 3105 - Charles and Sylvia DeLuca. Variance to construct one-family dwelling with deck addition with an insufficient rearyard setback at 1235 Wells Road, Peconic, NY. Appeal No. 2956 Parkside Heights Co. Special Exception to con- struct 18 condominium units (in two buildings) with accessory garages on private R-O-W off west side of Shipyard Lane, East Marion, NY. Vote of the Board: Ayes: Messrs. This notice is issued pursuant to Part 617 (and Local Law #44-4) of the implementing regulations pertaining to Article 8 of the State Environmental Quality Review Act of the Environmental Conservation Law. This board determines the within project not .to have a significant adverse effect on the environment. Also, please take notice t~at this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. SUPPORTING THIS DETErmINATION: (1) An~Envir°nmental Assessmen~ in the Short Form has been sub- miEted which indicates tha~ no significant adverse effects to the environment are likely to occur should this project be implemented as planned. This board determines the within project not to have a significant adverse effect on the environment. Department of Environmental Conservation, Permit No. 10~82-0515 as amended Octo- ber 26, 1982. Vote of the Board: Ayes: Messrs. Goehringer, Grigonis, and Douglass. (Members Sawicki and Doyen were absent.) This resolution was unanimously ad~pted. Being there was no other business properly coming before the board at this time, the Chairman declared the meeting adjourned.
