The Southold TOWn Board met at the office of Supervisor Lester M.
Albertson, 16 South Street, Greenport, New York, on May 7, 1963. The
meeting was called to order at 3:00 P.M. with the following present:
.Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices
Tuthill and-Clark; Supt. of HighWays Price; Town Attorney ~asker and
Town clerk Richmond.
Several people of the Town attended the Board meeting, many of whom
were interested in the Sign Ordinance.
Moved by Justice Clark; seconded by Justice Tuthill:
RESOLVED: That the minutes of April 23, 1963, be and they hereby are
duly approved.

WHEREAS, the ToWn Board on its own motion by resolution adOpted on
the 7th day of March, 1963, proposed certain amendments in the Build-
ing Zone Ordinance of the Town of Southold, Suffolk County, New York,
and
WFRREAS, the said matter was referred to the Planning Board for its
official recommendation and report, and
WHEREAS, thereafter, the Town Board pursuant to due notice thereof,
held a hearing thereon on April 9, 1963 at which time all interested
persons were~cgiVen an opportunity to be heard, and
WHEREAS, ~he Town Board thereafter considered the evidence given at
said hearing and considered said matter at length,
NOW, THEREFORE, BE iT RESOLVED: That the said proposed amendments to
the Southold Town Building Zone Ordinance be not adopted.

1. By amending Article III, Section 300, Subdivision II of the Building
Zone Ordinance of the Town of ~outhold to read as follows;
11. %~hen authori~ed as a special exception by the Board
of Appeals as hereinafter provided, one (1) sign, single or double-
faced, n6t more than four (4) feet in height and eight (8) feet in
width, the lower edge of which shall be not less than two (2) feet
above the ground and the upper edge of which shall not extend more
than six (6) feet above the ground, provided, however, that such
sign shall be set back not less than thirty-five (35) feet from all
street lines except that where a set-back line has been established
~in the vicinity with permar~ent buildings of more or less than thirty-
five (35) feet, such sign shall not project beyond the set-back line
so established, and provided further that such sign shall be set back
not less than fifteen (15) feet from all property lines.
II. By amending Article IV, Section 408, Subdivision (b) of the Build-
ing Zone Ordinance of the Town of Southold to read as follows:
(b) WALL SIGNS-- One (I) sign attached to or incorporated
in each building wall a-d advertising only the business conducted in
such building, provided such sign does not:
1. Exceed two (2) s~uare feet in total area for
each horizontal foot of such wall, and
2. Exceed in width one hundred (100) percent of
the horizontal measurement of such wall, and
3. Exceed ten (10) fe~t in height, and
4. Exceed fifteen (15) feet six (6) inches from
the ground level to the upper edge of sign, and
5. Project more than one (1) foot from such wall.

III. By repealing Article X, Section 1002, of the Building
Zone Ordinance of the Town of Southold.

WHEREAS, the Planning Board has filed its official report with the TOWn
Board, and
WHEREAS, THE Town Board pursuant to due notice thereof, held a public
hearing on said petition on April 19, 1963, at which time all interested
persons were given an opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED: That the relief demanded in said petition
of Ruth F. Wel~ls be and t~e same is in all respects denied~,.

five (5) aluminum rowboats for use ~ Lifeguards at bathing beaches 'in

At 3:30 P.M. in accordance with the notice published according ~ taw,

bidder 200 ton of 3/8 blue stone or so much thereof as may be required
for the repairs of the Town Highways.

NOW, THEREFORE, BE IT RESOLVED: That the Supervisor, Lester M. AlbertSon
be and he hereby is authorized to contribute Town Funds in an amount
e~aal tO ½ of the total cost up to but not to exceed the sum of $475.00
toward the cost of dredging the entrance of Goos~e Creek, Southold, N.Y.

WHEREAS, the Town Board has heretofore accepted the bid of Robert Wadding-
ton, Jr. for the alteration and additions to the Terminal Building at
Fishers Islan~ ;~rintthe amount of $16,042.00 and directed the B
Board of of the Fishers Island Ferry District to prepare
a contract.for the performance of said work for the approval of the Town
Board, and
WHEREAS, the Board of Commissioners prepared and submitted a proposed
contract for the approval of the Town Board, and
WHEREAS, t~e proposed contract submitted by the Board of Commissioners of
the Fishers Island Ferry District is acceptable to the Town Board,
RESOLVED: That the Town Board does hereby approve said contract and does
hereby authorize~, and direct the Supervisor to approve said contract
on behalf of the Teen Board.

WHEREAS, this Board deems it in the best interest of the Town of So~thold
and the.emplgyees thereof that a grievance procedure be established in
theTown of Southold under which employees of'the Town of Southold may
present grievances, free from coercion, interference, restraint, discrim-
ination or reprisal, and
WHEREAS, Article 16 of the General Municipa% Law authorizes the establish-
ment of a grievance procedure,
NOW, THEreFORE, BE IT RESOLVED: That the following grievance procedure
is here~y established for employees of the Town of Southold, Suffolk
Co~un~y, New.York:
1. ~EFINITIONS. As used herein the following terms shall
have the following meanings:
(a~ "Employee" shall mean any person directly employed
and compensated by t~e Town of Southold, except for elected or appointed
officers and persons employed in the legislative or judicial branch thereof.
(b) "Grievance" shall mean any claimed violation, mis-
interpretation or alleged inequitable application of any existing laws,
or duly established rules, procedures, regulations, a~ministrative Orders
or work rules of the Town of Southold or a department thereof, which relate
to or in~otve employee health or safety, physical facilities, materials
or e~/ipment furnished to employees, or supervision of employees; provided,
however, that such terms shall n0tinclude any matte~ involving an employees
rate of compensation, retirement benefits, discipliL~ary proceeding or any
other matter which is otherwise reviewable pursuant to law or any rule
or regulation having the force and effect of law.
(c) "Department" shall mean any office, department,
board or other agency of the government Of the Town of Southold2
(d) "Immediate Supervisor?' shall mean the employee or
officer on the next higher level of authority above the employee in the
depar~men~ where!9, the grievance exists and who normally assigns and super-
vises the ~employee's work and approves his time record or evaluates his
work ~erformance.

(e) "Days" shall mean all days other~than sa~-
days, Sundays and legal holidays, Saturdays, Sundays and legaI.holid~yS~
shall ~e excluded in computing the n~mber~ of days within which ~action .-
may be taken or notice given within the terms of this resolution.
(2) DECLARATION OF BASIC PRINCIPLES.,
Every employee of this Town shall have the right to present his grievance
in accordance with the procedure provided here~n, free from interference,
coercion, restraint, discrimination or reprisal, and shall have the~iright
to be represented by a person of his own choosing, at all stages-of the
grievance procedure.
(3) INITIAL PRESENTATION
' (a~ An emPloYee who claims tohave a grievancei'~
shall present his grievance to his immediate supervisor-, ora~ly,-'~within
two days after the grievance occurs.
(b) The immediate supervisor shall discuss the
grievance with the employee, shall make such investigation as he deems
appropriate and shall consult'with his superiors to such extent ~ ~e
deems appropriate, all ~n 'an informal basis.
(c) Within five (5)
the'grievance to hi~, the immediate supervis°r shall make hi~eCisi~a~
and communicate the same tot he employee presenting the grievances-and
to the employee's representative, if any.
(4) SECOND STAGE
(a) If an employee presenting a grievance be
not satisfied with the decision made by his immediate superior? he may,
within~ten (t0) d~Fs thereafter, request a review and determination of
his grievance by the Town Board. Such request shall be in writing and
shall contain a statement of thespecific nature of the grievance and'
the facts relating to it. Such reddest shall be served upon both the Town
Board and the immediate supervisor to whom the grievance was'originally
presented. Thereupon, within five ~(5) days after receiving-~uch~ re.eSt,
the i~,ediate supervisor shall submit to the Town Board a written
statement of his information concerning the specific nat-ore Of the
grievance and the facts relating"to it.
(b)'The Town Board may, and at the reddest of
employee shall, hold a hearing within ten (10) days after receiving the
written request and statement from the employee. The employee~ and.his-
representative, if any, may appear at the hearing and present oral state-
ments or arguments. -
(c) Within ten (10) days after the close of ehe
hearing, or within fourteen (14) days afterthe grievance has
mitted to it if there be no hearing, the ToWn Board~hatl make i~S;'~ec~s-
ion and communicate the same to the employee presenting the grievance,
a~d to the employee's representative, if any. Such decision shall be final.
This resolution shall take effect immediately.

WHEREAS, hoSpitals are staffed by professionally trained pers~nel who
daily provide diagnostic, therapeut~¢c, and rehabilitative services of
the r to help maintain the health of our citizens, and
career opportunities and rewarding life-work
to many persons in this community, and
WHEREAS, each member of a hospital staff perform a task essential to
the recovery of patients or to the safe and efficient operation of the
institution,
BEIT RESOLVED: that this community in recognition of National Hospital
Week, MaY 12-18, salutes its hospital, the Eastern Long Island Hospital,
fof'itsc6~tinued progress in health care, for conducting the education-
al programs that insure a continuing supply of well-trained health
personnel, and for providing a growing number of caree=, opportunities
for the~outh of America. _

NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of
Southold be and he hereby is directed to transmit this petition
tD the Planning Board in accordance with Section 981, Subdivision C
of Article,IX Of the Building Zone Ordinance of the T~Wn of Southold.

WHEREAS, the Town Board has heretofore accepted the bid of Thames River
Dock and Dredge Company for dock repairs and ramp relocation to the
Fishers Island Ferry District TErminal at Fishmrs Island, N~w York,
in the-amount of $13,580, and directed the Board of Commissioners
of the Fishers Island Ferry District to prepare a contract ~or the
performance of said work for the approval of the TOWn Board, and
WHEREAS, the Board of Commissioners prepared and submitted a proposed
contract for the approval of the Town Board, and
WHEREAS, the proposed contract s~bmitted by the Board of Commissioners
of the Fishers Island Ferry District is acceptable to the Town Board,
RESOLVED: That the Town Board does hereby approve said contract and
does hereby authorize and direct the Supervisor to approve said contract
on behalf of the Town Board.

NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is
authorized and directed to execute on behalf of the Board the findings
and dete~_minations required by law and it is further

Local Government at Albany, New York, on June 4 and 5, 1963, and be it
FURTHER RESOLVED: That the necessary expenses incurred while attending
said conference be a legal charge against 'the Town 'of S6~thold.- ~ "

and he hereby is directed to enter into a contract with Duratech Co.
for the' p.urchase of five (5) new aluminum boats at a total costof .25.

NOW, THEREFORE, BE IT RESOLVED:That Lester M. Albertson, Supervisor,
be and he hereby is directed to enter into a contract with O'Keefe ,C~. Olds
Inc. for the purchase of five (5) new 1963 2-door sedans, 8' cylinder
automobiles at a total cost of $5,929.75 to be delivered at the police
Department in Peconic, New York.

A letter was received from Walter Ebbitt requesting the TOWn. Board to
enact an ordinance relative to dogs. This letter was referred~ to the
Police Committee for study.
Letters were received from Spencer B. Terry and DaVid Spohn re~ue.st~g
to be relieved of duty on the Rescue S~uad.
A letter was received from the Fire Chief Assqciation concerni~.~ ~he
numbering of houses in the Town of Southold.~ Supervisor Albertson will
meet wi~h the Association to discuss the matter.
The Board will meet tonight, May 7, 1963, with the T. V. cable Co..
to discuss the possibility of a T. V. cable Franchise.
