WHEREAs, ~he superintendent of Highways of the Town of Southold has recommended to the Town Board that the Highway Specifications of the Town-of ~outhold heretofore~adopted~by the Town Board ~nd effective on June 1,. 1956, be amended4% and WHEREAS, ~the TOWn Board has examined the present Highway Specifications and desires to make certain changes and additions thereto, NOW, ..~TH/EREFORE,~. BE' IT~ RESOLVED: That the aforesaid Highway Specifications of-t~h~e._~Town of S0uth01d be and they .hereby are amended to provide as follows: HIGHWAY SPECIFICATIONS TOWN OF SOUTHOLD Any :p_ear?on or persons d?siro~s .Of dedicating land for town highway purposes shall be .re~ired to file-three (3.) prints of the proposed' layq~, t. zqf :SUCh highway with the Planning :BOard of .the Town of Southold. The Planning Board shall examine such prints and prepare a written report ther,. ,~o_ n;. con. tain. ing its recommendations conc~rning~.~e..:Pr, oP0sed layout, an~ file ,the same with the South01d Town Board together with one print Of the, P~r'0pos~ iiaffout. The. Planning Bo_ard sh~ll retain one .print ~or 152 its fileS and ~shall return one print to the applicant. the Town Board shall approve or d~sapprove such-~layout andso.~'~dVise ...... the Planning Board and the applicant. After such proposed layout has been approved bY the '- SOuthold TOW~ Board, the following specifications' shall be Complied w' 1. Any person or persons desiring to dedicate real estate to the."Tow~ of' Southold for highway purposes must execute and submit to the Town Board the following:- a.~A duly acknowledged dedication and release; together~ with the re~uire~ County Clerk's recording fees. b. Proposed consent of the TOWn Board. c. Proposed order' of the ~aperintendent. d. A survey map of the property. e. An Attorney's certificate of' title and an abstrct of~ title certified to the'TOWn Board. by an Attorney or a $2; 000 Policy issued in the name of the Town of 'Southold. f. A bargain and sale deed~ with covenant against fgrantor~s acts ~n-the proper form for recording in-the County Clerk's--6ffice?,-~ together with the recording fees. The foregoing six documents shall be fastened together in one fol:~ei and the dedication and release-shall inctude the signaturestof~&t'l fee owners, easementsowners, mortgagees , and so forth, and;the-Attor- ney's certificate shall certify to such. · 2. Ail highways accepted by the Town as Town Highways must .be~ at-least fifty (50) feet in width; such width shall hereinafter ~be knOWn-as the bounds of the highway. 3. Ail proposed highways sha~ll-. be properly -surveyed, monumen~ed concrete monuments on all points, curves and intersections, with maps shOWing a profile at an appropriate.~ scale, name of highway; name of all adjacent owners, if any, drain&ge~'~ights' of way or leaching areas, widt~h and length of highway, scale~- o~f map~ shall not be more th~n 1" to 20~". An additional survey maP" or'the property, other than the one in the folder shall.also be sub~itted; 4. Ail' highways terminating at tidewater shall have a width of not less than-10~' for a distance of 1~0' back from the mean high water mark. Ail highways on water front property must have the same access to the water as above required. 5. Ail dead-end highways must have a width of not less than 100' for a distance of 100' back from the dead-end to provide for a turnaround all of-which must be free from trees, bushes and stumps. 6. The name of such highways may be proposed by the OWner or OWners of Property dedicating such highways but the name of such highways shall be subject to the approval of the T=wn Board. 7. A width of thirty-four (34) feetsshalt~be hereinafter knOWn as the highway area from which all trees, brush, rocks, stumps~'~and other obstructions shall be thoroughly cleared.and all such material Shall be removed from the bounds of the highway. 8. The p~Dtion known as 'the highway area shal~l be plowed, disc-harrOW- ed, rolled and graded to a uniform-surface to the-longitudinal~ gra~e as shown on the final map. 9. Where the surface is sandy,~ either naturally orby vir~tue of~ grad- ing to the elevations established, loam, free ?from all, vegetable-matter, shall be used for a depth of Six inches below the finished grade on the road section. -. ~ ..... 10.-Where cuts and fills are necessary in Order to bring the'~highway to the proper grade and cross sections, the cut or -fill shal-i: m~t:i the abutting surface with a 1 on 2 slope.. Where the slope or f.~l.~l e~- tends beyond the fifty feet, the ne=essary releases, easements or deeds must be obtained from the property ownereor OWners. 11. When deemed necessary by-the Superin~endent~of Highways, s~za% sewers, leaching basins, leaching ar~s;- curbs and/or gutters shall '~e constructed in accordance with the recommendations of' the SuPerinten- dent of Highways. . - - 12. After the highway area has been properly graded, to the approval of the Superintendent of Highways, the twentY~0ur (24) foot section in the center of the highway area (hereinafter: r~ferred to as the road section) shall be stabilized with an application of one (1) gallon of SC-1 (Bituminous Cut Back) per s~: uare yard mixed to a depth of four (4) 'inches. Within two :'(:2) months, and not less than one (1) month a-feet stabilization, the road.section shal.1 be rol'led and proper~Iy pre~ared~ -and an. application of one-half (%).gallOn of MC-2 per s~uare yard shall be applied .with sufficient sand to absorb the excess oil. ~n case of ~ry we&-ther', the subgrade shall be wet;down:befor~ the oil is' applied. 13. On ~th' sides of-the oiled surface' or road section of the highway area, there shall be a five foot shoulder which shall .be graded, Shaped, rolled and free from all debris of all kind. 14. Before any highway shall, be accepted by the Town of SouthOld, as town highwayt~bY dedication, the assessed value of the buildingsJ and structures on the ta'n~-on-both.sides-of such highway ,(as shown onthe current tax roll of ~e Towntof SoUthold) shall have ,an assessed value' of not less than forty thousand .($40~ 000.00) dollars per mile or proportioned at that rate if more or less than a mile. 15. Where it is necessary to ha~e a drainage area beyond the fifty foot bounds, of the highways, .-such area must be deeded to the Town,-,the-same as the.highway with all easements thereto. 16. sidewalks shall be a standard four foot in width, four inches thick exceptZ,'.in '~rivewayS-where they must be not less than six.. inches thick. All curbs and gutters to be built to- standard forms as may be directed by the Superintendent of Highways. On existing TOwn Highways-~he Town will' fur~ish the necessary engineering, grading,' fill and la-Or; the property owner or owners shall furnish, the necessary ready mixed concrete and shall deliver such concrete to the site as directed by the Superin- tendent of H~ghways. The amount of sidewalk construction throughout the Town shall be determined by the Town Board. 17. Whenever in the opinion of the Superintendent of Highways he feels that for the ~est interest of the Town, alterations or modifications s should be made to the above specifications, rules and regulations,-SuCh alterations or modifications may be made on the recoF~endation of.the Superintendent of Highways to and with the approval of the TOWn '~BOar'd. Moved by Justice Clark; seconded by Councilman Grathwohl; W~.REAS, it is the responsibility of. the Town Board to maintain a refuse disposal area, and WHERF2~S, through experience it has 'been proven the use of a track tractor with 'a hydraulic bucket is the best way in which to handle organic and inorgan~ material, and WHEREAS, THE PRES~{T EQUIPMENT I~ use at the Town Disposal Area is not economically repairable, and it is the feeling of the Town Board that the use o~ e~uipment necessary to cope with the problems that confront us at' :th~ Town Disposal Area can be arranged for through contracts NOW, THEREFORE, BE IT RESOLVED that the Supervisor is hereby authorized to con~act with the K. A. Papish E~uipment Company for the .use of an Allis-Chalmers crawler-lOader -in new condition, capacity of bucket to be one Cubic yard; said contract to run for a three year period from January 'lst, 1963; and the monthly charge for this contract not to ex- ceed $ 291.22.
