Th~ said Long Island Lighting Company is hereby gra~ted the right and privilege to install a submarine cable under BayshOre Road and Island View Lane, Town Highways, extending froma point 185 feet more or less northerly from the southerly terminus of Bayshoreli~Road .in a southerly direction along said Bayshore ~Road and 'in an~.easte=ly direct- ion along Island View Lane to the high water mark of Peconic Bay, said installation to be made in accordance with plans submitted:ito'th, e Town by said Long Island Lighting .Company entitled "Conkling .Point Terrain, als for Submarine Cables" (WO No. 47547), for~.the purpose of tr~n.smit~ing electricity through said cable ~n~der .the~waters of' Peconic Bayu~to t~e. Town of Shelter Island. ,- 2. Ail poles, trenches, structures and other appurtenances shall be located under the direction of the Town Board of the Town of Southold or its duly authorized agent .... ~ .. ~ 3. At all times after the ~instaltation of said subma=.~ne~>cab~e and appurtenances the Long Island Lighting Company shai1 be~permitted,~ to examine the same and to keep the same in proper con~_itioR~ ~and repai=. and to do all necessary work to proper~y maintain, the .condition thereof. 4. The installation of said submarinw cable and appurtenances pexmitted to be installed hereunder shall be so installe~.as not~to. unreasonably interrupt or interfere with public travel upon the~i&fo=e~ mentioned town highways, and shall be installed and maintained .i~ a, proper workmanlike manner so that ,the same. shall in no way ~danger~ t~e public, and ~the said Long Island Lighting Company shall replace aL1 ear. th removed and shall resurface said highways and shall highways in as good a condition as before the installation.of~sa/d~? cable. The sa&d L~ng Island Lighting Company, upon notice by~.the ~Town Superintendent 6f Highways of the Town of southold, shall forthwith make any repairs required for the protection or preservation of such highways and rendered nec, essary by reason of. the. installation.~of said cable as aforesaid. In case the said Long Island Lighting Company~ st~all fail to made such repairs to said town highways as are re~uir~d.~ to,be made by the conditions of t~is resolution, the necessary repairs may be made without notice by the town superintendent .of h~$hways ~of ~the Town of Southold, at the expense of the said Long Island Lighting Company. 5. The Long Islm_nd Lighting Company shall at all times indem/aify and sa~e harmless the Town of Southold and the members of the said Board and the Superintendent of Highways of the TOWn of Southold from and against any and all actions, suits, ~amages, costs, charges and expenses by reason of the installation and maintenance of .said submarine cable an~ appurtenances in the af~said town. Highways or by~ reason of any act done or omitted to be done in the premises by the said Long Island Lighting Company. 6. This consent is made upon further express condition that. pe~~ mission be secured by said Long Island Lighting Company from such other public bodies an~ officers an~ commissions as is ree/uired by 7. Moved by councilman Grathwohl; seconded by Justice Clark; RESOLVED: That the Justices of the Town of Southold be and_they hereby are authorized to attend Justices Conference of the state of New York For~ham Law School to be held at Eew York on November 16, 17, 30, Dec. 1, 7 and 8~ 1962 and be it further RESOLVED: That the necessary expenses incurred while attending said school be a legal charge against the Town.
