Moved by Councilman Demarest; seconded by Councilman.Grathwoh~ RESOLVED: That the regular monthly meeting of the TOWn BoardM~ll be held at the Supervisor~s Office, 16 South. Street, Greenport,,.~?¥,..on Wednesday, Nov. 7, 1962, at 3;00 P.M. Vote of ToWn Board: Ayes-Supervisor Albertson; CouncilmenDemarest~ and Grathwohl; Justice Clark. Moved by Councilman Demarest; seconded by Justice Clark;' WHEREAS, an application was received from Julius Zebroski et al for an Open Development Area under the provisions .of Section 280-A of the Town Law, NOW, T~RREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be and he hereby, is directed to transmit this application to the Planning Board in accordance with ~'~e.~_l~Q~,~D~ A'_.~\t..P~i..T,,o~ ~w. Moved by Justice Clark; seconded by Councilman Grathwoh~; RESOLVED: That Bond No. 738-1167, issued by the Aetna Caaualty, and Surety Company in the name of Henry Brewster Faucon in the sum o~ $4000.00 be and the same is hereby approved as to its form, manner, of execution and sufficiency of sureties therein. Fitzpatrick in the sum of $4000.00 be and the same is hereby approved as to its form, manner of execution and suff$ciency of sureties therein. Moved by Councilman Demarest; seconded by Justice Clark; WHEREAS, the Commissioners of .the Fishers Island Ferry District wish to enter into a bareboat charter for use of the M. V. Yankee wi~h.the Interstate Navigation Company for a period commencing at .7:00 A.M. on October 22, 1962 and shall end at 7:00 A.M. on October 24, 1962 lump sum payment of $500.00 to cover the first two days charte= and ~if the charterer shall elect to continue the charter thereafter it shall pay the owner at the raterof $200.00 per day for each addit'i0nal day or part thereof, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Board a~proves the action of the Commissioners of the Fishers Island Ferry District on entering into the contract as per contact stated with the interstate Navigation Company. The meeting of the Southold Town Board reconvened at 7:30 Justice Tuthill is also present at this meeting. Moved by Justice Tuthill; seconded by Justice Clark; W~EREAS, .Freddie Lawson applied to the Town Board for a single trailer permit'dated Oct. 10, 1962, NOW, THEREFORE, BE IT RESOLVED: That the application of Freddie Lawson to locate a single trailer on the south side of Sound Ave., Mattituck, New York be and hereby is granted for year round occupancy for a period of one year. ~ Vote of Town. oard; Ayes-Supervisor Albertson; councilmen Demarest and Grathwohl; Justices Tuthiil and clark. Moved by Councilman GrathWohl; seconded by Justice Tuthill; WHEREAS, Fishers Island Ferry District CO~missioners request the approval of hiring John Pickett as Clerk to the Fishers Island Ferry D~strict, and WHEREAS, E, Perry Edwards, Justice of Fishers Island, reco~aends the hiring of said John Pickett, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Board approves ;the action of the Fishers Island Ferry District commissioners in the hiring of John Pickett as Clerk to the Fishers Island Ferry District. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Councilman Grathwohl; WHEREAS, Leander Glover et al by petition verified the 31st day of July, 1962, petitioned the Town Board for a change of zone of certain real property described in said petition from "A" Residential and Agricultural District to "C" Industrial District, and WHEREAS, the said petition was referred to the Planning Board for its official recommendation and report, and WHEREAS, the Town Board pursuant to ~ue notice thereof held a hearing thereof on Oct. 9, 1962 at which time all interested persons were given an opportunity to be heard, minutes of which were recOrded by judith Boken, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Building Zone Ordinance including the Building Zone Maps be amended from "A" Residential and Agricultural District to "C" Industrial District on the following described property: ALL that certain tract or parcel of land situated at Cutchogue, in the Town of Southold, Suffolk County, New York, and more particularly bounded and described as follows; BEGINNING at the intersection of the southeasterly line of Oregon R~a~~ with the southwesterly line of Cox Lane; running thence southeasterly alongside line of Cox Lane about 3,000 feet to a point on the direct extension northeasterly of the northwesterly line of land of Wickham Estate; thence southwesterly across land of Pietrewicz on s&id extension andthen' along said northwesterly line of Wickham Estate and land of Harris and then across land of Szawinski Estate; a total distance of about 1400 feet, to land of Leander Glover; thence southeasterly along said landor $1over about ~300 feet to the northwesterly line of Middle Road; thence southwesterly along said line of Middle Road about 50 feet to land of First Baptist Church of Cutchogue~ thence northwesterly along the last described land and other lands about 500 feet to land of Town of Southold; thence along land of the Town of Southold, three courses, as follows: (1) Southwesterly about 250 feet; thence (2) south- easterly about 100 feet; thence (3) southwesterly about 350 feet to land of McBride; thence southeasterly along land of McBride about 350 feet to said northwesterly line of Middle Road; thence southwesterly along saidi line of Middle Road about 400 feet to land of Zuhoski;thence northwesterly along land of Z~zhoski about 1950 feet to land of J. P. Krupski; thence along land of J. P. Krupski, four courses as follows: (1) northeasterly about 350 feet; thence (2) northwesterly about 1700 feet; thence (3) northeasterly about 450 feet; t]~ce (4) northwesterly about 150 feet to the southeasterly line of said Oregon Road; thence in a general northeasterly direction along said line of Oregon Road about 1300 feet to the point of beginning. Excepting therefrom however all the lands Within the above described parcel n~ owned by the Town of $outhold, as delineated on the survey attached to the file. Moved by Justice Tuthill; seconded by Councilman Demarest; RESOLVED: That the T~n Clerk of the Town of Southold be and he'. hereby is directed to request the Long Island Lighting Company to install three (3) Mercury Vapor overhead street lights on Love Lane on Poles 1, 3' and 4 and also two (2) Mercury vapor overhead street light, s on Pike Street on poles 7 and 4J, all NTT Poles, in the Mattituck Lighting District, $1, Mattituck, N.Y. Moved by Councilman Demarest; seconded by Justice Tuthill: IN THE MATTER ~OF THE EXTENSION .OF THE ORIENT LIGHTING DISTRICT IN THE TOWN OF SOUTHOLD; COU~TY OF SUFFOLK, STATE OF NEW YORK, PURSUANT TO ARTICLE 12A OF THE TOWN LAW. WHEP~AS, a map or plan relating to the proposed extension of the Orient Lighting District, prepared by Otto W. VanTuyl & Son, competent engineers and surveyors, duly licensed by the State of New York, in the manner and in such detail as has been determined by the Town Board of Southold Town, has been duly filed with the Town Clerk of the Town of Southotd, ~in accordance with the requirements of Article 12A of the Town Law'; and WHEREAS, an order was duly adopted by the Town Board of Southold Town on September 25th, 1962, reciting the filing of said map the improvements proposed, the boundaries of the proposed district, th~' estimated expense thereof, the proposed method of financing, the fa~ that the map or plan describing the same are on file in' t~e Town clerk,s Office for public inspection, and stating all other matters required by law to be stated, and specifying October 23rd, 1962; at 7:30 P.M. on that day as the time, and the Village Hall in the Village of Greenport, in said Town as the Place where the said Town Board would meet to consider said map or plan, and to hear~-'all persons -interested in the subject thereof concerning the same a%d to take such action-'there- on as is required or authorized by law; and WHEREAS, such order was duly p,~blished and posted as required by law, and WHEREAS, a hearing on said matter was duly held by said Town BoardUon this 23rd day of October, 1962 b~ginning at 7:30 P.M. of that day the Village'Hall in the Village of Greenport, in said Town, and f~il discussion ef the-matter having been.b~d, and all persons desiring to be heard having been duly heard, ~. NOW, upon the evidenee given upon such hearing and upon motion 'of Councilman Demarest, seconded by Justice Tuthitl, it is RESOLVED AND DETERMI~IE~:- (a) That the notice of hearing was published and posted-~as required by law, and is otherwise sufficient. (b) That all property and property owners~wi, th%n~the_prop~sed district are benefited thereby. - (c) That all the' property and property owners benefi~e4 are'~in- eluded within the limits of the proposed district~~ (d) That it is ~n the public interest to extend said Orient Light- ing District, and it is FURTHER RESOLVRD AND DETERMINED that the extension of the bound- aries of the Orient Lighting District as set forth in said map be approved; and the ~mprovements in said district be installed upon the re~aired funds being made available and provided for; and such district shall~be ~nown and designated as the Orient Lighting District in the Town of Sout~old and shall be bounded and described as follows: BEGINNING at .a point on the shore of Long Island Sound on the line between land of~Wi~ W. Stephenson on the East and land of Stephenson's Beach, Inc. on the West; running thence in a general northeasterly or easterly direction along Long Island Sound to Orient Point; thencel in a general southwesterly direction along Gardiners Bay to Long Beach Point; thence northeasterl~ and then northwesterly along Orient Harbor to a point about. 2,O100 feet westerly from the foot of 'State Street; thence norther- ly .t%~rough l~nds of said Stephe~son's Beach, ~nc. and across the Main Road~and then Old Main Road to the southerly corner Of land of said W. W. Stephenson; thence northwesterly along the line between said land of W.~W. Stephenson and land of Stephenson's BeaCh, Inc. to the point of beginning. The boundaries described a~e intended to include all property within said boundaries referred to and as shown in the map on file in the Town Clerk's Office, and it is FURTHER RESOLVED:ithat the method of financing said improvements con- sist of assessments levied on benefited real property within said distr- ict, and it is FURTHER RESOLVED that thisresolution is subject to a permissive referend~ as provided ~n .Section 209-E of the Town Law. Case on the West and lan~ formerly of Luvia Willard ,on-the East;-running thence northeasterly and then e~ster- ly along said shore line about 18,000.feet to the line between Southold Town Beach on the West and land of Faversham on the East; thence.south- erly along the last described line and then directly across North Road and then along the line between land of Hass on the West and Ruch on the East and thence extending southerly and then southwesterly through Arshamomoque Pond and Mill Creek to Town Har_bor; thence southwesterly and then easterly along the shore of Town Harbor to Paradise~Point; thence southerly and then westerly along Little Peconic Bay to the center-line of Richmond Creek; thence generally westerly and then northertyalgsg the center line of Richmond Creek to land of Stankewicz; thence~north- easterly along said land of Stanke~cz to land of Gradowski; thence northerly along said land of Gradowski about 2600 feet to Main Road; thence easterly along Main Road to the line_between!'ands of~otteveel on the' East and land of B. Falcon on the' west~ thence n~rtherly along the last described line a~ then along the line between land orA. Stetzer on the East and land of A. Mokus on the West to the northert~ !ine of Long Island Railroad Company; ;thence easterly along the northerly line of Long Island Railroad Company to the southwesterly line-of Bowery Lane~ thence northwesterly along the southwesterly line of Bowery ~Lane to the southerly line of Middle Road.; thence westerly ~along the s0u. ther!y line of Middle Road to a point opposite the line between land of-Alex Zebroski on the West and land of Frances Doroski on the East; thence northerly across said Middle Road. and then along the last described lt~ne to land of Pine Crest Dunes, Inc., formerly of K. W. Case; thence northerly along the easterly line of land formerly of K. W. Case and across Sound. View~ Avenue to the point of beginning. The boundaries described are intended to include all pr~operty within said boundaries re~erred to and as shown in the map on file, in the Town Clerk's Office, and it is FURTHER RESOLVED thatthe method of financeing said improvements consist ot assessments levied on benefited real property~i~within said district, and it is FURTHER RESOLVED that this resolution is subject to a Permissive~ referendum,as provided in Section 209-E of~the Town Law.
