The-meeting was called to order at 3:00 P.M. wi%h~the following present: Supervisor Albertson; Councilmen DemareSt~ and Grathwohl; Justice clark; Town Attorn~ Tasker; Supt. of High- ways Price and Town Clerk Richmond. Moved by Justice Clark; seconded by Councilman Grathwohl; RESOLVED: That the minutes of April 10, 1962, be and they hereby are duly approved. VOte of Town Board: Ayes-Supervisor Albertson;Councilmen Demarest and Grathwohl; Justice clark. Moved by Councilman Demarest; seconded by Justice Clark; RESOLVED: That the next regular monthly meeting of this Town Board will be held at the office of the Supervisor, Lester M. Albertson, at 16 South S~reet Greenport, N.Y. on Tuesday, May 8, 1962, at 3:00 P.M. Vote of Town Board: Ayes-Supervisor Atbertson; Councilmen Demarest and Grathwohl; Just ice Clark. A group of menffrom the Southold Town Business Men's Association appeared before the Board regarding the Ordinance regulating signs. Sup~visor Albert- son informed them that the Board had a proposed change of ordinance and would pass a re~lution to send it to the Planning Board for their reco~,endation and report. Moved by Councilman Demarest; seconded by Councilman Grathwohl; W~EREAS, Otto L. Anrig, of Mattituck has for thirty-two years been a faith- ful employee of the Town of Sou-thold, and W~EREAS, for the last twenty-six years he has acted in the capecity of Polic~ Chief (constable), and has diligently and faithfully pmrformed all of the duties in connection with his office, and has on many occasions performed these duties beyond the normal requirements, and WHEREAS, he has given unstintingly Of his own time without extra remuneratio~ and WHEREAS, the Town Board of the Town of Southold is fully cognizant of the excellent service rendered, and because it is mandatory and beyond the con- trol of the Town Board of the Town of Southold that said Otto L. Anrig retir~ as of April 30, 1962, because of his having attained statuary retirement age, and WHEREAS, we note with a feeling of sincere regret that the termination of th~ serviceS'ofl Otto L. Anrig becomes effective as of April 30th, 1962, now THEREFORE, BE IT RESOLVED: That Otto L. Anrig be granted an amount equal to two months salary at his present rate of compensation in lie~ of vacation, in accordance with Section 9~ of the General Municipal Law of the State of New York. Moved byJustice Clark; seconded by Councilman Demarest; WHEREAS, the Town B~rd believes that it is in the best interest of the Town that all signs in existance prior to the enactment of the zoning ordinance of the Town of Southold should ~e allowed to continue upon the condition that the owners of such signs obtain permits therefor, NOW, THEREFORE, BE IT~ RESOLVED: That the Building Zone Ordinance of the Town of Southold be and the same hereby is amended as follows: 1. By Repealing Section 1002, Article X of said ordinance. II. By amending Article VII, Section 703A of said ordinance to read as follows: prior SECTION 703A - A permit will be required/to the erection of or addition to all signs, including non-conforming signs in existance prior to the enactment of this ordinance, except signs permitted by Article III, Section 300, paragraph 8,9 and 10 of this ordinance. Metal identification tags serially numbered shall be affixed by the Building Inspector to all signs for which a permit is required. BE IT FURTHER RESOLVED: That the Town Clerk be and he hereby is authorized and directed to transmit a copy of this resolution to the Planning Board' of the Town of Southold with written instructions requesting said Board to make its official recommendation and report~, thereon pursuant to article IX of. the Building Zone Ordinance. ~ ~ Vote of TOWn Board: Ayes-Supervisor Albertson; Grathwohl; Justice Clark. Moved by Justice Clark; seconded by Councilman Demarest; WHREEAS, the Town Board is of the opinion that additional business areas be created along Route. 25 between Greenport and Southotd in said Town,.~nd WHEREAS, after due deliberation this board'believes that~ the area herein- after described should be re-zoned from "A" Residential and Agricultural DiStrict .to "B" Business, to wit: ALL that certain tract, piece or parcel of land situate, lying and being at Arshamomoque, in the Town of Southold, Suffolk County., New. York, generally bounded and described as follows: BEGIS~NING at the intersection of the southerly line of Main Road (Route 25) with the westerly line of Silvermere Road and running thence southeaSt- erly along said westerly line of Silvermere Road 575 feet, more or less, to land of the Long Island Railroad Company; thence in a general south- easterly direction along said land of the Long Island Railroad CQmpany 5,200 feet, more or less, to Kerwin Boulevard; thence northwesterly along-- Kerwin Boulevard to ~he southeasterl~ line of said Main Road (RoUte 25.) thence in a general northeasterly direction along said Main Road"-(Route 25) 5,900 feet, more or less, to the intersection of the southerly line of Main Road (Route 25) with the westerly line of Silvermere Road and the point o~ place of beginning. Excepting, however, from.the above described property the two areas presently zoned "B".Business and shown and aelineat- ed on the Southold Town Zoning Map. NOW THEREFORE, BE IT RESOLVED: That the Town Clerk be and he h reby is authorized and directed to transmit a copy of this resolution to the. south- old Town Planning Board for its recommendation and report pursuant to Article IX o~ the Building Zone Ordinance of the Town of Southold. Moved by Justice Clark; seconded by Councilman Demaresti WHEREAS, the Town Board has prepared the form of contract acceptable to the Town Board for the operation of the ferry boat,Mystic Isle, MOW, THEREFORE, BE..IT RESOLVED: That the Supervisor transmit to the Comm- issioners of the Fishers Isladd Ferry District such form of contract and advise ~aid C6i~sioners'that they may proceed to advertise ~or bids for said ferry in accordance with the said formsof contract. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and_ Grathwohl; Justice Clark. Moved by Councilman Grathwohl; seconded by Supervisor Albertson; WHEREAS, Harold D. Price, Supt. of Highways, informed this BOard that Crab- tree O'Keefe ~nc. was the lowest bidder for a 1960 Oldsmobile Station Wagon or equal, NOW, THEREFORE, BE IT RESOLVED: That the Town Board hereby authorizes the Supt. to purchase said Station Wagon in accordance with bids submitted. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justice Clark. Moved by Councilman Grathwohl; seconded by Councilman Demarest; WHEREAS, Harold D. Price, Supg. of Highways, informed this Board that the Long Island Produce and Fertilizer Company was the lowest bidder for one (1) new one-ton truck or equal, NOW, THEREFORE, BE IT RESOLVED: That the Town Board hereby autb_Drizes tt~ Supt. of Highways to purchase said truck in accordance with the bids sub- mitted. Vloutety for a change of zone from "A" Residentail and Agricultural District to "M" Multiple Residential District~ on certain property in East Marion, N.Y., NOW, THEREFORE, BE IT RESOLVED: Thata public hearing will be held by the Southotd Town Board~at the Supervisor's Office., 16 South Street, Greenport, N.Y. on Tuesday, May 8, 1962 at 7:30 P.M. on the above mentioned petition and that the ~Town Clerk~be and he hereby iSauthorized and directedto cause 'a notic~ 10fl said hear: to be Published~in the Long Island Traveler- Mattituck Watchman, .tt~e requirements of law. A letter was received from the Cutchogue Chamber of Commerce requesting the continuation of Griffi~Street9 Cutchogue, N.Y. Moved by Justice Clark; seconded by Supervisor Albertson; RESOLVED: That this meeting be recessed until May 1, 1962 at 1:30 P.M. Moved by Councilman Demarest; seconded by Justice ~lark: W-HERF~S, Wood[hollow Properties Inc. applied to the Town Board for a single trailer permit dated May 1, 1962, NOW, THEREFORE, BE IT RESOLVED: That the application of Woodhollow Prop- erties, Inc. to locate a single trailer on their property, Orient, N.Y. be and hereby is granted for a period of three (3) months. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; JuStice Clark. Moved by Councilman Grathwohl) seconded by Councilman Demarest; RESOLVED: That Otto L. Anrig be and he hereby is appointed Special Constable of the Town of Southold, the appointment to take effect immediately. Vote of Town board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justice clark. Moved by Councilmmn Demarest; seconded by Justice Clark; WHEREAS, Otto Anrig has retired as of April 30, 1962 as Police Chief (Constable) of the Town of Southold, and WHEREAS, the Town Board desires to appoint a Police Chief (Constable) to fill the vacancy created by the retirement of Otto Anrig, NOW, THEREFORE, BE IT RESOLVED: That Theodore B. Howard be and he hereby is appointed Police Chief .(Constable) of the Town of Southold to hold such office at the pleasure of the Town Board unless .otherwise provided by law, the salary to be the present salary being~ paid to Theodore B. HOward. Vote of TOwn BOard: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justice Clark. 76 Moved by Councilman Grathwoht; seconded by Justice Tuthill: WHEREAS, Mervin Grushkin entered into an agreement, with~the Town of Southold dated May 11, 1960 for~the operation of the refreshment-~stand and pther facilities at the T~wn Beach, and WHEREAS, the said Mervin Grushkin operated said refreshment stan~and facilities at the Town Beach.for the succeeding two seasons in a manner which was acceptable and aatisfactory tot he TOWn Board of theTown of Southold, and WHEREAS, thesaid Mervin. Grushkin. found it necessary to discontinue his b~iness in Southold Town and to ~ake employment in the State of Connecticut, and WHEREAS, undex the agreement dated May 1t, 1960 a check for $500.00 was deposited with the Town of Southold to insure the faithful per-. formance of the agreement, and' WHEREAS, the Town .Board of the Town of Southold, did, on March. 13th,-~ 1962, advertise for bids for the operation of the refreshment stand and facilities at the TOWn Beach, .and at least four bids were received in response to the advertisement with a propose~.rental substantially in excess of the $1~200.00 per annum which Mervin Grushkin had hereto- fore paid, and WHEREAS, the Town Board of the Town of Southold has determined that the Town has suffered no monetary loss through cancellation or, the agreement with Mervin Grushkin, new, therefore, be it RESOLVED:-That the Town Board of the Town of Southold, in.accordance with a request received from Mervin Grushkin dated March.5, t962,~ does. hereby cancel the agreement, dated May 11, 1960, and the Supervisor is hereby directed~ to.return the $500.00 to the said Mervin Grushkin. Moved by Justice Tuthill; seconded by Justice Clark; WHEREAS, the Town Board of the Town of Southold advertised for bids for the operation of the refreshment stand and facilities at the Town Beach on M rch 13, 1962, and WHER~AS, a~ter study by the Beach Committee of the bids, it was their recommendation that the high bid of Lewis E. Serviss of $2~050.00 per annum be accepted by the by the Town of Southold, now therefore, be-it RESOLVED: That the Supervisor be directed to enter into a contract with Lewis E. Serviss for the operation of the Town Beach refreshment stand and facilities for a period of fi~e years, all in accordance with the terms set forth in the specifications pertaining to the advertisement for bids. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark.
