MEETING OF APRIL 10~ 1962.
The $Outhold TOwn Board met at the office of Supervisor Lester M. Albertson
at Greenpo~ on Tuesday, April 10, 1962. The meeting was called to order at
3:00 P.M. with the following present: Supervisor Albertson; Councilmen Demarest
and Grath~ohl; Justices Tuthill and Clark; Town Attorney Tasker; Supt. of High-
ways Price and Town Clerk Ruchmond.
Moved by Justice Clark; seconded by Justice Tuthill:
~.RESOLVED: That the minutes of the meeting of March 27, 1962 be and they here-
~ are duly approved.

RESOLVED: That the regular monthly meeting of the TOWn Board will be held
at the Superv~sor's Office, 16 South Street, Greenport, N.Y. om Tuesday,
April' 24, 1962 at 3:00 P.M.

At 3:00 P.M. in accordance with the notice published, according to law,
bids were opened for proposals to furnish the Town of Southold one (1)
new Tax extension computer. Only one bid was received which was from the
Burrough's Corporation for $11,812.40.

RESOLVED: That the bid to furnish tax extension computer be held for
study by the Board.

WHEREAS, a certain check drawn on the General Fund of the Town of Southold
prior to 1959, said check made payable to a doctor for vital statistics
report in the amount of 25¢, is presumed lost,
NOW, THEREFORE.BE IT RESOLVED that the above check be cancelled and the
amount of 25¢ be red~posited in the General Fund.

WHEREAS% the Burton Potter Post ~185 American Legion has applied to the

WHEREAS, the Town Board has examined the application and after investigat-
ing the matter, duly made findings and determinations as~required by law,
NO~, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is
authorized and directed to execute on behalf of the Town Board the findings
and determinations required by law, and it is ~urther
RESOLVED: That th~ Town Clerk be and hereby is directed to issue a Bingo
License to the Burton Potter post ~185.

property in Peconic adjoining the Highway Department be sold to the North
Fork Bank and Trust Co. "

WHEREAS, W. Harry Lister as president of Boatmmn's Harbor has requested
the Town to dredge the entrance of Wickham's Creek,

WHEREAS, several requests have been made for extending the different
Lighting Districts in the Town of Southold, and
WHEREAS, the TOWn Board of the Town of Southold wishes to extend the
boundaries of the ~West Greenport Lighting District in said Town, and
WHEREAS, the Town Board of the TOWn of Southold believes the ~ktension
of the We~t Greenport Lighting District is in the public interest, it is
RESOLVED that the sum of One Thousand ($1,000.00) Dollars be a~d the sa~e
is hereby appropriated to pay the 'cost of preparing a gener~!.map o~ the
area to be included in the West Greenport Lighting District, including
legal and engineering services in connection therewith.
This resolution is subjec~ to a permissive 'referendum.

WHREAS, FOR SEVERAL YEARS THE Village of Greenport, wor$ing~in conjunction
with the special committee of the Burton Potter Post ~185, A. L., has spon-
sored the State-supported Youth Program for said Village, and .
WHEREAS, it appears that a considerable proportion of the young people
participating in such program live outside the"Village limits, and
WHEREAS, throughout most of the Town of Southold such programs and actiV-
ities are administered by School Districts, thus providing'that all young '
people in such districts are included, now therefore, be it
RESOLVED: That the Town Board of the Town of SOuthold respectfully reqUests
that the Board of Education of'Union Free School District $10, which
includes both the Village of Greenport and the outlying areas~' favorably
consider acting as sponsor of such a program as of July 1962.

CAPITAL~NOTE RESOLUTION DATED APRIL 10, 1962
A RESOLUTION-AUTHORIZING THE PURCPIASE OF REAL-ESTATE FOR THE PURPOSE OF
STORING HIGHWAY MACHINERY, TOOLS, IMPLEMENTS AND EQUIPMENT OF THE TOWN
OF SOUTHOLD, SUFFOLK COUNTY, N~ YORK, AT A MAXIMUM ESTIMATED COST OF
$5,000.00 AND AUTHORIZING THE ISSUANCE OF A $5,000.00 CAPITAL NOTE TO
PAY THE COST THEREOF.
BE IT RE~SOLVED:'bY the 'Town Board of the Town of Southold, Suffolk
County, New~York, as follows:
SECTION!~I~'~,,The Superintendent of Highways of the Town of Southold,
Suffolk County, New York, is hereby authorized to purchase the following
described real property to be used for the purpose of storing high~ay
machinery, tOols, implements and equipment at a maximum estimated ~ost
of $5,000.00 to wit:
ALLthat certain plot, piece or parcel of land situate, lying and being
at Peconic, in the Town of Southold, County of Suffolk and State of
New York, bounded and described as follows:
BEGINNING ~t a point on the easterly line of land of the Davids Estate
and the westerly line of land of the Town of Southold, North 30 degrees
10' 50" West 208.32 feet from the northerly-line of the Main Road; running
thence along land of said Davids Estate, South 48 degrees 40' 00" West
244.84 feet to the northeasterly corner of land of Sternemann; thence
along land-of Davids Estate, North 33 degrees 31' 20" West 822.85 feet
to land of Dobek; thence along said land of Dobek, North 46 degrees 42'
20" East 27:1~.~99 feet; thence along land of Debek and land of Surozenski;
South. 32degrees 34' 30" East 557.89 ~eet; thence along land of Latham
andalong land of the Town of Southold South 30 degrees 10' 50" East
278.41 feet to the point of BEGINNinG. Containing 4.923 acres.
SECTION 2.The plan for the financing of such maximum estimated cost is
by the~issuance of a $5,000.00 capital note hereby authorized to be issued
pursuant ot ~e proViSions of the Local Finance Law.
SECTION 3~. It is hereby determined that the period of probable usefulness
of such specffic object or ~l~rpose is thirty years pursuant to,subdiv-
ision 21(a) of paragraph a of Section 11.00 of the Local Finance Law,
and that the proposed maturity of the note herein authorized will not
exceed five~years.
sECTION 4~ The ~faith and c~mdit of said Town of Southold, Suffolk County,
New York, are hereby irrevocably pledged to the payment of '~e principal
of and interest on such note and an amount sufficient to pay the principal
of and interest on such note shall be included in the annual budget and-
levied as a part of the Taxes for each fiscal year to pay the principal
and interest becoming due and payable in such fiscal year.
SECTION 5. Subject to the provisions of the Local Finance Law, the power
to sell said capital note is hereby delegated to the Supervisor, the chief
fiscal officer. Said note shall be of such terms, form and contents, an~
shall ~e Sold in such manner as maS be prescribed by said Supervisor, cons
istant with the provisions of the Local Finance Law.
SECTION 6. The validity of such note may be contested only if:
1.) Such note is authorized for an object or purpose for which said Town
of Southold is not authorized to expend money, or
2.) The provisions of law which should be complied with at the date of
publication of this resolution are not substantially complied with,
and an action, suit or proceeding contesting such validity is commenced
within twenty days after the date of such publication, or
3.) Such note is~authorized in violation of the provisions of the
con~$itution.

published in full in the Long Island Traveler Mattituck Watchman, the
official newspaper, together with a notice of the TOWn. Clerk in sub-
stantially the form provided in Section 81.00 of the Local Finance~aw..

RESOLVED: That Lester M. Albertson, Supervisor, be and he hereby is
authorized to enter into a contract with the Village .of Greenport, N.Y.
for the use by the Village of Greenport of the radio facilities of the
Southold Town Police Department for the sum of $3000.00 per..year from
January 1, 1962 to December 31, 1962.

WHEREAS, Kenneth G. Case, bY petition verified the 13th day of March 1962
petitioned the Town Board for a change of zone of certain real property
described'in'said petition from "A" Residentail and Agricultural District
to "B" Business, and
WHEREAS, the said petition was refer~ed to the Planning Board for its
official recommendation and report, and
WHEREAS, the Town BOard pursuant to due notice thereof held a hearing there-
on on April lb, I962 at' which time all interested persons were~given an
opportunity to be heard,
NOW, THEREF0~E, BE IT RESOLVED: That the Southold Town Building Zone Ordin-
ance including the Building Zone Maps, be amended from "A" Residential and
AgricultUral District to "B" Business District the following described
property:
ALL that certain tract or parce~l of land situated at Peconic, intthe Town
of Southold, Suffolk County, New York, and more particularly bounded and
described as follows:
Beginning at a monument set on the southerly line of North Road at the
northeasterly corner of land of Kenneth case, being the northwesterly cor-
ner of land of F.F. Overton Estate, running thence along said land of F.F.
Overton Estate and land of J. Trombetta, south 37 degrees 04' 50" East
a distance of 384.39 feet, more or less, to the existing "B" B~siness
District; running thence South 55 degrees 05' 20" West along the northerly

WHEREAS, the Supt. of Highways of the Town of Southold has advised the
Town Board that a serio~4s flooding condition exists on Tuckers Lane, Southol~
and recommends that land be acquired on the east side of Tuckers Lane for
the purpose of constructing a leach basin to drain surface water on Tuckers
Lane, and
WHEREAS, Supt. of Highways Price has also advised the Town Board that he
has consulted with the Donahue family, the owners of the property on the
east side o6 Tuckers Lane and said owners will convey the parcel of land
hereinafter described to the Town of Southold for the su~.,of $1,500.00,
NOW, THEREFORE, BE IT RESOLVED: That the Supervisor of the Town of SOUthold
be and he hereby is authorized and directed to enter into a contract and
to purchase the property hereinafter described from:the present owners for
the sum of $1500.00, said real property being described as follows:
ALL that plot, piece or parcel of land situate, lying and being at Southold,
in the Town of Southotd, County of Suffolk and State of New York, bounded
and described as follows:
BEGINNING at a point on the easterly line of Tucker Lane 300 fee% southerly
along said line from land now or formerly of Zigmund Helinski and running
