The Southold T?wn Boardr. met at the office of Supervisor Lester
Albertson at Greenport, on Tuesday, Feb. 20, 1962. The meeting was
called to order at 3:00 P.M. with the following present: Supervisor
Albertson; Councilmen Demarest and Grathwohl; Justice Tuthill and Clar~;
Town Attorney Tasker; Supt. of Highways Price and Town. Clerk Richmond.

RESOLVED: That the minutes of February 6, 1962 be and they hereby.~are
duly approved.

RESOLVED: That the next regular monthly meeting of this Town oard will

At 3:00 P.Mi in accordance with the notice published, according to law,
bids were~opened for proposals to furnish reefers to the Townof Southold
for the Auxiliary Police. Only one bid was submitted which was by Levin's
Men's ghop, Greenport, NY as follows: 17 Reefers at $59.95 each.

WHEREAS, the Police Committee reported that the lowest bid on the Auxili-
ary Police Reefers was submitted by Levins Men's Shop,
RESOLVED: That Lester M. Albertson, Supervisor, be and he hereby is direct-
ed to enter into a contract with Levins Men's Shop for the purchase of
Auxiliary Police Reefers in accordance with bid submitted by the said
Levins Men's Shop.

WHEREAS, the County of Suffolk is contemplating the establishment of a
Suffolk County Air Port Authority, and
WHEREAS, the Town Board of the Town of Southold feels that in the interest
of future development of Southold Town, airport facilities would be de-
sirable,
NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of Southold
hereby requests the County of Suffolk to consider the Town of Southold a~
a location for future Connty air site.

requirements of the extension of the road by the Cutchogue Post Office.

CAPITAL NOTE RESOLUTION DATED FEBRUARY 20, 1962
A RESOLUTION AUTHORIZING THE PURCHASE OF OFFICE.~ACH~NES
AND EQL~/PMENT FOR THE TOWN OF SOUTHOLD, SUFFOLK COUNTY,
N~N YORK, AT' AM AXIMUM ESTIMATED COST OF $12000.00 AND AUTHORIZING
THE ISSUANCE OF A $12000.00 CAPITAL NOTE TO PAY THE COST
THEREOF.
BE'IT RESOLVED, by the Town Board of the Town of South old, Suffolk
COunty,'New York, as follows:
SECTION 1. The purchase of an office machine consisting of a tax
extension computer for the Town of Southold, Suffolk County, New York,
is hereby authorized at a maximum estimated cost of $12,000.00.
SECTION 2. The plan for the financing of such maximum estimated cost is
by the issuance of a $12,000100 capital note here~y authorized to be
issued pursuant to the provisions of the Local Finance Law.

SECTION 3. It is hereby determined that the period of probable useful-
ness of such specific object or purpose is five years pursuant to sub-
division 52 of paragraph a of Section 11.00 of the Local Finance Law,
and that the proposed maturity of the note herein authorized will not
exceed five years.
SECTION 4. The faith and credit of said Town of Southold, Suffolk
County, New York, are hereby irrovocably pledged to the payment of the
principal of and interest on such note and an amount suff~icient to' pay
the principal of and interest on such note shall be inc!uded~ in the
annual budget and levied as a part of the taxe~ for each~ fiscal year
to pay the principal and interest becoming due and payable in such
fiscal year.
SECTION 5. Subject to the provisions of the Local Finance Law, the
power to sell said capital note is hereby delegated to the Supervisor
the chief fiscal officer. Said note shall be of such terms, form and
contents, and shall be sold in such manner as may be prescribed~by
said Supervisor, consistent with the provisions of the Local Finance Law.
SECTION $. The validity of such note may be ccentested only if:
1) Such note is authorized for an object or purpose for which said
T~n of Southold is not authorized to expend money,
2) The provisions of law which should be complied with at the date
of publication of this resolution are not substantially complied
with, and an action, suit or proceeding contesting such validity
is co~,~enced within twenty days after t_he date of such publication,
or
3) Such note is authorized in violation of the provisions of the
constitution.
SECTION 7. This resolution, which takes effect immediately, shall be
pyblished in full in the Long Island Traveler-Mattituck Watchman, the
official newspaper, together with a notice of the Town Clerk in sub-
stantially the form provided in Section 81.00 of the Local Fi~anceaLaw.

RESOLVED: That Supervisor Lester M. Albertson be and he hereby is auth-
orized and directed to transmit to our State Legislator a mecommendation
of this Board to make the following changes in the Fishers Island
Ferry District Act.
An ACT to amend Chapter six hundred n~nety-nineof the
laws of nineteen hundred and forty-seven entltled~"An
act authorizing the acquisition, construction, equipment
and operation of a public ferry forhire from Fisher~s Island
across waters of Long Island Sound; authorizing the erection
of Fishers Island Ferry district in the town of Southold,
Suffolk County and providing for the electio'n of its officers
and management of its affairs; authorizing theNcollection
of ferriage charges; authorizing the issuance an'd sale of-
obligations of said town and providing for their payment;
authorizing the lev~ and collection of taxes; and pro-
viding for other related matters'~ in relation to the
extension of said district, the qualifications of voters
and commissioners, and providing for a hearing on annual
estimates of revenues and expenditures of said district.
SECTION 1. Chapter six hundred ninety-nine of the laws of nineteen
hundred and forty-seven, entitle~ '~An act authorizing the acquisition,
construction, equipment and operation of a public ferry for hire from
~ishers'Island across waters of Long Island sound; authorizing
~reation of Fishers Island ferry district in the town of SoUthold,
Suffolk County and providing for the election of its officers and
management of i~s ~ffairs; authorizing the collection of ferriage charges;
authorizing the issuance and sale of obligations of said town andproviding
for their pa~lment; authorizing the levy and collection of taxes~ and
providing for other related matters" is hereby amended by inserting therein
a new section, to be section one-a, to read as follows:
$ 1-a. The Town Board of the Town of Southold, Suffolk .~ounty, mayextend
the Fishers Island Ferry District to include the entire territory of
Fishers Island pursuant to the applicable provisions of Article 12-A of
of the Town Law.
SECTION 2. The first paragraph of section 5 of such chapter is hereby amended
to read as f011~ws:
S 5. The affairs o~ the district shall be under the jurisdiction, control
and supervision of a board of five commissioners. The town board shall appoint
five resident taxpayers of the district who shall constitute the board until
their successors are elected andlhav~ quaiified pursuant to'~ the provisions
of thfs act. Successors to the members so appointed shall be elected by the
electors of the district as hereinafter provided. Every person who is an

own assessment roll Shall be eligible to hold the ~office of ferry commissioner.
The ferry' Commissioners shall have power and it shall be the~ duty of such
commissioners:
SECTION 3.~ Section 9 of such chapter is hereby amended to read as follows:
S 9. The annual meeting shall be held within the district at a place to
be fixed by the commissioners, The commissioners shall cause notice to be
posted in five public places in the d'~strict at least ten days before the
date ~f the annual meeting. The notice shall state the time, place and
object of the meeting and the hours that the pol~s ar~e to remai~ open.
The polls shall be open for a period of four hours to be fixed by the
commissioners, Voting shall be by paper ballet to be provided by the
commissioners. Such ballets shall conform as nearly as may be to ballots
for primary elections provided by section one hundred eight of the election
law. The expense of such annual meeting shall be a charge against the
district. Electors of the district qualified to vote for town officers
of the town of Southo!d at the preceding town election and owners of real
proDerty situate within the Fishers Island Ferry District assessed upon
the last preceding town assessment rol~ shall be eligible to
any annual election. The members of the board of commissioners shal'l be
the inspectors of election and at the close of the polls shall canvass
.... the vote and certify the result of the elction. A certificate Of the result
executed by the inspectors of election shall be filed in the office of the
town clerk 6f the town of Sou~hotd.
SECTION 4. Section 10 of such chapter is hereby amended to read as follows:
S 10. The fiscal year of the district shall commence on the first day
of January and end on the thirty-first day of December. The commissioners
shall prepare detailed estimates in writing of the anticipated revenues
and expenditures for such district for the purpose of determining the
amount of money required to meet the expenses of operation and maintenance
of the district and district property and improvements for the fiscal year
commencing on the first day of January next succeeding. Upon the completion
of such annual estimates, the commissioners shall adopt a resolution speci-
fying the time when and place where a ~ublic hearin9 will be held upon such
annual estimates and require the manager to give notice of such hearinG.
Such hearing shall b~ held on or before the 20th day of AuGus~ in each
year. Notic8 of such hearing shall be published once in one newspaper
having general circulation within the district at least ten days prior to
THE time of such hearing. At the time and Place specified in such notice,
the commissioners shall meet and review said annual estimates. At such
hearing any person may be heard in favor of or against such annual estimates
as compiled .ci~rfor or against any ~em or items therein contained. After
such hearing the commissioners may increase or reduce any item contained
in such annual estimates. (Such annual estimates Shall be prSpared and
submitted and action thereon ~aken by the town board of the town.) There-
up6n, the' Commissioners shall approve such annual estimates and submit the
same to the town board of the town for its action thereon in the manner and
within the time specified in section two hundred two-a of the town law.
The town board shall add to any such estimate installments of pr£ncipal
and of interest accruing during such fiscal year on any town bonds issued
to provide funds for the payment of the cost of acquisition, construction
and equipment of the ferry. The amount of such estimate as approved by
the town board shall be raised by tax upon all the taxable real property
of the district, at the same time, in the same manner and by the same
officers as town charge~ are raised by tax therein, and when collected
shall be paid to the supervisor of the town. All of the provisions of
section two hundred two-a of the town law, not inconsistent with the
provisions of this act, shall apply.
Section 5. This act shall take effect immediately.

authorized and directed to transmit to our State Legislator ~n act,
validating, ratifying, approving and confirming the acts'an~ proceedings
heretofore taken by the Town Board of the Town of Southo!d,~ Suffolk
County, in connection with the building zone ordinance adopted by
such board on April 9, 1957.
SECTION 1. All acts and proceedings of the town board of the town
of Southold, in the County of Suffolk, in connection with the~.~dopti0n
and enactment by such board of a building zone ordinance which was
adopted on the ninth day of April, nineteen~hundred fifty-seven are
hereby declared legal and validated in all respects, and a~! proceed-
ings and acts authorized thereby, and all acts, proceedings and things
heretofore undertaken, performed or done with reference thereto, are~
hereby validated, ratified, ~confirmed, approved and declared 'legal in
all r~spec~s notwithstanding a failure to post or publish a copy of
such ordinance, or the map adopted in conjunction therewith or_in-
corporated therein and/or a failure to file affidavits Of the posting
and publication thereof with the town clerk. ~ .....
SECTION 2. This act shall take effect immediately.

WHEREAS, the Superintendent of Highways ~has advised the Town Board
that the extremely icey condition of the roads this winter has required
extraordina~ryand extensive salting and that during such emergency it
was necessary that additional salt be purchased without delay, and
WHEREAS:, 'th~ Superintendent of. Highways has also advised the Town Board
that he deemed it necessaryto purchase said salt immediately and has
requested that .the TOWn Board ratify such purchase and approve the
paYment thereof, ~
NOW;~THEREFORE, BE IT RESOLVED: That the Town ~oard does hereby deem
Such purchase by the Superintendent of Highways to be in all respects
proper~and does hereby ratify such actions of the Superintendent of

NOW, THEREFORE, BE IT RESOLVED: That the Town Board approves the
acti6n of Harold Price, Superintendent of Highways, in the purchase
of said truck in ~ccordance with bids submitted.

MEETING OF FEBRUARY 26, 1962.
WE, the undersigned, being members of the Town Board of the Town of
southold, Suffolk County, New York, do hereby severally waive notice
of the time, place and purpose of the meeting of the Town Board to be
held at Greenport, in the Town of Southold, New York, on Monday,
February 26, 1962, and do hereby consent that th~ same be held on
said date for the transaction of any business which may properly

A special meeting of the Southo!d Town Board was held at the Town Clerk's
Office, Main Road, Southold, New York on Monday, February 26, 1962 , the
members of the Board having waived notice of the time, place and purpose
of the meeting. The meeting was called to order by the Supervisor, Lester
M. Albertson, at 10:30 P.M. with the following present: Supervisor
Albertson; Councilmen Demarest and Grathwohl; Justices Tuthill and Clark;
Town Attorney Tasker and Town Clerk Albert Richmond.
The following resolution was offered by Justice Clark who moved its
adoption, seconded by Justice Tuthill to wit:
WHEREAS, the Town Board of the Town of Southold heretofore authorized
the issuance of a deferredpayment note in the amount of $20,000.00
pursuant to a resolution adopted on February 2, 1959, in connection
with the purchase of real estate for use as a public bathing beach and
recreational area, which said note was dated and issued on March 3, 1959
