WHEREAS
, tax certiorari proceedings were commenced against the Town of Southold by
certain petitioners seeking reductions in the assessment for certain properties for various tax
years; and
WHEREAS
, Scott DeSimone, Special Counsel for the Town, has recommended settlement of
these proceedings pursuant to the Town Attorney’s Memorandum regarding “Tax Certiorari
Settlements” dated October 10, 2005; and

, the proposed settlements implementing reductions in assessments appear to be just,
reasonable, and in the best interest of the Town of Southold;

necessary to effectuate such settlements and execute the same

that pursuant to the provisions of Chapter 25 (Agricultural Lands) and Chapter 6
(2% Community Preservation Fund) of the Town Code, the Town Board of the Town of
sets Thursday, November 22, 2005, at 8:00 p.m., Southold Town Hall,
Southold hereby
53095 Main Road, Southold, New York as the time and place for a public hearing for the
purchase of a development rights easement on a portion of the property owned by Flower
Hill Building Corp.
Said property is identified as SCTM #1000-69.-3-10.1. The address is
50275 Ackerly Pond Lane, Southold, New York, and is located on the easterly side of Ackerly
Pond Lane, approximately 934 feet northerly from the intersection of Route 25 and Ackerly

Pond Lane (a/k/a Bowery Lane) in Southold. The proposed acquisition is for approximately
22.23 acres (subject to survey) of the approximately 27.1260 acre parcel now before the Town
Planning Department as a proposed conservation subdivision.
The purchase price is $35,000 (thirty-five thousand dollars) per buildable acre. The exact area of
the purchase is subject to a Town provided survey acceptable to the Land Preservation
Committee.
The property is listed on the Town's Community Preservation Project Plan as property that
should be preserved due to its agricultural value.
FURTHER NOTICE is hereby given that a more detailed description of the above mentioned
parcel of land is on file in Land Preservation Department, Southold Town Hall Annex, 54375
Route 25, Southold, New York, and may be examined by any interested person during business
hours.

LOCAL LAW NO. _18_ 2005
A Local Law entitled, “A Local Law in relation to Use of Historic Buildings in Residential Districts”.
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Section 1. Purpose.
The Town Board recognizes that the Town’s historic buildings, particularly those with national or
state status, are an important cultural, historic and architectural resource to Southold. The upkeep and
maintenance of these buildings is significant and organizations that seek to maintain the buildings in their
historic status will be permitted, by special exception from the Board of Appeals, to use the building for
community events, professional offices and an apartment.
Section 2. Code Amendment.
§100-31. Use regulations.
In A-C, R-80, R-120, R-200 and R-400 Districts, no building or premises shall be used and no
building or part of a building shall be erected or altered which is arranged, intended or designed to be
used, in whole or in part, for any uses except the following:

B. Uses permitted by special exception by the Board of Appeals. The following uses are
permitted as special exception by the Board of Appeals, as hereinafter provided, and, except for two-
family dwellings and the uses set forth in Subsection B(14) hereof, are subject to site plan approval by the
Planning Board:
(16) Preservation and use of a federal or state designated historic building for the purpose of
hosting community events, together with the use of part of such building for professional offices and/or
one (1) apartment, not to exceed a total of three uses per building, provided that such building is owned
and maintained by a not-for-profit historic organization. In no event shall there be more than one (1)
apartment per building.
§100-42. Use regulations.
In the HD District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any
use except the following:

IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
