HomeMy WebLinkAboutZBA-10/14/1965 Southold Town Board of Appeals -2- October 14~ 1965 The Chairman opened the hearing by reading application for a special exception~ legal notice of hearing~ affidavit attesting to its publication in the official newspaper, and notice to the applicant. THE CHAIRMAN: Is there anynne present who wishes to speak in favorof this application? MR. LATHAM: The picture of the sign is there. It states the names of the different businesses. MR. BERGR~: This is your own property: MRS. LATHAM: Yes. This sign was ordered by me and Mr. Latham knew nothing about it. It is now Where we would like to have it. THE CHAIRMAN: How far is this sign from the property line? MR. LATHAM: It is on the line. THE CHAIRMAN: It has to be at least five feet in 'from the property line. MR. BERGEN: You have to be five feet from any property line. On a corner you would have to.be five feet back and five feet in from the property line. MRS. LATHAM: What about all these other signs? Mrs. Mitchell's sign is right in line with our sign. THE CHAIRMAN: They are illegal signs. MRS. LATHAM: If we move it back we will be in an apple tree. We can't move it east, Mr. Latham has the property for sale. THE CHAIRMAN: If we granted you this sign, we would be granting you a pzivilege that is denied to everyone else. The sign shall be located on the property of Irving C. Latham, south side of the Main Road, Orient, New York. 2. The sign shall be located at-least five feet (5~) from any property line. 3. The sign shall be located at least three feet (3~) from ground level. 4. The sign shall be fourty-four inches C44") wide and have five (5) panels that are each six inches i(6") high. Vote of the Board: Ayes:-MR. Hulse, Mr. Bergen~ Mr. Grigonis. on motion by Mr. Bergen, seconded by Mr. Grigonis,. it was RESOLVED: WHEREAS Joseph Polashock,~hird Street, New Suffolks New York, petitioned the Board or'Appeals for a variance to the Zoning Ordinance, and paid the necessary fee of $5.00; and WHEREAS Joseph' Polashock thence withdrew his application, and notice of publication for a hearing was cancelled; NOW THEREFORE BE IT REHOLVED that the Board of Appeals return to ~Joseph Polashock thewS5.00 fee.
