There were present: Messrs: Robert:W. Gillispie, Jr.~ Chairman; Robert Bergent Fred Hulse, Jr., Charles Grigonis, Jr. Absent: Mr. Serge Doyen, Jr. PUBLIC HEARING: Appeal No. 812 - 7:30 PjM.~.S.T.), Upnn application of'George Wetmore, Greenport, New York, a/c E. Lionel Pavlo, 530 Fifth Avenuez New York, New York, for a variance in accordancewith the Zoning Ordinance, ArtiCle III, Section 303,~Article x, Section 1000A, for'permission to divide property. Location of property: west side BayshoreRoad, Lots No. 148, t49t 150a and North ½ of 151 in Peconic Bay Estates, Greenport, New York. Fee paid $5.00 The Chairman opened the hearing by'reading the application for a variance, legal notice of hearing, affidavit attesting to its publication in the official newspaper, and notice~Dthe applicant. $outhold Town Board of Appeals --¸2-- November 10~ 1965 THE'CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? Mr. George'Wetmore appeared before the Board to speak in favor of the application. He presented to the Board a filed map showing the property in question. THE CHAIRMAN: Is there a house on the lot to the west of this? MR. GEORGE WETMORE: No. THE CHAIRMAN: A statement is made here in the application that the remaining lots are all 50 foot lots. Is this a filed map. GEORGE WETMORE: Yes~ I believe it was filed in 1934. (It'was determined that the filed map in question was not made a part of the Zoning Ordinance.) THE CHAIRMAN: Is it true that there are houses on 50 foot lots in this area? GEORGE WETMORE: Yes. Most of the shorefront lots are 50 foot lots. THE CHAIRMAN: Do most of these lots have houses on them? FRED HULSE: Yes. GEORGE WETMORE: There are about 10 lots without houses on them. THE CHAIRMAN: What does Mr. Pavlo plan to do with the property after it~ is divided? GEORGE WETMORE: I think he plans to build on one parcel and sell the other. THE~CHAIRMAN: Are there any further questions? GEORGE'WETMORE: I would like to say this, I don~t think there is a lot down there that is 175 feet in width that'has been sold. THE'CHAIRFaa/~: Is there anyone present who wishes to speak against this appliuation? (There was no response.) Southold Town Board of.Appeals November 10, 1965 After investigation and inspection the Board finds that the applicant wishes to divide property thus creating two lots to be 87½ feet by 125 feet each. The Board finds that other lots in this immediate area are all 50 foot lots. The Board finds that most of the 50 foot lots have houses built on them. This division of property as proposed by the applicant, will in no way harm the character of th~district, it will in fact, enhance the character of t~e district-by creating two lots which~are larger than the other lots in this immediate area. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of ~this propert~y and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the~district. On motion by Mr. Hulse, seconded by Mro Bergen, it was RESOLVED that George Wetmore, Greenport, New York, a/c E. Lionel Pavlo, 530 Fifth Avenue, New York, New York, be granted permission to divide property and thus create two lots to be 87½ feet by 125 feet each. Location of property: west side Bayshore Road, Lots No. 148~ 149~ 150 and north ½ of 151 in Peconic BayEstates, Greenport, New York. This variance is granted subject to the following condition: 1. That~no future variance or variances will be granted for the reduction of side yards, rear yards or front yar~ setback on either of the two lots created. CE.S.T.), Upon application of JerryShulman and Wife~ Belle Terre Road, Port Jefferson, New York, for a var~ce in accordance with the Zoning Ordinance, Article IV, Section 410,(g)~ Article X, Section 1007 (e), for permission to erect an addition to a non-conforming building. Location of property: south side Sound Avenue~ Mattituck~ New York, bounded north by'Sound Avenue~ east and south by Long Island Railroad, west by Jefferson Stovalo Fee paid $5.00. THECHAIRMAN: As we understand it~ this addition will not change the exterior dimensions of the buildings. JEP. RY SH~: That is right. (The Board viewed the sur~ey of the prop. in question. It was determined that part of building is on the highway.) THElCHAIRMAN~ Are there any'other questi. would like to ask? MR. TPIE-CHAIRMAN: Is there anyone present-who wishes to speak against this application? ~There was no response,) After investigation and inspection the Board finds that the applicant wishes to erect an addition to a non-conforming build- ing. This addition will join the two present buildings together. This addition will house trucks that wish to load or unload their shipment. The Board finds that with this addition the applicant will be able to operate his business in bad weather~ and freezing temperatures. WithoUt this addition~ the operation of the applicant is haulted in bad weather. The Board points Southold Town Board or,Appeals -5- November 10, 1965 out that the addition will not create a traffic hazard~ it will in fact, reduce the waiting period for trucks and thus reducethe traffic hazard. The trucks will not have to wait on the street to~oaded or unloaded. The Board points out that this addition will not harm the character of the district, in view of the fact, that there are other business operations in the immediate vicinity. In general, the Board is in agreement with the reasoning of the applicant as presented to the Board in the application. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district. On motion by Mr. Bergen, seconded by Mr. Hulse, it was RESOLVED that Jerry'Shulman andWife, Belle Terre Road, Port Jefferson, New York, be granted permission to erect an addition to a non-conforming building located on the south side SoundAvenue, Mattituck, New York, bounded north by SOund.Avenue, east and south by Long ISland Railroad, west by Jefferson Stoval. Vote of the Board: Ayes:-Mr. Gillispie, Mr. Bergen, Mr. Hulse, Mr. Grigonis. Mro John Nickles from Lewis Realtors appeared before the Board to discuss informally the application or'William Jackens and wife, for permission to build a two family dwelling, on property located in Bayview at $outhold. The Board viewed the tax map, locating the property in question. The Board did not indicate whether or not this application would be approved. However, they stated that if they did approve the application, the following restriction would be enforced: That~when the applicant sold the house and property, or when the 'applicant~s mother no.longer resides on the premises, the two family dwelling shall~reveft s.to a one familydwelling. The Chairman advised Mr. Nickles that be wanted to be sure that the applicant fully understands the condition. Southold Town Board of-Appeals -6- November 10, 1965 On motion by M_r. Gillispie, seconded by Mr. Hulse, it was RESOLVED that the Southold Town Board of Appeals set 7:30 P.~'.(E.S'.T.')~- Wednesday~ November 24, 1965, at the Town Office, M~in Road, Southold, New York, as time and place of hearing upon application or'William J. Jackens, and wife~ 150-39 84th Street, Jamaica, New York, for a special exception in accordance with the Zoning Ordinance, Article III~ Section 300, Subsection 5 (b), for permission to erect a two family dwelling. Location of property: north east corner of Ed~s Road and Summit~Drive, Bayview in Southold, New York, bounded north by Albert Wurth, east by Joseph Gutierrez, south by Ed's Road, wes% by'Summit Drive. Vote of the Board: Ayes:-Mr. Gillispie, Mr. Bergen~ Mr. Hutse, Mr. Grigonis. On motion by Mr. Hulse, seconded by Mr. Grigonis, it-was RESOLVED that the Southold Town Board of Appeals set8:00 P.M.'{E~'S.T.)~-Wednesday, November 24, 1965, at the Town Office, Main Road, Southold, New York, as time and placeoof~hearing upon application of Florence Moffat, Boisseau Avenue~ Southold, New York, for a variance in accordancewith the Zoning Ordinance, Article III~ Section 303, Article X, Section 1000A, for per- mission to divide property: Location of property: east side Boisseau Avenue, Southold, NewYork, bounded north byD. Tuthill- H. Tuthill, east by Jos. Krukoski, south by'C. Salters-Blados, west by Boisseau Avenue-Wheeler. Vote of the Board:Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Hulse, Mr. Grigonis. On motion by'Mr. Gillispie, seconded by Mrl Bergen, it was RESOLVED..thatthe minutes of the Southold Town Board of ~Appeals dated October 28, 1965, be approved as submitted.
