If it had been after~: it would ha~been approved by the Planning Board. There'w~re certain situations wh~pe they had to leave some 65 foot lo~s to square out the lines. What is the size of the otherlots in this area? MRS- LOGAN: My lot is 150 feet by 150 feet. Mr, SorensonSs is 150 feet by 150 feet. Reverend Jacobs® was 250 deep, 135 feet on the front and tapered down to about 80 feet, but I am guessing on that. WILLIAM SORENSON: I would like to speak in opposition to this. This is a self created and self imposed haw~hip. RUSSETJ, MANN: He chose to change this property in this manner. I think he has created this whole situation himself. MR. LI~U~AN: Whoever put a house on this property would have to put up a mininum size house. RICHARD ~SMER: He just purchased this property in a matter of months ago. WTTJ,IAM SORENSON: To protect his house andhis property he bought this land. But he doesn't care about the rest of the property owners in the area. RICHARD OSMER: What is happening here is that he has 2 1/3 lots and he wants to put three houses on here. MR. LOGAN: The majority of the lots in the area are 100' lots. (Mr. Steve Simmons, it was determined~ had 30 feet frontage on the road, however he had plenty of area.) THE CHAIRMAN: It appeares that Mr. Cornell has created his own hardship~ The applicant says in theapplication that without the variance, applicant would be required to retain a larger area than commensurate with the applicant's needs. Southold Town Board of Appeals -4- January 2~, 1965 A lenghty discussion was further held on the property in question and its division. Through discussion it was determined that this lot was originally owned by Robert Bergersun. The size of the lot was orig/nally 200 feet by 100 fee~- The property was then bought and divided three ways. Mr. Jacobs had 200 feet by 35 feet, Mr. Cornell had 100 feet by 65 feet on Christo~r SSreet~ and Mr' Beale had 100 feet by 65 feet with no road ~rontage. Mr. Cornell bought the property back. from Mr. Beale, thus creating the present situation that he is requesting a variance for. THE CHAIRMAN: Are there anyonother questions concerning this application? i(There was no response.) THE CHAIRMAN: Anyone at all wish to say anything else in regard to this application? i~There was mo response.) After investigation and inspection the Board finds that the hardship noted in the application is self-created. The applicant joined with two other adjoining property owners to purchase a fourth lot, which was then subdivided into three lots, particularly to enlarge the present lots of the purchaser. Subsequently the applicant purchased the enlarged portion of the Beale lot, joining .it to his portion of the lot. It was purchased for the purpose of enlargement. He would thus have 2/3 of the original lot purchased for enlargement and he required a variance. His hardship stating that the area he now owns is more than what he needs, the Board finds that this proposal is a result of a hardship which the applicant entered into willingly. The Board finds that strict application of the Ordinance will not produce practical difficulties or unnecessary hardship; the hardship created is not unique and would be shared by all properties alike in the immediate vicinity of t~i~ property and in the same use district; and the variance does~serve the spirit of the Ordinance and will change the character of the district. On motion by Mr. Gillispie, seconded by Mr. Hulset it was RESOLVED that Arthur Cornell, Oakwood Drive~ Southold, New York, be denied permission to divide and set off a lot with insufficient frontage~ on property located on the north west corner of oakwoodDrive and Christopher Street,-Southold~ New York. However, there was an error .in the application. The Chairman was to confer with the Town Attorney and notify the Secretary if the application was accepted so that legal notice could be published. On motion by Mr. Gillispie,~ seconded by Mr. Bergen~ it was RESOLVED that the Southold Tewn Board of Appeals set 7:30 P.M.'i~S~), Thursday, FebrUary 4, 1965, at the Tewn Office, Main Road, Southold, New York, as time and place of hearing upon application of'Service Sign Company, Inc., 417 W. 126th Street, New York, New York, a/cMullen Motor Sales, Main Road, Southold~. New York, for a special exception in accordance with the Zoning Ordinance, Article IV, Section 408, Subsection iCc),~ for permission to erect an on the premises s~gn. Location of~property: south east corner of Main Road and CottagePlace, SouthoId~ New York~ bounded north~ry Main Read~ east byR. P, Glover, south by Daniel Finne~ west by Cottage Place.
