There were present: Messrs: Robert W. Gillispie, Jr., Chairman; Fred Hulse, Jr., Serge Doyen, Jr. Absent: Charles Grigonis~ Jr., Robert Bergen. PUBLIC MR. JAMES OLSEN: I am sure the Board is familar with the situation there. I can not figure out any other way of doing it. I have removed the roof sign. TRE CHAIRMAN: Is there anyone present who wishes to speak against this application? (.There was no response.) After investigation and inspection 'the Board finds that James Olsen wishes to erect a sign on his Real Estate Office, located on the Main Road, in Mattituck~ This sign will be placed on the esterly side wall. The angle of the road and the propertly line is such that a sign is not-easily seen if placed on the front of the building. Surrounding trees also make it difficult to see the building, and a sign, if it was placed on the front of the building. The Board finds that this sign will be 21 inches high by 51 inches long~ and will be illuminated. The Board finds that the public convenience and welfare and justice will be served and the l~gally established or. permitted use of neighborhood property and adjoining use districts will no be permanently or substantially injured and the spirit of the Ordinance will be observed. On motion by Mre Gillispie, seconded by Mr. Hulse, it was RESOLVED that James Olsen~. Main Road,~Mattituck~ New York~ be granted permission to erect.a wall sign on the easterly wall of the building located south side Main Road, Mattituck,. New York. THE CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that James Olsen wishes to place a ground sign on his Real Estate Office property located in Mattituck. The Board finds that this sign will be less that'the total square footage that is permitted~_for an on premises business sign~ however~ it will have additional height. This sign needs more height in order to be seen traveling in an easterly direction, The Angle of the road and the property line~, combined with the treess and a non-conforming ground sign on the adjoining property~ block the~!sion of a sign with normal height. The Board finds that this sign will be 7~ feet wide by 9~ feet long. The Board finds that the public convenience and welfare and j~stice will be served and~he legally established or ~ermitted use of neighborhood property and adjoining .use 'di~tficts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. SOUTHO~D Tow.n Board of App~ls -5- February 1~F 1965 After investigation and inspection the Board finds that Caberon Properties, Inc,~ wishes to place a directional ground sign' on the property of the Case Estate. The B~rd finds that the owners'of this property have given permission to place this sign on this particular property. The Board finds that this sign will be doubled face, and read "Cedars Golf Club, Open to Public", The sign will also have a directional arrow on it. This sign will be 5 feet wide and 3½ feet high. The Board points out that thissis a directional sign, directing the public to a place of amusement. THE CHAIRMAN: Was this Cottage in question part of the hotel operation? FLOYD KING, JR: Yes. It was divided into 3 parts when my f~ather died. THE CHAIRMAN: How many cottageswere there originally? FLOYD KI~IG~ JR: There were 10 cottages. THE CHAIRMAN: Now, tell us what is directly south of this cottage in question. FLOYD KING, JR: Directly to the south is one family dwelling which is summer cottage~ also was part of the hotel operation. The next house is four apartments in a business zone. That was part of the hotel operation. Formerly ithad eight bedrooms. The next house is three ~apartments~ formerly used in connection with the hotel operation in the business zone. The next house is being remodeled into five apartments in the business zone. This house is directly on the water. The next one is Orient-Worth. Across the street is the hotel. THE CHAIRMAN: Now,going north what is in the area? FLOYD KING, JR.: The first house was my parents home. That is a one family dwelling in the business zone. ~he next cottage is used as one family summer'residen~e. This was with the hotel operation. Across the street is one family dwelling used as a tourist house. The owner has a number of rooms that she rents. The next house ~on the same side of the street is a summer home. The summer people own it. The ne~t property borders on the Orient Historical Society property. THE CHAIRMAN: W~nat is directly north of the house in question? Southold Town Board of Appeals -~- February ~, 1965 FI~YD KING, JR: On the north there is a one family dwelling, year ~ound; and north of that is a ~one family dwelling year around; north of that one family dwelling is another large house that is a one family d~elling~ I believe that 'the business zone in this area runs as far assLatham's property. THE CHAIRMAN: Beside these one family dwellings, the neighborhood is of multiple character. Is there anything further on this application? FLOYD KING~ JR.: The plan is that if they can use the ustairs as an apartment it will help to deface from the exp~nse of redecorating the house. It has two complete bathrooms. MR. HULSE: How many rooms are in this house in question? FLOYD KING', JR.: There are six rooms. Four downstairs and there are two upstairsl MR. HULSE: What is the size of the plot? FLOYD ~ING, JR.: 70~ by 90' approximately. There is room on the south side of the house for a driveway~ and I can not see any reason why one car can't fit behind the other there. THE CHA~: Are there any other questipns in connection with this application? (There was no response.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that Floyd F. King~ Jr., wishes to convert a building into a two family dwelling. This building was formerly a cottage used as part of a hotel operation, as an individual cottage. The building already has two complete baths and one lavatory. The Board finds that this was part of an estate divided into three parts, this particular cottage being part of the property left to Floyd F. King~ Jr. The Board finds that this conversion will not change the character of the district in view of the fact that there are many homes on both the north side and south side of this street that are summer homes with more than one ~amily each. There are only three homes in this area that are one family dwellings year around. PUBLIC HEARING: Appeal No. 742 ~ 8:45 P.M. (E.S.T.), Upon application of Long Island Lighting Company, 250 Old Country Road, Mineola, New York, for a special exception in accordance with the Zoning Ordinance, Article III, Section 300, Subsection 6a, for permissiontto establish a new electric distribution substation. Location of property: west side Mill Lane, Peconic, New York, bounded north by land now or formerly of Abraham Becker ~ Ano. east by Mill Road, south and west by land now or formerly of Abraham Becker & Ano. Fee paid $5.00. THE CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? PERRY HATCH: Gentlemen of the Board, I represent the Real Estate Department of the Long Island Lighting Company. Our attorney, Ann Meally will speak for this application/ Southold Town Board of App~e~ls -9- February 18~ 1965 ANN MEALY, ESQ: As you have said, Fir. Chairman,. pursuant to Artic3s III, Section 300, Subsection 6a~ of the Southold Town Building Zone Ordinance, this is an application to erect an substation. The substation will be located in the area you have specified. This area is sparsely settled. This would be constructed on vacant land. The reason for this application is there is an increasing demand upon the long Island Lighting Company, both in the number of customers and the amount of electric power required. THE CHAIRMAN: What does an electric substation do? ANN MEALY, E~Q.: We have an engineer here who can answer that question? FRED MEALY, Engineering Departmentt LILCO: There are several types of substations that service communities. The type of subs~on that we are interested in here is one that transform voltage from higher voltage to lower voltage. If there were 23,000 volts coming into this substation~ it would be cut down to 13,000 volts. We now have two substations out here. One In Mattituck and one in Southold. The distance between th~Se two stations is 13 miles. The voltage gets very low near the end of the line. We feel that we need a substation in the Peconic area. The two stations in MattitUck and Southold, are not sufficient to take care of the increasing demand for electricity. THE CHAIRMAN: This will directly benefit the Peconic area~ and indirectly benefit the Mattituck and Southold area. FRED MEAL~: The Peconic area is serviced from a long distance which makes the ~oltage very low in this area. THE CHAIRMAN: Does anyone here have any questions they would like to ask? MR. JAMES: Is this going to be the same thing as is in Mattituck? FRED MEALY: NOo Ann Meally~ Esq. presented a photograph of what the p~posed substation would l~k like. This was passed around the room so that everyone present could view it. DR. RADZIEWICZ~ Mill Lanet Peconic: You mentioned that th~ze is a substation in Southold and one in Mattituck. Why does this one have to be located in peconic. Why can't it be put in an area like the town dump? Southold Town Board of App'~ls February ~ 1965 FRED ~Y: I am not familiar with the Town dump. There are several factors that lead to the decision for the location. First we are located in the middle of the Mattituck substation and the Southold substation. It is most desirable from our point of view because this site is right along the present transformer lines. This property gives a good access to the road, which gives us a means of getting our equipment in and out. Thisarea is sparsely settled and the operation would be quite far back from the road. MR2 JAMES: I don't think anyone would like to see that in their back yard. ~I am 200 feet from Sound View Avenue on the west side of Mill Land, toward the sound. THE CHAIRMAN: The area where this is proposed is mostly wooded area. MR.' JAMES: There are alo%~$f homes in that area. FRED MEALY: The area in question is all wooded area. DR. RA~ZIEWICZ: That is not sparsely settled. KENT RENN~.?~,~ Lane, Peconic: There are many homes in this area. This is residential area in character, If we allow this in there,we are not doing the residential homes any good. THE CHAIRMAN: Substations ars necessary to all the residents. The Long Island Lighting Company has photographs of substations that are elsewhere, and they are very well landscaped. The point has been made here, that this particular location is directly on the transmission line. This facility will add to the comfort of the residents. ~RNT RENELL: If you place this in a residential area such as ours it will black the area. I certainly would not build a home next to it. THE CHA~: It looks as if this is to be placed about 288 feet back from the Mall R~ad. FRED MEAI,r;f: It is about 285 feet. ANN ME~T.T.Y,' ESQ.: Would this be landscaped in any way? FRED MEALLY: Yes. (Dr. Radziewicz then read a statement that he had prepared informing the Board of his objection to this substation. He felt that such an installation would devaluate his property which he informed the Board was of much value to him.) S~uthold Town Board of AppeaSes -11- February 18~I1965 MRS. RADZIEWICZ: I don~t think-we need a substation here. We have one in Southold and one in Mattituck, I don~t see Peconic as the middle. Peconicwould be 1/4 of the way. The Town-Dump would be a better location. We have a jetty now down at the sound and it has been .drawing people there. The people are coming to build homes and live there. FRED MEALLY: I would like to point out that the highest point of this structure will be w24 feet. KENT RENNELL: What other substation of this type have you constructed and where~ FRED MEA?,?.Y: At OrientPoint in this general area. That is the most typical. MR, HULSE: Is this the same type of substation that is near the &rive-in theatre in Greenport? PERRY HATCH: It is similar. This substation will lower the voltage. FRED MEALL¥: Whenlwe speak of our'Southold substation, it isn't actually$outhold. The substation is ,located between ,Southold and'Greenport. MRS. MALEK:Peconic: Will there b~ any noise from this substation? FRED MEALLY: No, there will be nome. ~(Fzr. Meally then went on to explain the operation of the substation and how the voltage would be cut down by this installation.) THE CHAIRMAN: Will this be visible from the road? FRED ME~Tw,Y: The whole thing would not be visible. You could see a small portion of the steel structure from the road. TWM. CHAIRMAN: How high is the present transmission tower? - FRE~_MEALLY: About 40-45 feet. THE CHAIRMAN: Do you plan to screen in this area. PERRY HATCH: This will be screened in in future years. We plan to plant scotch pines. Southold-Town Board of~A~eals --12- February 18, 1965 HENRY~SMITH: On these high tension powe~ lines, I have no objection. I have no objection to putting a substation there. I think it is good for the community. ANN MEALLY, ES~j: Will there be any discharge, or any refuse ~or sewage? MI{. FRED MRALL~: "The substation will be surrounded by a seven foot chain link fence with an additional foot of barbed wire attached along its top. All structures and equipment components will be of modern design and operation. The substation will not discharge any refuse, sewage or effluent. The proposed installation will not emit obnoxiuos gases, odors~, dust, smoke or soot and it will not cause a distribing noise, Traffic flow to and .from the station will be minor, since the station is normally unattended". (mr. M~llywas reading from the booklet pressnted to the Board.) THE CHAIRMAN: There will be no oil trucks, or no buildings ? .MR. MEALLY: The station will not house any personnel. MR. JAMES: Will this have the same appearance as shown in the ~icture? MR. MEAT.T.Y It would be the same as the picture. MR. JAMES: Would you like to see this in your ba~k yard? This is an eye-sore. 300 feet isn't very far away when you own 250 feet off the r~oad yourself. MRi MEALLY: we have built substations in various parts of Long Island. Houses have been built after the substaion has been built. This will not effect the quietness of the neighborhood. THE CHAIRMAN: How manysubstations have you built in ~e last five years on'Long Island? MR. ~EALLY: I would ~/ke to rule out.the large stations~ They do not apply here~ I would say six or eight. There may be more. THE' CHAIRMAN: Then that would-average about one a year. MR. MEAT.T.Y: Yes, that is right. KENT RENNELL: How ~many'of these six or eight substations have been built on Eastern Long Island, and where? On the Sag Harbor Turnpike, about ½ mite south of~Sag Harbor. i~discussion was then held on the location of other substations on eastern Long Ialand.) PERRY HATCH: I might say at this time, that in every case, we make every effort to locate our facility in a suitable area, and sometimes we are very limited. This is one of our problems. A substation located inCutchogue would not serve the purpose. We have to locate our substation in order to obtain maximum effieiency. We can not bring the electricity from the east to the west. MR.' JAMES: This property would not be desirabls to purchase with this monstrosity abudding my property, I have children, and'I am proud of my home, but I am loseing money with this in my back yard. MR.' MEAT~.¥: This location is right along our power line. It is necessary that we have maximum effieiency. -- MR~ RADZIEWICZ: It is only a mile further to the Town dumpj You~op~e haven't looked far enough. I 3ust put up a~beautifulhom~,, and I would like to keep it beautiful. MR. JAMES: I am sure that if you were looking for land of this type for the subst~ion~ that you would find someplace else between $outhold and Cutchogue. MRS.'~RICH: What would be the future feeling of the Board in changing the zone near this appeal 'if it is granted. Would future applications be accepted by the Zoning Board. THE CHAIRMAN: Such an application would not come to this Board. A change of zone application would go to the Town Board for their consideration. PERRY HATCH: I think at this time I would like to say one- other thing~ All that was~needed to ¢omstruct this site is one ac~e. 'We purchased a great deal more so that we could leave the natural wooded area. So that we can leave the station screened from the open area. We didn't buy this additional property just to throw our money away. MR. JAMES: How would you get in and out of'this place? RADZIEWICZ: We are the ones that live there and have to look at this thing. PERRY HATCH: You will see very little during the summer. This will be screened in. I would like to say that Long Island Lighting has the interest of the people at heart. i(Th~e was much discussion in regard to other possible locations for this substation. The opinion of most was ~t this should be located someplace else besides the locatioh selected by Long Is]and Lighting Company.) Is there anyone else who wishes to be heard on this application? (~here was no response.) THE CHAIRMAN: Are there mnyother questions any one would like to a~ ? There was no response.) T~E CHAIRMAN: I will declare the hearing c~sed at this time. After investigation and inspection and public hearing~ the Board finds the following: The Board finds that the permissive use is to establish a substation for the distribution of electric power in the Peconic area~ located approximately half,way between the ~attituck and Southold facilities of the Long Island Lighting Company. It is evident that a shortage of electric power will exist Dy the summer of 1965, due to the increasing use of electricity by present custiomers and the addition of new cust~omers. Under New York State'Law~ Long Island Lighting Compan~ is obligated to furnish this facility. Southold Town Board of ApP%~ls -15- February 18, 1965 The Use will not prevent~orderly and reasonable use of adjacent property, or of legaltyestablished uses in the vicinity. It is the Board's opinion that the safety, welfare~ convenience~ and comfort of the Town will be enhanced by the construction of this substation. The use will prommte the orderly development of the Peconic area as well as indirectly assist the Southold and Mattituck area. The area surrounding the proposed site is partially wooded,~ relatively sparseley settled, residential and agricultural in character. The wooded area of the proposed site will largely screen the substation from Mill Road andSo~nd View Avenue~ and it is on the existing to~er transmission line. It is the opinion of the Board that it will be very difficult to-locate this facility so necessary to the economy of the Town, in a more favorable location. Assistance in choosing the present location was rendered by the Town Supervisor. Testimony of the Long Island Lighting Company Engineering Department indicated that a substation must be reasonably close to a transmission line to be economical and effective. The Board of Appeals finds that an immediate need exists and that the conservation of property values, as well as future development and enhancement of property values requires a constructive approach to the reasonable and necessary requirements of this p~posed utility expansion. The futmre development of the Town and expansion of.utility service are inseparable~ In this application, Long Island Ligh~ng'Company has contracted to buy, subject to the approval of this use, a considerably larger plot of approximately 3.2. acrss; more than required by this facility. The actual area to be used will be about one-half acfe~ which will be enclosed by a seven foot chain link fence~ topped with barbed wire. Maximum height of 2proposed facility is projected at ~24 feet as compared to the present tower line~ whose voltage lines are approximately 40 feet above ground level. Any further expansion is to be l'ocated within the fenced area noted above in the northwest cormer of property at approximate distances as follows: 280 feet south of Mill Road, at closest point and 450 feet west of Sound View Avenue and Mill Road intersection. A considerable portion of these distances are ~hly wooded as shown in the aerial ph~tograph~ Exhibit~, in the appendix to-the application. Southold Town Board of-~p~als -16- February'8 ~ 1965 Principal objections by persons at thehearing were of an aesthetic nature, however, applicant's site is largely screened by wooded land and will be furtherTscreened by evergreens to be to the north. Further'objections concerned the depreciation of property values of the objectors.
