A regular meetingof the Southold Town Board of'Appeals was
held 7:30 P.'M.~,a Thursday~ March 18, 1965~ at the Town Office~
Main Road,, Southoldm New York.
There were present: Messrs: Robert'W. Gillispie~ Jr.~. Chairman;

PUBLIC HEARING: Appeal No. 752 - 7:30 PjMZ'~jS.T~') Upon
application of M. Winiarz, a/c North Fork Liquor Corp.~ for
a review of a previous action of the Board of Appeals to modify
same by adjusting the easterly side line established in said
action. Location ofproperty: north side Main Road~, Matti~uck~
New York. Fee paid $5.00.
The Chairman opened the hearing by reading application for
a variancez~ legal notice of hearing~ affidavit attesting to its
publication in the official newspaper, and notice to the applicant.

After investigation and i~spection the Board finds that
Micislaus Wini~z is requesting a review of an action of the
Board of Appeals. The Board finds that the decision made in
Appeal $709 is impractical to the applicant. If the building
was to be located in the position that is stated in Appeal
number 709~ the applicant would not be able to obtain maximum
use from the buildingj TheBoard finds that the requested change
in the sideline requirement of 3 feet minimum to 4 feet minimum
in the front of the building and 1 foot from the line at the
rear of the b~ilding will overcome this difficulty.
The Board finds that strict application-of the Ordinance
will produce practical difficulties or unnecessary hardships;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and'the variance does observe
the spirit of' the Ordinance and will,not change the character
of the district.
On motion by Mr. Bergen~i seconded~by Mr. Gillispie~ it was
RESOLVED that M. Winiarz, a/c North ForkLiquor'Corp.~ Main
Road, Mattituck~i New York~ be 'granted permission to locate~
the proposed building on the lot on the north side of the Main
Road~ Mattituck~ New York, as stated in the application to
the Board of'Appeals~ number 752~ and that the decision of the
Board of Appeals made in,Appeal $709, dated August 31~. 1964z: be
reversed.

application ofWilliam Wickham,. a/d Fred Caldwell for a variance
in accordance with the Zoning'Ordinance~ Article III~ Section 303,
and Art'icleX~. Section 1000A~ for permission to divide a lot with
frontage on two streets. Location of property: Fleets Neck,
Cutchogue, New York, bounded north by Primavara~ east by Stillwater
Avenue~ south by Arthur Sherrard~ and west'by Pequash Avenue.
Fee paid $5.00.

against this application?

After investigation and inspection theBoard finds that
Fred Caldwell wishes to divide a lot which has frontage on
two streets. This lot does not have sufficient frontage on
either street. Ho~ever~ there are eight lots on Fleets Neck
Road and Stillwa~er'Avenue, the location of the lotin question,
which have been held in single and separate ownership that thave
frontage on the road ranging from 60 feet to 108 feet. Before
division the lot is 300 feet in depth~ which the applicant feels
is too large for a single residence. After division the lot on
Fleets Neck Road would be approximately 12i150 square feet and
the lot on Stillwater~Avenue would be 9,.825 square feet. Both
of these lots would be in keeping with the character of the
neighborhood.
The Board finds that strict application of the Ordinance
will produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the~same use district; and the variance does observe the spirit
of the Ordinance and will not change the character of the district.

RESOLVED that the William Wickham, Esq.,. a/c Fred Caldwell,
Malibu~California~,be granted permission to divide a lot with
insufficient frontage and area. Location of property: Fleets
Neck, Cutchogue, New York.
Vote of the Board: Ayes: Mr.-Gillispie,, M_ri Bergen, Fir. Hulse.

application of Caberon Properties,_Inc., Cutchogue~ New York,
fora special exception in accordance with the Zoning Ordinance~
Article III~ Section 300~Subsection~ll~ and Article IV, Section
408,~ Subsection (a), for permission to erect a directional sign.-
Location of property: south side Main Road,-Cutchogue, New York,
bounded north by Main Road, east by J. Hand~, south by J. ~ommer,~
and west by J. Sommer. Fee paid $5.00,

THE CHAIRMAN: Is there anyone present who wishes to speak
in fa~orof this application?
RICHARD CRON~' ESQ,: I speak in behalf of the applicant. The
application speaks for itself. This sign is an absolute essential
to the golf course. This will be the only place~where we will
have a sign on the Main Road. We would hope that the sign will
fit in with the rest of the community. It would~t~awful
looking sign. We wouldn't want it to be. If it was, it would
be detrimental to the golf.course as well as to the town. We hope
that the Board w~ll give favorable consideration to this applicatimn.

After investigation and inspection the Board finds that
'Caberon Properties~. Inc. request permission to erect a directional
sign on the property of Edward J. and Jean A. Munsono Said
owners of the property have given the applicant written permission
to erect a sign on their property. The Board finds that this
sign will be advertising a Par 3 golf course situated in Cutchogue.
It is the policy of the Board to grant directional signs which
guide the traveling public to places of lodging~ eating, ~I

amusement areas~. Marina~. etc.
The Board finds that the public convenience and welfare
and j~stice will be s~zved and the legally established or
permitted use ofneighborhood property and adjoining use
districts will not be permanently or substantially injured
and the spirit of the Ordinance will be observed.
On motion by Mr, Gillispie~ seconded by Mr. Hulse, it was
RESOLVED that Caberon properties, Inc.~ Cutchogue, New York,
be granted permissio~.t'o erect a sign on the property of Edward J.
and Jean A~ Munson. Location of property: south side of the
Main Road,~Cutchogue, New York. This special exception is g~anted
subject to the following conditions:
The sign shall,be no larger than 4~ by 64.
2. The sign shall be located in the westerly part of the
property.
3. The sign shall be located five ~) feet from any property
lineo
4. The sign shall be three .(3) feet~a~ove ground level.
5. If and when the Town establishes a uniform procedure for
signs, this sign will not be excluded.

application of Julius Gates~ $outhold, New' York~ for'a-~special
exception in accordance with the Zoning Ordinance,. Article IV,.
Section 408~ Subsection ~a) for permission to-reduce the
required height of an on premises ground sign. Location of the
property: north side Main Road, Southold~. New York,~ bounded
north by'A/W. Stokes~. east bylA~W%' Stokes~-south by MainRoad,
and west by Town proPerty. Fee paid $5100,

After investigation and inspection the Board finds that
Julius Gates wishes to erect~a sign with the top of the-sign
onl~ three feet from ground level. This sign will be 3 foot by
2 foot and read "Real Estate,. Three Village Realtya Lico Real
Estate Brokers~ Julius Gates~ P~E'~" It is the opinion of the
Board that this sign will be in harmony with the Business District
in this particular area where the sign is to be located~
The Board finds that the public convenience and welfare
and justice will be served and the legally establ~ed or
permitted use of neighborhood property and adjoining use districts
willnst be permanentlyor substantially injured and the spirit
of the Ordinance will be observed.
On motion by Mr. Grigonis,~ seconded by Mr~ Bergen, it was
RESOLVED that Julius Gates, $outhold, New York~ be granted
permission to reduce the required height ~f an on premises ground
sing. Location of property: north side MainRoad, $outhold~
New York~ This application is granted subject to the following
conditions~
1. The sign shall be located five ~5) feet from any property
2. The sign shall be at least one (l) foot above ground~east
levell
3. This sign shall be 3 feet by 2 feet.
