Worth and others, Peeonic, New Yerkw for a variance in accordance with the Zoning Ordinance~Article III~ Section 303, an~.Article X~ Section 1000A~i for permission to divide lot with insufficient area. Location ef property: east side Mill Lanea Peconic, New York,;.-bounded north by MiamiAvenue,. east by Goldsmith Inlet,. south by Fowler,~ west by Mill Road. Fee paid $5.00. The Chairman opened thehearing by reading application for a variances, legal notice of hearing#~ affidavit attesting to its publication in the official newspaper~ and notice to the applicant. Chairman~ and members of the Board~ this contract was drawn up from the lots that were originally in Bailly 'Park. ~ A discussion was held in regard to the size of the lots at present compared to what they were in1926 as shown on the map of Bailly Park presented ~y Mr. Edson). THE CHAIRMAN: Is there anyone present who wishes to speak against this application? ~There was no'~.~ponse.) After investigation and inspection the Board finds that Dorothy M. Worth and others wishes to divide a lot,. thus making two lots with insufficient area. However~ both lots will have sufficient ~rontage on the road, The Board finds that this is a reasonable request~ and is in agreement with the reasoning of the applicant~as stated in the application to the Board. The Board finds that this situation is common to shorefront property as it follows the course of the creek. The Board finds that strict application to the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be .shared by all properties alike in the immediate vicinityof this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district. On motion by Mr. Gillispie, seconded by Mr. Bergen,. it was RESOLVED that Lefferts P. Edson,. Esq./ a/c'Dorothy and others,'Mill Lane~ Peconic, New York~ be granted permission to divide a lot with insufficient ~?~%?~&.~E onproperty located east side Mill Lane, Peconic, New York~ subject ~ the following condition: This present Board is not willing to consider any side yard or front yard variances for the construction of a dwelling on these two properties. To) Upon application or'Clement T. Brown, Knollwood ?.B~e,. Mattituck, New York, for a variance to the Zoning Ordinance~ Article III, Section 307# for permission to amend a building permit to construct an attached garage. Location of property: south side Knollwood Lane, Mattituck~ New York, bounded north by-Knollwood Lane, east by Gilbert'Callahan~ south by Edward Slaga, west by-Charles KOehlero Fee paid $5.00. The Chairman opened the hearing by reading application for a variance~ legal notice of hearing, affidavit attesting to its publication in the official he,paper, and notice tO the applicant. THE CHAIRMAN:~ Is~'there'anyone presentwho wishes to spgak in favor of this application? (Mr. Clement Brown appeared before the Board to speak in favor of this application. He Stated tha~ his lot runs downhill and into a hollow. He also stated that his house was set-back 50 feet from the road. Mr. Koehler, adjoining property owner, appeared to object to this application. His objection was t/~at~S house was .set-back 90 feet from the road and the p~oposed addition by Mr. Brown would be in view of his front yard. There was much discussion concerning the breezeway and the ga~$ge. Mr. Brown has already laid down a patio which he intended to build the garage to. However, his plans would leave him only 5 feet fromthe property line. The Board was no willing to go along with this reduction in side yard.) THE CHAIRMAN,. Anyone else wish to be hear~ on this application one way or the other? !(There was no response.) After investigation and inspection the Board finds that Clement Brown wishes to construct an addition to his existing dwelling, thus leaving an insufficient sideyard. The Board finds that M re Brown has twice the size lot required by the Zoning Ordinance~ therefore, it is the opinion of the Board of Appeals thata reduction in the sideyard requirements should not be granted~ Such reduction would not be in keeping with the requirements and spirit of the Zoning Ordinance. Also said reduction in sideyard would not be in keeping with the neighborhood, since other dwellings in this ~rea have the sufficient side yards. The Board finds that the hardship claimed by the applican~~. is a self-imposed hardship; If the applicant had not laidthe patio~ the garage could be attached di~ectlyto the dwelling~ and no side yard reduction would be require~. Vote of the Board: Ayes:-Mr. Gillispie, Mr. Bergen,. Mr. Hulse, Mr. Do~n, and Mr. Grigonis. PUBLIC HEARING: Appeal No' 749 - Upon application of J. Herbert Cassidy,. Hobart Road,. Southold, New York, for a special exception in accordance with the Zoning Qrdinance, Article'X, Section 1003A,. for permission to renew a labor camp permit on the property of I.P. Krupski~ east side BridgeLane, East'Cutchogue, New York,, bounded north by $. Zanowski, east by A.'C% Davids:, south by P. Bedell and west by Bridge'Lane. Fee paid $5.00. The above hearing was recessed from March 4~ 1965, at which time the Board wanted more time to secure more information about the farm ~abor camp. The Chairman reopened the hearing by reading the legal notice and application. MR. CASSIDY: I will make this short. We would like to keep this open just long enough to finish out the season, then we are going to close it down. THE CHAIRMAN: Is there anyone else who wishes to be heard on this application~ or any questions? '~There was no response.) After.investigation and inspection the Board finds that j. Herbert~Cassidy requested permission to renew a farm labor camp permit. At the hearing on March 4, 1965, there was considerable objection to the continuance of this camp~ A letter in the file from Joseph H. Sawicki~ Chief of indicates that there were no calls from Cassidy~s Labor'Camp in the year of 1964. However, there were numerous calls from Robert Bolling Camp, Bridge Lane, Cutchogue, New York. Southold Town Board of Ap~e~ls -5- April 1, 1965 It was established at %he public hearing on March ~, 1965, that Robert Bolling is the crew leader for the Cassidy Labor Camp. The letter from the police chief stated that the calls from Robert Bolling:'s Camp were to settle fights~ non payment of wages~ remove drunks and disorderly persons and assaults. At the reopening of the hearing of April 1~ 1965, ~Lr. Cassidy stated that he requested permission to keep the camp open only until May 15, 1965, which would be the end of the season. It was the opin~n of the Board that this is a reasonable request. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. On motion by blt. Gillispie, seconded by Mrl Hulse, it was RESOLVED that Jo Herbert Cassidy, Hobart Road, Southold, New York be granted permission to reneW a farm labor camp permit on the property of I.P. Krupskio This permit is granted only until May 15~ 1965, at which time the farm labor camp permit forCassidy' Labor Farm, Bridge Lane, Cutchogue~ New York,expires permanently. Vote of the Board: Ayes:--Mr2 Gillispie, Mr. Bergen, Mr. Hulse, Mr. Doyen, Mr. Grigonis. Mr. TredwellAbrams appeared before the Board for an informal discussion in regard to putting a directional sign on the property of Mary Pylko~ M~ttituck~ The Board accepted the necessary applications and advised Mr. Abrams that this would be set for a hearing on April 15~ 1965. The Board again took up the matter of the sign to be erected on the Chevron Service Station, intersection of Bayview Road and Main Road, Southold. Mrl Hockman~ agent for the Chevron Station~ appeared before the Board to discuss this matter. It was Mr. Hockman's idea to provide a background for the proposed sign. His idea was that the sign would now become a wall sign. However, the Board was not~illing to go along with this. The applicant feels that the sign'would not be suitable anywhere but on the roof of the building. The Board was willing to grant the "Chevron" roof sign~ if the applicant would agree to take down the wall sign which reads "we take better care of your car". it was agreed Southold Town Board of Appeals -6- April 1,~ 19-65 to again recess this matter until April 15, 1965, at wh~h time the applicant will advise the Board w~ich sign he prefers to keep on the Chevron Station. CE, S~T.), Thursday, April 15, 1965, at the Town Office~ Main Road, Southold, New York, as time and place of hearing upon application of Ed's Sign Service, a/c General Wayne Inn, Bayview Road, Southold, New York, for a special exception in accordance with the Zoning Ordinance, Article IV, Section 408, Subsection C~), for permission to erect a directional sign on the property of Southold Bayview Corporation, located at the intersection of Bayview Road and Route 25,~ known as the Chevron Service Station. Vote of the Board: Ayes:~Mr. Gillispie, Mr. Bergen~ Mr. Hulse, Mr. Doyen, and Mr. Grigonis. Location of property: South west corner of Traveler-Street and Youngs Avenue ~ Southold, New Tork, bounded north by Traveler Street, East by Young Avenue~. south by Leictt-Terp, and west by' H.W. Prince. Vote of the Board: Ayes:-Mrl Gillispie, Mrl Bergen, Mr. Hulse, Mr. Doyen, and Mr. Grigonis. Location of property: west side Winthrop Drive, Fishers Island,~ New York,~ bounded north by Government Pxpertyl~ east by'Winthrop Drive, south by Government property, west by Silver Eel Cove. Vote of the Board: Ayes: Mr. Gillispie~ Mr. Bergen~ Mr. Hutse, Doyen and Mr. Grigonis.
