Southold Town Board of ApP%~ls -2- April 15, 1~65 The Chairman opened the hearing by reading application for a special exception, legal notice of hearing, affidavit attesting to i~s publication in the official newspaper, and notice to the applicant. T~E CHAIRMAN: Is there anyone present who wishes to speak in favor of this sign. ~There was no response.) (~r. Nelson Axiene and M_r. Prellwitz, members of theCivic Association were present at this hearing. They thought that the sign was needed in order to bedirected to-the business.) THE CHA/I~W_AN: Is there anyone present who wishes to be heard in opposition to this application? i~There was no response.) After investigation and inspection the Board finds that Mattituck Inlet Marina andShipyard request permission to erect a directional sign on the property of Mary Pylko. SaidMary Pylko has given written consent for such a sign to be erected on her property. The Board finds the sign in question is not a new sign on this particular location. The place ofbusiness has changed ownership and the open boat is a different boat. Therefore~ this will be the same sign with different wording. This sign will read "Mattituck InletMarina and Shipyard, Inc.~ Dockage, Storage~ Repairs~ Sales, Captain~Abrams open Boat~" and will have an arrow pointing in the direction of the business. The Board finds that this business is off the main highway and needs a directional sign. The Board points out hat this is in the interest of the traveling public, as all directional si~s are, to direct people to places of amusement, food,~lodging, churches, etc. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and ~he spirit of the Ordinance will be observed. On motion by M_r. Bergen, seQonded by Mr. Gillispie, it was RESOLVED that Tredwell Abrams a/c Mattituck Inlet Marina and Shipyard~ Mill Road, Mattituck, New York~ be granted permission to erect a directional sign on the property of Mary Pylko, located south side Sound Avenue~ Mattituck, New ¥ork~ subject to the following conditions: Southold Town Board of Apples -3- April 15, l'>J5 1. Fee paid $5.00. The Chairman opened the hearing by reading application for a special exception, legal notice ofhearing~ affidavit attesting to its publication in the official newspaper, and notice to the applicant. T~E CHAIRMAN: Is there anyone present who wishes to speak for this application? EDWARD PURCELL: You could ask me anything you want to know and maybe I could help you. (EdwardPurcell informed the Board that he has permission from 'Stanley Cierach~ lessee of the property, to put the sign on said location. He said that -~he would write to Southold Bayview Corporation and get their permission to erect the sign.) THE CPLAIRMAN: Is there anyone present who wishes to speak against this application? Southold Town- Board of Appea~Is -4- April 1-5, 19'65 (Mr. Prellwitz felt that this was a poor ~ocation for the sign in view of the fact that this location is already crowded with a telephone booth, milk machine, and a number of other signs. The possibility of locating the sign on the Chevron pole sign was discussed, Mr. Purcell was to advise the Board exactly where the sign will be located.) TP~ CHAIRMAN: Anyone else wish to be heard for or against this application? (There was no response.) After investigationand inspection the Board finds that General Wa-yne Inn wishes to place a directional sign on the property of Southold Bayview Corporation, lessee, Stanley Cierac~. Permission for the erection of said sign has been obtained fromStanley Cierach, however, not fromSouthold BayviewCorporation. The Board finds that the sign will be 2 feet by 3 feet, double faced, and read "Turn-Here~ General Wayne Inn".~ The other side will read "Straight Ahead, General Wayne Inn". The Board finds that the location in question is now cluttered with a telephone booth, milk machine~ and-a number of other signs. Therefore~ it is the opinbn of the Board that the applicant should try to obtain permission to place the sign on the pole of the'Chevron Station~ sign. The Board is in agreement with the applicant; a sign is necessary at this particular location. The Board points out that such a sign is in the. interest of the traveling public, as all directional signs are, to direct people to places of amusement, foOd, lodging churches~ etc. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use' of neighborhood property and adjoining use districts will not be permanently or substantially injured and the s~irit of the Ordinance will be observed. On motion by Mr. Gillispie~ seconded by Mr. Bergen~ it was RESOLVED that. Ed's Sign Service~ a/c General. Wayne Inn~ Bayv~iew Road, South~ld~ New York., be granted permission to erect a directional sign on the propertyof Southold Bayview Corporation, located at the intersection of Bayview Road and Route 25~ known as the Chevron Station, subject to the following conditions: Southold Town Board of App~ls -5- April 15, lg65 1. The applicant advising the Building Inspector, Mr. Howard Terry, of the optamate location of the sign. 2. The applicant obtaining ~ritten permission from Southold Bayview Corporation, owner of premises~ to erect a sign on this property. 3. The sign shall be located five feet from any property line. 4. (Edward Purcell was present to speak in favor of this application, however~ had nothing further to add to the application.) I was just wondering if this will impair vision looking tothe west. E~WARD PURCELL: This will be located 15 feet back from the road. NELSON AWIENE: I would like to speak against this. I don~t think you should start a precedent of directional signs that call attention to other directional signs for the same business. (~here was a lenghty discussion held on the necessity of this sign in question. The Board felt that a four by six sign was too large for a directional sign that was actually directing% the people to an additional sign. Also in the same location as this sign is proposed, there are at least two other directional signs. The Board advised Mr. Purcell that the sign would have to be smaller, and could be a reflected type if the applicant desired.) THE CHAIRMAN: Anyone else wish to be heard in opposi~bn to this applieation? ~There was no responsel) After investigation and inspection the Board finds that the applicant wishes to erect a directional sign on the property of Antone Suzozenski, 150 feet west of South Harbor Road. Written permission has been obtained from Antone Surozenski to place a directional sign on his property. The applicant proposes a four foot by six foot sign that will read "Straight'Ahead, General Wayne Inn, Ye are all Welcome". The Board is of the opinion that a four foot by six foot iS too late in view o~ the fact that the applicant has one~a~% of this location that is 'only Therefore, the Board is only willing to by three foot sign on this particular location-in The Board finds that there are also two other directional signs on this particular location. Southold Town Board of App~e~ls -7- April 15, 1965 On motion by Mr. Gillispie, seconded by Mr. Hulse~ it was RESOLVED that Ed's Sign Service, a/c General Wayne Inn, Bayview-Roads Southold, New York, be granted permission to erect a directional sign on the property ofAntone Surozenski, south side of the Main Road, 150 feet west of South Harbor Road, subject to the following conditions: 1. Southold Town Board of App~%ls -8-- April 15~ 1965 THE C~: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that Lloyd Terry Wishes to renew his labor camp permit for the year of 1965. The Board finds that in the past there.has never been any trouble with the laborers in this camp, and there have not been any complaints made by the neighbors ~bout this camp. The Board finds that there'will be no changes in the camp, except for an improvement in the lavatory facilities. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. On motion by Mr. Bergen~ seconded by'Mr. Gillispie~ it was RESOLVED that~Lloyd Terry, Orient, New York, be granted permission to renew farm labor camp permit that was granted April 30, 1964~ on property located south side Main Road, Orient, New York. Location of property: south west corner of Traveler Street and Youngs Avenue~ $outhold, New York, bounded north by Traveler'Street, east by Youngs Avenue, south by Leicht-Terp, and west by H.W.' (June Baker was present at the hearing, however, he had nothing further to add to the application.) THE CHAIRMAN: Is there anyone present who wishes to speak in opposition to this application? (T~_ere was no response.) After investigation and inspection the Board finds that Koke Bros. wishes to erect a wall sign on the face of the garage. The Board finds that the sign is to be 52 inches by 5 feet, and will read "Oldsm0bile Service." At present there is insufficient notice to the public of the existence of the Oldsmobile Sales Agency on the premises in question. The old Oldsmobile sign on the face of the original garage and showroom shall be removed and discarded~ prior to the erection of the new s~gn. The Chairman read the following letter from the Fishers Island FerryDist~ict: ~This is to advise the Board of Appeals~. TownClerk~ls Office~ Southold, New York, that the Fishers Island Ferry District, Fishezs Island, New York, has no interest in or objection to the proposed structure of Mr. Donald Cleveland to be located on Silver Eel Cove~ Fishers Island~ New York. "Fishers Island Ferry District /s/ W.'C. Sinclair~ Manager" The Chairman also read the following letter: "Zoning Board of Appeals, Town of Southold~ Southold, Long Island~ New York. "Dear Sirs: I am writing you with regard tothe request for a variance at Fishers Island,~ for Mr. Cleveland. "While at Fishers Island recently, I saw a set of plans for the proposed alterations and additions to the former pump house building owned hyMr. Cleveland. "! own the vacant lot across the street from the Cleveland property. I wish to state that I am opposed to the granting of a variance. "One of the reasons why I purchased this lot last summer was that it offered a nice view of the harbor. I felt at the time that the pump house tract was suitable for a boat house. With the small land area I was confident that substantial additions to the present structure would not be permitted. "I am a member of the Zgning Board of Appeals in Norwich, and understand the problems that come up. I can imagine that this is not an easy one for you. I realize the advantages of having more buildings and increasing the grand list. "In this particular case, I believe the proximity of the building to the shore line should be a consideration. I speak on behalf of Mr. Cleveland,: who is the owner or'the property. Mr. Cleveland is here to answer any questions you may have. William Esseks, Esq., presented the Board with plans for the addition to the existing pump house. The Board viewed a map of the property in question and located the property of Shepard Palmer, objector to this variance. The Board also vieweda number of photographs of the property in question, taken by Howard Terry, building inspec~r. WilliamEsseks~ Esq., stated that they would like to establish this area as an area with residential character.) THE CHAIRMAN: Anyone else wish to speak in favor of this application? SERGE DOYEN,' JR~ ~(Member of the Board): I inquired around. The FerryDistrict has no objection to this variance, they would if it was going to interfere in any way~ but they have no objection to this. I spoke to the Moores across the street. They felt that this would be an asset to the area and were in favor of it. MR. CLEVELAND: The only thing I would like to say is that I wasn't quite sure what was going to come up here. I thought that~whenRace Point'Corp. applied for a variance~ that would be the.only variance we would need. T~ECHAIRMAN: Is there anyone else present who wishes to speak in favorof this application? (.There was no response.~ ~CHAIRMAN: Is there anyone present who wishes to spekk against this application? CThere was no response.) After investigation and inspection the Board finds that the applicant request a rear yard variance in order to erect an addition to an existing pump house. The applicant wishes to construct a guest house by making an addition to the pump house. The Board finds that the lot in question is very irregular. The lot has approximately 58 feet of depth on the northerly side, and only approximately 20 feet of depth on the southerly side. The Southold Town Board of Appeals -~2- April 15, 1965 Board finds that the construction of a guest house on this site will enhance the area, in v~'ew of the fact that this area is presently in a run-down condition. Such a const~ction will help to maintain a residential shorefront. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be sha~ed by all properties alike in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district. On motion by Mr. Gillispie, seconded by Mr. Bergen~ it was RESOLVED that'Caroline C. Cleveland, Wooddale Road, Greenwich Conn.~ be granted permission to erect an addition to the existing pump house with insufficient rear yard requirements on property located west side WinthropDrive, Fishers Island~. New York. Vote of the Board: Ayes:-Mr. Gillispie~ Mr. Bergen, Mr. Hulse, and Mr.. Doyen. Mr. WilliamW~h, Oaklawn Avenue, Southold~ appeared before the Board for an infom~l discussion. ~e wishes to convert his home to a two family dwelling or put a cottage or trailer in the back yard to rent out when he retires. The Board advised him that he could not put a cottage since his lot is not large enough; that the Board of Appeals has no jurisdiction over trailers, however, it was very improbable that he could put one in his back yard. The Board also advise~Mr. Worth that they would have to look further into the case of changing his heme into a two family dwelling, since his house was not too large as it stands. Mr. Daniel Smith appeared he, re the Board for permission to change the Tydol Service St&~ion on the east side of t~e Main Road Southold, into an office and shop. The Tydol Service Station is a non-conforming use. By unanimous vote of the Board of Appeals it was RESOLVED that it is not necessary for Mr. Daniel Smith to make formal application to convert the present Tydol Service Station, a non-conforming use, located on the east side of Main Road~ Southold, into a higher use~ namely, a real estate office and shop for use in connection with his building construction business. The Boa~ofAppeals hereby authorizes him to do so. A bench saw will be operated occassionally in the shop, however, this is not part of the building construction business.
