May 13, 1965
A regular meeting of the Southold Town Board of'Appeals
was held on Thursday, May 13, 1965,~ at 7:30 P.'M.., at the
Town Office, Main Road, Southold, New York.
There were present: Messrs: Robert-W. Gillispie, Jr., Chairman;
Robert Bergen, Fred Hulse, Jr.
Absent: Messrs: Serge Doyen, Jr.~ Charles Grigonis, Jr.
PUBLIC HEARING: Appeal No. 768 - 7:30 P.M.(E.'D.S.T.), Upon
application of David Tuthill~l Wickham~Avenue~ Mattituck, New
York, for a special exception in accordance with the Zoning
Ordinance, Article III, Section 306, (as it applies to the "B"
Business District of the Ordinance)~ for permission to erect
an attached garage with insufficient~setback. Location of
property: north west corner of Pike Str.eet and Wickham'Avenue,
Mattituck, New York, bounded north byDonald Gildersleeve,
east by-Wickham Avenue~ south by Pike Street, west by'LoC.
Gildersleeve. Fee paid $5.00.
The chairman opened the hearing byreading application for
a special exception, legal notice of hearing, affidavit attesting
to its publication in the official newspaper, and notice to the
applicant.

THE CHAIRMAN: Is there anyone presentwho wishes to speak
in favor of this application?
(David Tuthill was present to speak for the application.
The Chairman advised Mr. Tuthill that the Board was not willing®
to go along with the proposed location of the garage. If the
applicant placed the garage in the proposed location, he would
be creating a traffic hazard. Mr. Tuthill would have to back
out onto WickhamAvenue~ a heavily traveled street. Lenghty
discussion was held on different proposals for the location of
the garage. The Chairman thought that perhaps the garage could
be located as proposed in the application, if the garage doors
faced in a northerly direction. However, this proposal might
not leave enough room for the applicant to back out of the
garagee in view of the fact that there is a large oak tree in
the way.)
On motion by Mr. Hulse, seconded by Mr. Bergen~ it was
RESOLVED that the hearing upon application of David Tuthill,
Wickham Avenue, Mattituck~ New York, be adjourned until the next
meeting of the Board of'Appeals in order for the Board to obtain
exact measurements of the lot and addition in question.

PUBLIC HEARING: Appeal No. 769 - 7:45 P.M.(E.D. ST.), Upon
application of Peter'Sledjeski~ Main Road~ Orient, New York~ for
a special exception in accordance with the Zoning Ordinance,
ArtiCle-X, Section 1003A, for permission to renew a farm labor
camp permit that was granted~June 11, 1964. Location of property:
south side Route 25, Orient, New York~ bounded nor~h ~y Main
Road, east by J.B. Droskoski, south and west by J. Tuthill and
J. Dyer. Fee paid $5.00.
The Chairman opened the hearing by reading application for
a special exception, legal notice of hearing~ affidavit attesting
to its publication in the official newspaper~ and notice to the
applicant.

THE CHAIRMAN: Is there anyone present who wishes to speak
in favor of this application?
ALICE SLEDJESKI: I am here for the application.
THE CHAIRMAN: How many laborers do you have in the camp2
ALICESLEDJESKI: We have four in the camp now. .Last year
we had seven or eight laborers, but I don~t think we are going
to have that many this year.
MR. BERGEN: Have you ever had any trouble with the laborers
or had to call the police2
ALICE SLEDJESKI: No.
T~ CHA/_RMAN: Is there anyone present who wishes to speak
against this application?
(There was no response.)
After investigation and inspection the Board finds that
Peter Sledjeski wishes to renew a farm labor camp permit granted
June 11, 1964. The Board finds that there will be no changes
in the camp for the year of 1965. There haven~'t been any
complaints or objections to this camp being operated. The
Board feels that this camp is necessary to the operator since
the closing of the Greenport-Labor'Camp which use to house a
large number of laborers.
The Board finds that the public convenience and welfare
and justice will be served and the legally established or
permitted use of neighborhood property and adjoining use districts
will not be permanently or'substantially injured and the spirit
of the Ordinance will be observed.
On motion by Mr. Gillispie, seconded by Mr. Bergen, it was
RESOLVED that~Peter Sledjeski~ Main Road, Orient, New
York~ be granted permission to renew a farm laborcamp permit
that was granted June 11, 1964, on property located south side
Route 25, Orient, New York. This permit is granted for one (1)
year.

PUBLIC HEARING: Appeal No. 770 - 8:00 P.M.'~(E.D.S.T.), Upon
application ~ Robert Guarriello, Westview Drive, Mattituck, New
York, for a variance in accordance with the Zoning Ordinance,
Article III, Section 305, for permission to erect an attached
garage with insufficient front yard setback. Location of
property: north side'Westview Drive, Mattituck, New York~ bounded
north by F.E. Hass, east by R. Bascomb, south by Westview Drive,
west by Irene Fogarty. Fee paid $5.00.
The Chairman opened the hearing by reading application for
a variance, legal notice of hearing, affidavit attesting to its
publication in the official newspaper~ and notice to the applicant.
THE CHAIRMAn,: Is there anyone present who wishes to speak
in favor of this application?
(Robert Guarriello was present at the hearing bsthad
no~hing to add to the application itself. It was established
that the house is set on the lot'at an angle to the road.
It was also established that these lots were laid out in 1955.)
THE CHAIRMAN: Is there anyone present who wishes to speak
against this application?
(There was no response.)
After investigation and inspection the Board finds that the
applicant wishes to construct an attached garage with insufficient
set back from the road" If the structure was moved back on the
property~ the sideline requirements of the Zoning Ordinance would
be violated. The Board points out that it is better not to
crowd the sideyards when a lot is pie-shaped. The Board finds
that the applican%~'s house is set on an angle to the road. The
proposed reduction in front yard set back will in no way harm
visibility or create a traffic hazard. The Board also~inds
that the proposed addition to the house will enhance the
appearance of the house~ as well as enhance the appearance
of the neighborhood.
The Board finds that strict application of the Ordinance
will produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance does observe
the spirit of the Ordinance and will not change the character
of the district.

RESOLVED that Robert Guarriello, Westview Drive, Mattituck,
New York~ be granted permission to erect an'attached garage with
insufficient front yard setback, on property located north side
Westview Drive.,Mattituck, New.York.~

Mr. Hickey appreared before the Board for an informal
discussion in regard to erecting signs for the 325th Anniversary
of~Southo~d Town, Mr. Hickey stated that these signs would be
four (4) feet by eight ~) feet and located at the Orient'Point
FerryExit and at-Sound Avenue in Mattitucko These signs will
only be up for about four months. Mr. Hickey also advised that
they would have a 11~ by 24: and a 6~ by 12® portable sign that
would be on a trailer and put in different locations. The
Chairman advisedMr. Hickey that these signs could be taken
care of by writing a letter, rather than making a formal application
to the Board of Appeals.
On motion by Mr. Gillispie, seconded by Mr. Bergen~ it was
RESOLVED that the Southold Town Board of Appeals set 7:30 P.'M.,

Southold, New York, as time and place of hearing upon application
of James P. Howard, 93-34 204 Street, Bellaire Queens, New York,
for a variance in accordance with the State of New York State
Town Law, Section 280A~ for approval of access. Location of
property: Private Right of Way, off the west side of New Suffolk
Lane, bounded north by E. Grathwohl, east by S. Krukowski, south
by So Krukowski, west by G.F. Grathwohl.

application of Pinecrest Dunes, Inc., Soundview Avenue, Peconic~
New York, for a special exception in accordance ~ith the Zoning
Ordinance~ Article X, Section 1007, Subdivision (~), for permissiOn
to expand a non-conforming use. Location of property: north side
$oundview Avenue~ Peconic, New York, bounded north byLongIsland
Sound, east by Carl J. Graseck~ south by Soundview'~Avenue, west

It was further RESOLVED that the legalnotice of the before
mentioned hearings shall be'published in the Suffolk Times, the
official newspaper of the Town under date of May 21, 1965.
The following hearing was recessed from the meeting of the
Board of Appeals held on November 5, 1964:
APPEAL NO. 721 - Upon application of John Gsu~ble, 10 Annette
Avenue, Smithtown, New York~ for recognition of access in accordance
with the'State of New York Town Law~ Section 280A. Location of
property: private right-of-wayoff south side Bayview'Avenue,. Southold,
New York, b~unded north by private road~ east by R.'Jo Turner, south
by'Peconic,Bay, west by Edward Mills.
The Chairman reconvened the hearing and reviewed the application.

heard in opposition to this application?

After investigation and inspection the Board finds that
John Gamble request approval ofaccess on a r~ht-of-way on
the south side of Bayview Road, extending from BayviewRoad
Along the easterly border of land of Davis. The Board finds
that the access in question now meets the mininum requirements
for approval of access. The Board finds that thisright-of-way
is accessible to all emergency equipment.
The Board finds that strict application of the Ordinance
will produce practical difficulties or'unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance does observe
the spirit of the Ordinance mhd will not change the character
of the district.
On motion by Mr. Bergen~ seconded by Mr. Gillispie, it was
RESOLVED that John Gamble, 10 Annette Avenue, Smithtown~.
New York, be granted approval of access on a private right-
of-way off the-South side of Bayview Avenue~. Southold~ New
York.

RESOLVED that the minutes of the Southold Town Board of
Appeals dated April 29, 1965, be approved as submitted.
