There were present: Messrs: Robert~W. Gillispie, Jr., Chairman, Robert Bergen, Fred Hulse, Jr. Absent: Charles Grigonis, Jr.., Serge Doyen, Jr. PUBLIC ~.ARING: Appeal No. 768, Upon application of-David Tuthill,.WickhamAvenue, Mattituck, New York, for a speical exception in accordance with the ZOning Ordinance~Article III, Section 306, ~s it applies to the "B" Business District Section of the Ordinahce), for permission to attach a garage with insufficient setback. Location of property: north west corner of Pike Street and Wickham Avenue~ Mattituck~ New York, bounded north by Donald Gildersleeve, east byWickham.Avenue, south by Pike Street, west by L,C. Gildersleeve. The above hearing was reconvened from a meeting of the Board of Appeals held on May 13, 1965~ in order for the Board to obtain accurate measurements of the property in question. Southold Town Board of App~ls -2- May 27, 196~. (After inspect~n of the property the Board found that there is 35~ 6" from the present house to the property line. The proposed garage would be 20'~a thus leaving 15~6'' to the property line.) DAVID TUTH~1~: Would the Board be willing to go along with this application, if I was to back out onto'Pike Street? TP~ECHAIRMAN: The Board doesn:t like the idea of backing out onto any street. However, in this case, I think it would be better for you to back onto Pike Street, rather than Wickhmm Avenue. ~(Again the Board discussed other possible locations for the proposed garage. ) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that the applicant wishes to erect an attached garage to his house located on the north west corner of Pike Street andWickham Avenue, Mattituck. The Board finds that the location of the cesspool in the rear of the house prevents the addition from being placed on the north side of the ~house in the rear yard area. There is also a long term lease on the northerly l0T of the p~operty. The Board finds that there is 'insufficient room on the westerly side of the property to place the garage. Therefore, the garage will be located on the east side of the property as proposed by the applicant. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. The Chairman opened the hear~ by reading application for a variance, legal notice of hearing~, affidavit attesting to its publication in the official newspaper, and notice to the applicant. THE CHAIRMAN: Is there anyone present who wishes to speak in favor of this application? (There was no response.) After investigationand inspection the Board finds that the applicant requests appr~al of access on a private right-of-way. The Board finds that all the requirements of the County have been met in regard to the connection of this right-of-way to New Suffolk Lane (County'Route 26), and the necessary performance bond has been posted. Therefore, it is the opinion of the Board of Appeals that this access should be approved. The Board points out that the right-of-way is accessible to all emergency equipment. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship crea~ed is unique and would not be shared by all properties alike in the immediate v~inity of this property $outhold Town Board of'App&~ls -4- May 27, 1965~ and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district. TPRE CPL%IRMAN: Is there anyone present whowishes to speak in fa~or of this application? I think that everything is pretty well stated in the application. W~at happened to the other sign that you had up? JACK LEVIN: That sign took a terrific beaten last winter. The sign that was up there was 12 years old. This ~new sign i~ a good looking sign , and t think it would be a hardship if I wasn't-allowed to put-it up. THE CHAIRMAN: Is there anyone present who wishes to speak against this application? This sign is to be 12 feet high and 12 feet wide. The lower edge of the sign is 5 feet above ground level and the upper edge .is approximately 18 feet above ground level. This sign was designed to stand-up under poor weather conditions. The original sign that was on the . premises for 12 years was destroyed through the years due~he poor weather, particularly .during the winter. The Board finds that the total area of this sign is 81 square feet. The Board points out that this sign is in the interest of the traveling public. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property an~ adjoining use districts will not be permanently or'substantially injured and the ~irit of the Ordinance will be observed. On motion by Mr. Gillispie, seconded by Mr. Bergen, it was RESOLVED that Sound Shore Motel, North Road, (C.R.27A), Greenport, New York, be granted permission to erect a ground sign on property located north side North Road, Greenport, New York. Glickman, Esq., appeared on behalf of the applicant. He stated that the applicant owned an open development area. Mr. Glickman pointed out on the map the particular property~f~% ~question, and also pointed out to the Board the 50 foot right-of-way which gives access to the Beach. Mr. Glickman requested that the variance be ~ granted. ) THE CHAIRMAN: Is there anyone present who wishes to speak against ,this application? (there was no response.) After investigation and inspection the Board finds that the applicant wishes to divide property. The Board~finds that a righ-t-of-way has been granted which results in insufficient width and road frontage. The Board points out that the Planning Board had originally recommended this right-of-way to give access to the beach. The Board finds that this property is the Lonly land available for the creation of a right-of-way to the beach. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created ~ is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use'~istrict, and the variance does observe the spirit of the Ordinance and will not change the character of the district. After investigation and inspection the Board finds that the applicant wishes to divide a piece of property, thus creating one lot With only 97 foot frontage and another lot with 103 foot frontage. By dividing the property in this manner, th~ house on the lot with 103 foot frontage will be able to maintain the required sideyard. The proposed dwelling to be on the lot with only 97 foot frontage will keep within all the requirements of the Zoning Ordinance. The Board finds that the lot~with insufficient frontage has at least four times the total area required by the Zoning Ordinance. The applicant should not be concerned with difficulties from the Health Department in regard to location of well and cesspools. This division of propertywill not change the character of the district in view of the fact that a one family dwelling will be erected on the lot that has insufficient frontage. The Board finds that strict'application of the Ordinance will produce practical difficulties or unnecessaryhardship; the hardship created is unique and would not be shared by all properties ali~e in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district. (Mr. Kenneth Schold was present to speak for the application, however, he had nothing further to add to the application. A brief discussion was h~d on the general operation of the camp.) THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that Pinecrest Dunes~ Inc.~ requssts permission to expand a non- conforming use. The applicant wishes to erect a building to house 12 campers. Because of Board of Health rules and reg- ulations and i~terior improvements in the other six cabins, the applicant has lost the space for 12 campers, thus, the new building will make up for said loss. The Board points out that this camp has been in existence for many years. The Board also points out that there will be no overcrowding of land in view of the fact that Pinecrest Dunes, Inc.~ owns over 30 acres of land~ which is used for camping purposes. The Board fin~s that the public convenience and welfare and justice will be served and the legally established or permitted use ofneighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. Southold Town Board of Appeals -11- May 27, 1~65 On motion by Mr. Hulse, seconded by~Mr. Bergen, it was RESOLVED that~PinecrestDunes, Inc., Soundview~Avenue, Peconic, New York, be granted permission to expand a non- conforming use by building a cabin to house 12 campers, on property located on the north side Soundview Avenue~ Peconic, New York. Vote of the Board: Ayes:- Mr. Gillispie, Mr2 Bergen, Mr. Hulse. Mr. Henry Kernowski appeared before the Board to discuss Be~ch~s horse farm, located on the north side of Main Road~ Mattituck, New York. Mr. Kernowski owns a vegetable stand to the east of Besch's property. The Chairman read to Mr. Kernowski the decision of the judge in this case. The Chairman advised Mr. Kernowski that the Board or'Appeals would re-hear this application on June 10, 1965, at 8:15 P.Mj The following letter was written to Joseph Sawicki, Chief, Southold Town Police Department, Peconic 'Lane~ Peconic, New York: Dear Sir: The Board of Appeals has been asked to review an application for Besch~s livery stable located on the Main Road in Mattituck. Would you please advise us if your department has had any calls regarding this stabler in regard to run- away horses or anything of that nature, since the livery stable has been in existence. The folbwing letter was written to the Suffolk County Department of Health~ County Center, Riverhead, New York~ Attn: Mr. Calvin Smith. Dear Mr. Smith: The Board of Appeals has been asked to re-hear and take new testimony in the matter of the Besch livery stable located on the Main Road in Mattituck. Accordingly~ we would appreciate a copy of your most recent report~on the conditions at the Besch livery stable, as well as any information you may have on file. Southold Town Board of. The following letter was written to John McNulty, Esq., 175 Griffing'Avenue~ Riverhead, New York. Dear Mr. McNulty: The feelings of the Board of Appeals in regard to the Besch livery stable have not changed since their decision of'December 17, 1964, at which time the Board denied the applicant permission to operate a livery stable° In re-reading our decision we find that the Board's findings were based on dust, and fly problems, the devaluation of business of two neighboring businesses, endanger of the health in the locality, improper disposal of manure, two averse reports from the Board of Health, killing of~a horse on the Long Island Railroad Tracks to the north of the p~Operty~ plus numerous other findings. In view of the foregoing, if you wish to withdraw your verbal request for a rehearing, we will be glad to comply. Very sincerely, Robert'W. Dear Mr. La Freniere: In considering informally tonight your proposal which you have suggested in your letter of May 14~ 1965, for the construction of a windmill 14 feet high to be erected in your front yard, the Board of Appeals ~finds that it is unfavorably impressed by this project~, however, we will be glad to schedule a hearing in the event you wish to eome to the office of the Board of Appeals and file a formal application for a building permit, which would be denied by the Building Inspector, subject to appeal to this Board. 'Southold Town Board of Ap~als -13- May 27, 1965 'In response to a letter from James F.'Jj Hickey, Secretary Southold Town 325thAniiversary Comm~ee, the Board of'Appeals RESOLVED that the Southold Town 325th Anniversary Committee be granted permission for the erection oftwo signs according to the following specifications: 1. One sign shall be located at the north side of Route 25, at Orient Point Ferry. 2. One sign shall be located on the north side of North Road, west of Mattituck. 3. Permission of the property owners shall be obtained before the erection of each sign. A copy of said letter of permission shall be submitted to the office of the Board of Appeals. 4. The signs shall be constructed of wood, paintedt be four feet by eight feet, and held by 4~'by 4" posts. 5. The signs shall be located at least three ~) feet from ground level, and at least five (5) feet from any property line. 6. These signs shall be erected for the months of June, July, August, September, 1965, only. The Board believes that the post which are used to support these signs should be painted. Dear Fir. Schneider: On April 15, 1965, the Board of Appeals granted the General Wayne Inn permission for the erection of two signs, setting up certain conditions. The sign now located on the property of'Antone Surozenski, located south side Main Road, Southold, was to be a two foot by three foot sign. However a four foot by six foot sign was erected at this site and to date is still there. The second sign in question is located at-the intersection of Bayview Road and Route 25,. Southold. For the erection of this sign the permission of~Southold Bayview Corporation~ owner of the property, was to be obtained. However, no such letter of permission has ever reached our office, and this sign has been erected. The Buikling Inspector also informs us that the fee for ~oth of these signs has never been paid. Therefore, both signs have been illegally erected. It will be necessary for these signs to comply with the Zoning Ordinance and sign requirements immediately, or their removal will be ordered.
