PROPERTY FACTS/DESCRIPTION: The applicant's 10,531 sq. ft. parcel has 75 feet along Locust Lane and 137.84 feet along L'Hommedieu Lane. The property is improved with a two-story dwelling and accessory frame garage as shown on the July 16, 2004 survey prepared by Peconic Surveyors, P.C. BASIS OF APPLICATION: Building Department's January 12, 2005 Notice of Disapproval, citing Sections 100-33B, in its denial of a building permit application for approval of an "as built" accessory structure (containing a shower), for the reason that the construction is less than three feet from the side property line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 3, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant is requesting a setback variance concerning the 'as built' construction of a 6' x 9' accessory (shower) structure located one foot from the northerly (side) property line as shown on the July 16, 2004 survey, amended November 30, 2004 by Peconic Surveyors, P.C. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's as-built structure contains a shower facility for use by family members, and built one foot from the property line, adjacent to the neighbor's residence to the north. The applicant's dwelling is situated at the northeasterly portion of the property closer to • Page;—April 14,2005 • • ZB Ref. 5670—Barbara Kellc CTM ID: 64-2-54 Locust Lane. The yard area is open and unobstructed, available for the applicant to properly locate an accessory structure to meet the code's minimum setback requirement. 2. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. This accessory structure can be relocated to meet the code required setbacks at least three feet from the side lot line, without a variance. 3. The variance requested herein is substantial, representing 50%, or greater reduction, from the code-required three ft. setback. 4. The difficulty was self-created. 5. Evidence has been submitted to suggest that the shower structure at the requested location will have some an impact on the physical or environmental conditions in the neighborhood. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Simon, and duly carried, to DENY the variance requested. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The owner constructed a 6 . 1 foot x 9 . 2 foot outdoor shower, however, it was incorrectly placed 1 foot from the property line. The property is surrounded by a 6 ' high wood fence and planted hedge, the shower is located on the owners property south of the fence, therefore, it can not be seen from the adjacent property. Because the shower was less than 200 square feet the contractor did not believe he needed a building permit, none was obtained. The building department advised that a building permit was required. The owner complied with the Town' s request, after a survey was prepared, the owner discovered that the shower was located less than 3 ' from the property line. The outdoor shower has open wood walls for privacy, no roof, an arbor for aesthetics, a small sink and a cement pad with decorative tiles . (No electric or sanitary) Moving the structure is difficult without compromising the structure. A structure which is less than 100 square feet and located in conformity to the zoning setbacks does not require a building permit, however, the building department requires a building permit for the "plumbing" . If the Zoning Board grants a variance for the location of the structure the applicant will obtain a permit for the plumbing. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house is on a busy corner due to the activity at 7-11 Convenience Store, the shower was located on the property to provide the most privacy. The adjacent property does not see the shower, the walls of the shower sound-proof the structure, and the water is drained away from the property line. Unlike most outdoor showers which run water directly onto the ground, this shower has a drain. Without the variance the shower would need to be moved 2 feet, the relocation of the shower 2 feet would leave a larger opening between the fence and shower to catch debris, leaves, and overgrown vegetation. Also the location of the shower is tucked against the fence and away from the patio area. Finally, moving • • the shower would damage the base, and the cost of moving the structure has been estimated to be approximately $3, 500 . 00 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The shower is smaller than a shed, is out of view from the road, and is screened by the owner' s 6 ' high stockade wood fence. In addition the neighbor also has a dilapidated fence on their property which further screens the shower. 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . An outdoor shower is a customary and accessory amenity to the homes in Southold. That particular neighborhood is close to the beach and an outdoor shower is needed. This outdoor shower, rather than be against the house (along the road) is in a 6 ' x 9 ' shed. The owner saw this same structure in Southold during a garden tour and thought that an outdoor shower with a garden shed look was an attractive alternative to the typical shower stall design. 5 . The alleged difficulty was not self-created. The size of the structure (less than 100 x 100) does not require a permit, however, because the structure was placed too close to the property line a variance was required. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant. The outdoor shower was built with extra care and aesthetic features (tile and a floor drain) therefore relocating it will most likely damage the structure, therefore, a variance was sought to preserve the structure. Evergreens for neighbor to screen shower: landscaper recommends 3 to 5 evergreens, 6 ' to 8 ' heigh (as available) Leylandii Cypruss, Juniper or Arorvitae. With owner' s consent we would purchase the evergreens and plant them. 2 . Second layer of 6 ' stockade fence placed on posts of existing fence (facing neighbor) for length of structure (2 sections) 3 . Cut off pergola: Contractor warns that the pergola provides the structural frame of the shower stall . The pergola consists of supports and joists with decorative ends therefore the pergola would need to be replaced with another frame on the top. The pergola could be lowered without removal . Presently, the existing Wisteria vines grow over the pergola and hides it from view when it has grown to maturity. The pergola was also designed to provide a platform for planters . The plants in the planters provide a colorful treatment which also covers the pergola. Last year hanging planters were hooked to the pergola. The dense vegetation provides noise abatement and privacy during the summer when the shower is in use. Consequently cutting off or down the pergola is the least desirable of the alternatives to the owner. The neighbor did 4. not seemed satisfied, in any event, so removing the pergola is a penalty which can be avoided by item 1 or 2 . It flys in the face of common sense for Ms. Moore to* argue that the structure is inconsequential, amounting to little more than "four pieces of fence" (page 2, line 16 - minutes) and then turn around and claim that it.will! cost $5,000.00 to move "four pieces of fence". If the use is so inoffensive, why didn't the Kellc's locate it next to their own back door rather than next to the Sanford's back yard? • 6. Ideally, my'client requests. that the applicant be required to remove the structure and shower it contains; • 7. Absent total removal, my client requests that the pergola be removed and , the height of the remainder of the structure to a level equal to or lower than the adjacent boundary line fence. It is 9 feet high, there is no set back from the property line, and it is not only a 9-foot arbor but an outdoor shower. On Thursday, April 22nd, a workman asked permission to come onto my property to service this outdoor shower. In order to do this, a section of fence had to be removed. Any future maintenance and repair will necessitate access to my property, the dismantling of the fence, and the disruption of my garden. This encroachment is a concern to me: 1. Height of 9 feet 2. No set back from the property line 3. No access for maintenance or repair except through my property 4. Maintenance & repair requires dismantling of fence 5. Drainage and possible contamination of my property from water runoff 6, Loss of privacy, due to showering activity, by the side entrance to my home and garden 7.
