No. 5690: PANAGIOTIS KANARAS Property Location: 480 Ruth Road, Mattituck CTM 106-5-33 (unmerger from 32) SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 4, 2005 at which time the applicant requested an adjournment to allow time for attendance by an attorney, and July 7, 2005. During the July 7, 2005 hearing,written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 12,500 square feet of land area. The lot lines noted in the 1970 deed are confirmed in the September 29, 2004 survey prepared by Kenneth W. Woychuk, L.S. The adjacent property, deemed merged by the Building Department with the applicant's property, is also 12,500 square feet and is improved with a single-family house constructed in about 1969, referred to as CTM 106-5-32, BASIS OF APPLICATION: Based on the applicant's January 27, 2005 request for a building permit to construct a single-family dwelling, and the Building Department's January 28, 2005 Notice of Disapproval, citing Code Section 100-25. The reason for the disapproval is that the subject lot (1000-106-5-33) merged with an adjacent lot to the west (SCTM #1000-106-5-32), which has been held in common ownership, during a period of time after July 1, 1983. APPLICANT'S REQUEST: Waiver to unmerge properties under Article II, Section 100-26 • • Page 2—August 18, 2005 ZBA File No. 5690— P. Kanaras CTM 106-5-33 of the Southold Town Zoning Code. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The waiver will not result in a significant increase in the density of the neighborhood. The lot that would be re-created by a waiver will follow the lot lines at the time of creation as deeded in June 1970. This 12,500 sq. ft. parcel of land is of a size consistent with that of lots on that block. Of the eight lots immediately to the east and west, only one has a width in excess of that of the lot in question. 2. Grant of a waiver of merger would recognize a lot that is consistent with the size of lots in the neighborhood. The neighborhood and district is well-developed with single-family residences. To the north are lots developed on the Map of Captain Kidd Estates. The area consists almost exclusively of older lots that do not conform to the R-40 (40,000) minimum for this zone district. The 12,500 sq. ft. size of the vacant lot in question is equal to most, and clearly consistent with the average size of lots in the neighborhood and district. 3. The waiver will avoid economic hardship for the owner, who purchased the land with the expectation of being able to build on the vacant lot at issue. The area is serviced by public water through the Suffolk County Water Authority, and the owner has obtained approval from the Suffolk County Department of Health Services to construct. The adjacent property(improved CTM 32)was part of the merger between 1970 and 1984 by the former owners (Lambros). In 1984 CTM 32 was conveyed separately to Ketsoglou & others. This property was later conveyed by Lambros to the applicant (Kanaras) in May 2004. A single and separate search was not obtained until January 7, 2005 to show the merger of the property, and the owner was not aware of the merged status of the property until making written application to the Town of Southold to build. 4. The application shows there will be no significant change in the contour of the land, and no evidence was presented to suggest that the lot would require filling, or to suggest that its natural details, character, contours or slope would be significantly altered in any manner. 5. The waiver will recognize the original lot lines set forth in the June 3, 1970 deed originally creating this lot, which was created prior to the 40,000 minimum lot size requirements under Chapter 100 (Zoning Code) effective in 1971. WICKHAM: I'm Abigail Wickham, and I'm 8 here on behalf of the applicant and his contract 9 vendee. One thing I want to say is this one is 10 definitely confiscatory. And I don't know if the 11 Board has a history of this, but what appears to 12 have happened based on the title search is that 13 Mr. and Mrs. Lambros acquired the adjoining lot in 14 1969 and deeded it out, it, at that time had a 15 house on it, to people in May of '84, 11 months 16 after the July 1, 1983 merger date. Those people 17 then conveyed it to other people and there has 18 been a chain of title on it, and that house is now 19 owned by people by the name of Vonordus. The 20 vacant lot the Lambroses acquired by separate deed 21 and held it until just recently and about a year 22 ago when they sold it to Mr. Kanaris, Mr. Kanaris 23 was of the impression it was buildable, had no 24 idea it wasn't. I don't think anyone knew that 25 there was a legal merger and probably for the . July 7, 2005 177 1 2 reasons that Jim has expressed because no one 3 received a notice. And therefore, that lot is now 4 not owned by anybody that surrounds it and it is 5 unbuildable unless you grant this waiver of 6 merger. 7 - There are three other vacant lots in the 8 vicinity of this property. One is Tax Lot 9 106-5-3, owned by people by the name of McKeatas 10 since 1967, that's on Captain Kidd Drive, it's 11 behind this driveway, and from the tax records no 12 other adjoining improved lots are owned by those 13 people or have been since ' 67. So I don't think 14 that would create a waiver of merger precedence 15 here. The same situation I found with vacant lot 16 106-5-27.1, owned by the Ebetees since 1964, and 17 the one on the corner of Breakwater and Ruth, 18 which is 106-7-24. So those are three vacant 19 lots. They are buildable but I don't think this 20 will create a precedent because it looks like 21 those are not merged with adjoining properties. 22 This particular lot, Tax Lot 33 is a small lot, no 23, question about it, but it is almost identical to 24 the other lots around it. It has already received 25 Health Department approval. We have, I believe July 7, 2005 178 1 2 you have in your file, if not I'll be glad to give 3 it to you, a survey showing the proposed house 4 layout that exceeds front yard setback, it exceeds 5 rear yard setback and both side yard setbacks and 6 the house would be less than the maximum height. 7 So certainly a variance will not be necessary to 8 build nor will they be anywhere near the maximum 9 building envelope.( 10 I have a letter from Certified Appraisal 11 Services dated June 24, 2005, I will have to give 12 the Board duplicate copies because I don't have 13 that, but it is signed by a Mr. Russo, who has 14 made an analysis of this property. Based upon not 15 being a separate buildable lot, he gives it what 16 he calls excess land contributory value, which 17 would be the value if it were added to an 18 adjoining lot and that would be in the 19 neighborhood he said of $25, 000 to $30, 000. So 20 there's a severe economic hardship here in that 21 Mr. Kanaris paid considerably more for that 22 property when he purchased it, which was at my 23 finger tips. He paid $65, 000, which also was 24 undermarket but apparently there was a final 25 difficulty with Mr. Lambros, which he was July 7, 2005 179 1 2 assisting him with. So that is the price. It is 3 certainly worth considerably more in this market, 4 and if it is not buildable, it's worth $25, 000, 5 $30, 000, which is an economic hardship. 6 There would not be a significant increase 7 in density.
