(631) 765-1809•Fax(631)765-9064 2 5 2005 FINDINGS, DELIBERATIONS AND DETERMINATIONcrifolge:114, MEETING OF MAY 12, 2005 SOl old o 1 Clark ZB Ref. 5695 — Don Tison and Diane Giardi Property Location: 170 Laurel Avenue, Southold CTM 56-3-4 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 9,540 sq. ft. parcel has 100 feet along Laurel Lane and is improved with a 1-1/2 story frame dwelling with shed as shown on the April 26, 1995 survey prepared by Roderick VanTuyl, P.C. BASIS OF APPLICATION: Building Department's February 28, 2005 Notice of Disapproval, citing Section 100-242A in its denial of an application for a building permit to construct an addition, for the reason that the new construction will increase the degree of nonconforming with a front yard at less than the code-required 35 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 4, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct additions to the existing dwelling, the front portion of which is proposed within the 35 ft. restricted front yard setback area, as shown on the 1/23/05 diagram drawn by John F. Barkiski, P.E. The new 4' deep front change involves an increased height affecting an existing 74 sq. ft. of floor space, approximately 3.3 feet higher than the lower, front one-story section. Also proposed is an increase in the existing overall height, increased from 20 ft. 3-1/16th inches to 23 ft 9-3/16th inches to the top of the highest ridge of the new construction. The setback is shown at a minimum of 31 ft. from the front lot line for the new, second-level construction roof area. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: • • Page 2—May 12,2005 , • ZB Ref. 5695—Donald Tison CTM ID: 56-3-4 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's home is the only 11/2 story home among larger, two-story homes in the neighborhood along Laurel Avenue. The setback is proposed to be increased to a minimum of 31 feet with the new two-story construction. The existing setback is 27 feet at its closest point from the front lot line, which will remain at an one-story level. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. This particular house was built parallel to the front property line, which places the house on a 30 degree angle to the side property line. This angled location leaves little to no room for expansion, and the logical choice is to build up over the existing first floor area. 3. The variance granted herein is not substantial. 4. The difficulty was self-created when the applicant purchased the lot knowing the tight side and front yard tolerances. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the 1/23/05 and 2/13/05 elevation and floor diagrams prepared by John F. Barkiski, P.E., and setbacks shown on the April 26, 1995 survey prepared by Roderick VanTuyl, P.C. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. An error has been made by the Building Department by disapproving our application based on Article XXIV section 100-242A of the Town Code. This section addresses nonconforming buildings and our home conforms to the standards found in the exemption and modification section in Article XXIII, Section 100-230 A, Exceptions and Modifications: Our home conforms with the Code relating to our front yard set back from Laurel Avenue following 100-230 A. The Building Department's action is an unreasonable interpretation of the code. Background Our home, at 170 Laurel Avenue, and other properties in the area are mostly non- conforming in lot size. These parcels are situated in much the same way as ours with buildings closer to the road than is currently the standard. Our home is 27 feet from the street. We have been renovating our house from the bottom up. Once we reached the roof we discovered that it was structurally unsound. The structure was not repairable in tact or at the same height. Our only option was to build over the existing failing roof structure. I began building the replacement roof in July of 2004 and substantially completed it before winter set in by mid December. We received a letter from the Building Department in late December explaining a complaint had been received about our roof and that the Code requires a building permit. Shortly after we received the letter, I met with the Building Inspector and he introduced me to the Permits Examiner, Patricia Conklin. She explained the process to me and I proceeded to develop the plans and gather other required papers. I met Ms. Conklin a number of times and she explained the Code. At its closet point our home is 27 feet from the road and our new roof structure is 31 feet. The Code defines this set back as a reduced front yard or an established front yard. The Code normally requires a 35-foot front yard set back for a lot our size. The new roof starting 31 feet from the road has increased the existing roof height by 39 7/16 of an inch. The Plan Examiner showed me the exception section, which allows new construction if it meets an average —2— March 17,2005 of other properties existing front yards within 300 feet. On this part of the section I consulted with her a number of times and identified a flag lot behind us that would not be included in the average. We also discussed the corner lot to our south with its home about 23-feet from Main Road. Its front-yard was established nearly two hundred years ago facing Main Road and side-yard facing Laurel Avenue. At that time she indicated that it would probably not come into play in the averaging. It was my belief corner lot 5 had its established front-yard on Maine Road and its established side side-yard on Laurel Avenue as viewed from 100-230A. We submitted our application on February 23, 2005. A few days later I was surprised that our application had been disapproved. The disapproval cited that a nonconforming building cannot be made more nonconforming following Article XXIV section 100-242(A). In a conversation after disapproval, Ms. Conklin explained that the corner lot had two front yards, and did not help us. Her decision to disapprove was based on 100-232A modifying the corner lot standard to include front yards on both streets. Assertion of compliance The Building Department misconstrued the Code. In 1989 when section 100-232A was adopted it changed lot-fives Laurel Avenues side yard to a front-yard. It created a 35-foot set back requirement for new construction on Laurel Avenue. The section did not change the measure of its home to Laurel Avenue to an"established front yard". Contrary to the disapproval, we meet the Codes averaging standards including the corner lot required 35-foot front-yard set back. Our required set back is 28-feet 4-inches; our roof repair and alteration begins at 31-feet. Our application was submitted with drawings, plans, surveys and a scaled plan of Lower Laurel Avenue showing our neighborhood. This plan confirms we meet the standards of Article XXIII, Section 100-230 (A), Exceptions and Modifications. The plan of Lower Laurel Avenue was sealed and stamped by a New York State Registered Engineer. The accompanying surveys included our lot and lot 2.3 behind us. These surveys include all relevant boundary lines needed to calculate building setbacks from the street. They show all lots within the 300-foot specified distance to be used to determine our reduced setback requirement. There are three lots including ours that may be averaged to determine our reduced front yard or setback from the street. These are lot 3 to our north, with a setback to its home from the street of 23 feet; lot 4 our home, with a setback from the street of 27-feet and lot 5 our neighbor to the south. This home actually fronts on Main Road and is approximately 23-feet from it. It does not encroach into the front-yard requirement of Laurel Avenue. Request for Area Variance Our secondary request for relief is for a variance regarding written reason within the disapproval. The relief sought is from Article XXIV Section 100-242A. Background Our Home, at 170 Laurel Avenue and other properties in the area are mostly non- conforming in lot size. These parcels are situated in much the same way as ours with reduced front yards. 1. An undesirable change will not be produced in the Character of the neighborhood or a detriment to nearby properties, if granted because: We purchased our home during February of 2002. It was run down and needed repair. The repair and alteration has been designed to fit the Character of the neighborhood and the neighbors are pleased as to its appearance. It has been restored for the period that which it was first built. We had originally only wanted to install skylights in the front and changed to allow for summer venting of heat and to more fit the mid 18th century original style. • —4— March 13,2005 2. The benefit sought by us cannot be achieved by some method feasible for us, other then an area variance because: We purchased our home during February of 2002. It was run down and needed repair. During our repair and rejuvenation, it became apparent in the spring of 2004, that the original roof structure was seriously compromised. It could not be repaired in place, neither could it be insulated nor vented. The finished ceilings heights on the second floors living space were low, 60% pitched from seven feet to three feet, and the remaining at seven feet. The roof structure, its rafters were dimensionally small and placed three feet on center. The front and back rafters joined at the ridge-less peak, had separated without the original collar ties. They had been removed when a dormer was installed in the 1950's. The roof had three layers of asphalt shingles over the original rotten wood shingles. Between two layers of roofing, was found plywood fastened to non-structural sleepers, concealing a structural failure. The roofline was sagging ten inches. The severity of this discovery was the reason for the new roof structure. It was impracticable if not impossible for me alone to remove the existing roof and then replace it with a new one. My only option was to build above. 3. The amount of relief requested is not substantial because: The ability to construct the new roof structure independently form the existing required that I have a Crawl space between the two roofs. The total height is 39 7/16" but there is only 30" of space between them. Our alteration/repair starts at thirty-one feet (31) from Laurel Ave. And our front yard currently is 27'. It increases our existing roofs height thirty-nine and seven sixteenths of and inch, (39 7/16"). It is exactly over our second levels existing living area which is 74 square feet. The roof section at issue is 112 squared feet and over the existing second level living space including walls and cornice work. Two small shed dormers were added above ceiling height to vent summer heat. They measure thirty-two inches wide and high, (32") and are thirty-three feet and seven inches from the street. The normally required front yard is thirty-five feet (35'). limitations. —5— March 13,2005 4. The Variance will not have an adverse effect or impact on the physical or environmental condition in the neighborhood or district because: The area is not impacted environmentally as it does not exceeded the structure footprint. It does however improve the physical condition within the neighborhood because it improves the structure and its physical appearance. 5. The variance has not been self-created because. The structure was in need of a roof repair because of a previous dormer alteration that caused structural failure over a period of time. We could not replace them from the outside in because our ceilings do not meet the current building and we are not permitted to reduce the ceiling height further. Likewise, the standards as written and then interpreted by ZBA in Waltz, places a procedural process that is impossible to meet without a variance. Following the standard we could not have even placed new rafters directly at the same ceiling height and meet the building code. They would extend above the narrow rafters that existed at only 5". The roof was beyond repair, one had to be installed. 6. Additional information The structure as existed could not be vented or insulated. The existing bedroom layout does not meet the egress standards and the headroom was also below code. The granting of the variance would crate a structurally safe home that is conforming to the building code. Box 1179 Southold,New York 11971 Dear Patricia, Thank you for your time once again this past Friday, it was late afternoon and your time was greatly appreciated Please find attached our application for a building permit to complete repairs and alteration of our home at 170 Laurel Avenue. As we discussed, we are repairing our old home and this has required us to replace the second floor roof system. The old roof, built during the 1800's was becoming unsound. The new roof system, designed to comply with current building codes regarding structure and egress makes our home safe and will also allow us to insulate and vent the structure which was not possible before. The new taller roof begins 31 feet from the street line. You noted that there is an exception in the code that allows for a reduced set back. At that time I believed that we met all the standards of the required set backs without having to use the exception standards. Once, reviewed the survey given to us when we purchased our property, indicated that the increased roof height on the front of our home did not meet the 35 feet setback from the street line. It should be noted that our home being only twenty-seven feet from the street line, measures thirty-six feet to the actual pavement of Laurel Ave. This indicates that the pavement line of Laurel Avenue is nine feet past our front lot line or street line. I returned to your offices for a second time and we discussed the actual location of our roof alteration and its proximity, to laurel Avenue. You showed me the exemption standards that allowed a reduced set back in older neighborhoods: We briefly discussed how those standards might apply to our situation. Questions arose regarding a rear or flag lot directly behind ours with its principal building lying within three hundred feet of our new roof structure. It was not clear at that time the impact if any the flag lot may have upon the exemption standards. The standards were within the Southold town code and found within section 100-230, Exceptions and modifications. .;�- -2- February 23,2005 Attached are surveys of our property and of our neighbors flag lot directly behind us and a Plan of Lower Laurel Ave stamped by a licensed Engineer. The Plan of Lower Laurel Ave demonstrates our compliance with the standards found within section 100- 230. This section reads as follows: Section 100-230, Exceptions and modifications. "A. Established front yard setback. Where property in the vicinity is improved with principal buildings with front yards of less than that required by the provisions of this chapter, the front yard setback shall be the average setback of the existing buildings within three hundred (300) feet of the proposed building on the same side of the street within the same use district." Two existing buildings fall within these standards. The first is our home lot, number 4 on the tax map. The survey shows our existing home is twenty-seven feet, (27') from the street line. The second building is located on lot 3 on the plan. The plan shows that it measures thirty-two feet from the paved portion of Laurel Ave to the front of the home. This measure although conservative, proves our alteration meets the town code. Together an average of twenty-nine feet and six inches becomes the required front setback for any new construction on our property. This is closer to the street then our alteration is and this measure would be decreased if we were to use the actual street line for lot 3. Three properties shown on the Plan of Lower Laurel Ave do not meet the threshold of the section above and thus are not used in the averaging. First, The Lot Labeled N/F J Poliwoda and its principal building are beyond the 300' requirement. Second, the lot Labeled N/F Haesch, lot 5 is excluded from the averaging because the home fronts on the Main Road. Third, the lot labeled N/F Witzke lot 2.3 fronts on our back yard lot line and it's own accessway and is excluded as it does not front on laurel Ave. The Witzke lot is a flag or back lot with access to Laurel Ave via an access way. All principal buildings within a flag lot must meet the codes required front yard set back. That front lot line is the front lots, rear property lot line. See Town Code Section 100- 100-235 (B) . That section in part reads as follows: "The front yard of any lot having access to a street by means of an accessway shall be the required front yard specified for the district in which the lot is located and shall be measured from the rear lot line to the front lot." Therefore, the front yard set back for lot(2.3) is measured from their front lot line and that line being the same line as our lot (4) and our side neighboring lot 3.) combined rear lot lines. The code also defines "front lot line" this definition reads as follows: "LOT LINE, FRONT -- The lot line separating a lot from a street right-of-way; also referred to as "street line.""The front lot line is also defined as being the Street line. —3— February 23,2005 The fact that the flag lot 2.3 has a defined street line that is not Laurel Ave is further reinforced by the fact that the accessway is,excluded from the lot area. The section that excludes the accessway is section 100-235 (B). This section in part reads as follows: Section 100-235 (B) "Residential rear or flag lots and accessways.Any rear lot or flag lot occupied or to be occupied by a one-family dwelling shall have access thereto by means of an accessway, having a width of not less than fifteen(15) feet, serving only such lot. The area of the accessway shall not be included in determining the area of any lot. The code section'shown above excludes a rear lots accessway from the lot area. The term Lot area is further defined within the Town codes defmition section. The Codes Lot Area Definition reads as follows: "LOT AREA -- The area of a lot taken at its perimeter, exclusive of any portion within a public or private street right-of-way." The code defined "lot area" does not use the term "accessway" as is used in section 100- 235. However it uses the phrase " private street right of way". Therefore, the term "accessway" as used in the section relating to rear lots, has the same meaning as "private right of way." A right of way is used to access properties and yard and other requirements are measured from them. The town code defines Right of way as follows: RIGHT-OF-WAY LINES --The boundary lines of land used or intended for use as streets, as shown on deeds, plats or the Master Plan, and from which yard and other requirements shall be measured. A private right of way ends at a certain point leading to a rear or flag lot.At that point a line is formed separating the right of way from the remaining lot area. That line is the Front lot line. The Town Code definition of Lot Line, Front is as follows: "LOT LINE, FRONT -- The lot line separating a lot from a street right-of-way; also referred to as "street line."" The front lot line is also defined as being the Street line. The Town Code defines Street Line as`follows: "STREET LINE -- The dividing line between a lot and a street." Conclusively, Lot 2.3 does not front on Laurel Ave. Therefore it is not included in averaging out our required set back for our Property.
