Clerk MEETING OF MAY 12, 2005 ZBA Ref. 5699 - JOHN GIANNARIS and GEORGE GIANNARIS Property Location: Hellenic Restaurant, 5145 Main Road, East Marion CTM 35-2-14. Zone District: Limited Business. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 1.519-acre parcel has 238.3 ft. frontage along the north side of NYS Route 25 (or Main Road) at East Marion. The property is located in the Limited Business Zone District and improved with a restaurant, as shown on the October 12, 2004 site plan, amended February 10, 2005 by Young & Young, Surveyors. BASIS OF APPLICATION: Building Department's February 24, 2005 Notice of Disapproval, citing Section 100-82 in its denial of a building permit application additions and alterations to existing restaurant. The reason stated for disapproval is that the proposed construction will have a setback at less than 100 feet from the front property line for new construction (additions and alterations). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 4, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following fads to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct an enclosure with sliders and roof over the 30' x 34' patio which exists at 42.8 feet from the front lot line, and to construct a roof over the concrete walkway along the front of the restaurant building, existing at 22.64 feet from the front lot line at its closest point. Also proposed is new construction along the easterly side of the building, approximately 83 feet from the front lot line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property is surrounded on the north and west sides by Island End Golf Club properties, and on the east by land owned by the Village of Greenport Page 2—May 12,2005 • ZB Ref. 5699—John Giannaris• CTM ID: 35-2-14 (leased parking lot), and a private access right-of-way and residences. It is the determination of the Board that the grant of the requested setback variances will not in any way alter the character of the neighborhood or district. The front setback of the building is presently 30.4 feet with 22.6 feet from the front concrete walkway. The applicant's proposed new roof will be 20' to the top of the highest ridge. The front walkway construction measure at 8 feet by 40 +- feet, and the roof with enclosure measures approximately 30 by 34 feet (over the existing patio), all as shown on the October 12, 2004 Plan noted as Sheet 2 (grading and drainage plan) and Plan noted as Sheet 1 (landscape and alignment), prepared by Young & Young, amended February 10, 2005. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The entrance way is filling an existing notch on the northeast corner of the restaurant which maintains the same open side yard. The front walk is preexisting of the zoning code and is being roofed over for inclement weather purposes. 3. The variance granted herein is substantial, and is 78 feet closer than the code-required 100 ft. setback from the street right-of-way. 4. The difficulty has been self-created and is related to the need for to roof over and alter the existing building and related entrance areas, which building has existed for over 40 years in a nonconforming location. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Chairwoman Oliva, and duly carried, to GRANT the variances as applied for, as shown on the October 12, 2004 Plans noted as Sheet 2 (grading and drainage plan) and Sheet 1 (landscape and alignment plan), prepared by Young & Young, amended February 10, 2005, SUBJECT TO THE FOLLOWING CONDITION: That the front roofed-over walkway construction not be enclosed. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. After ten long years of refining, changing, and re-structuring of the master plan for Hellenic Cabins and Snack Bar Inc., we have chosen to focus on the evolved needs of the Restaurant. For those of you who have been our patrons, especially during our summer season, flaws in the physical layout of the restaurant are obvious. In order to accommodate whatLis the most crucial time of the year for our business we need to create a general area where patrons could wait for a table, order take out and have easy access to the restrooms. Another imperative issue is to deal with the natural elements that affect our customers who choose to dine outdoors, i.e. mosquitoes,bees,blowing rain, and chilly evenings to,name a few. We needed to make changes around the heart of our restaurant, which is the kitchen that is opened into the dining room. Our proposed changes where met with welcome from the planning department, architectural review board,building department, and the department of transportation. The department of wastewater management has already given us approval for the proposed seating. The only issue that surfaced recently was Article 8, Section 100-82 where Bulk Schedule requires a 100' front yard setback. When we applied a few years ago for a building permit to convert our canvas awning into a permanent roof, we were not required to apply for a variance. We are requesting four renovations that encroach on the front set back. Because of the original location of the restaurant, 3/4 of the building is within the 100' front set back. Even though we were very cautious about not encroaching on the side set backs, we were unaware that any modifications to the building in the easterly direction would affect the front set back. We also assumed that a variance would not be necessary because one was not needed to create the roof over the existing outdoor patio. The reason for this request is for consideration of the • setbacks of the proposed five new buildings, based upon the March 3, 2003 revised plan • and Building Department's March 13, 2003 amended Notice of Disapproval. At the public hearing no information was furnished to indicate that the requested variances would produce undesirable character changes in the neighborhood or to nearby properties. The property is surrounded on the north and west sides by the Island's End • Golf Club properties, and the east by land owned by the Village of Greenport (leased • parking lot), and a private access right-of-way and residences. It is the determination of the Board that the grant of the requested setback variances will not in any way alter the character of the neighborhood or district. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Based on the March 3, 2003 revised survey, the duplex units as proposed are positioned on a circular court on the westerly portion of the property. The purpose of this configuration was to maximize the • area needed for parking of the restaurant. The relief granted addresses this alternative requested by applicant, based on the amendments and removal of existing nonconforming buildings in nonconforming locations. • 3. The relief requested is not substantial. During on-site inspections and knowledge of the history of•the property ("Hellenic Cabins"), and the Town's Assessment records, the . • property has about 14 buildings, many of which are in nonconforming locations and all of which will be removed or demolished, and replaced with five (5) duplex buildings in locations more conforming than the existing setbacks. 4. The request for variances is self-created. All of the construction will be placed in the westerly section of the property. This area is smaller than the area occupied by cabins, and the site plan/survey affords a greater area of open space and areas slated for parking. 5. No evidence has been submitted to suggest that the grant of setback variances for new duplex buildings, after removal of existing nonconforming structures, will have an adverse impact on physical or environmental conditions in the neighborhood. . • Page 3—June 5, 2003 • Appl. Grant of the requested setback relief is the minimum action necessary and adequate • to enable the applicant to enjoy the benefit of new construction in this Limited Business • Zone District, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Tortora, and duly carded, to GRANT the Variance as applied for and shown on the plan prepared by Young & Young, L.S. dated June 19, 2002, revised March 3, 2003.
