WHEREAS, Anthony H. Palumbo applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated October 22, 2003 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 19th, 2003 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and docwnentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. . 2 . WHEREAS, the Board has determined that the project as proposed will not affect the health, Safety and general welfare of the people ofthe town. Box 1 179 53095 Routes 25 Southold, NY 11971-0959 Re: Petition for Hardship Exemption from Moratorium Palumbo property, 3550 Grathwohl Road, New Suffolk SCTM# 1000-110-8-3 Dear Members of the Board: As owners of the above-referenced property, we are requesting an exemption from the Moratorium on wetlands permits pursuant to the applicable 2003 Local Law. We have attached the following items with regard to the subject property: our most recent survey, our NYSDEC permit (issued April 2003), our Suffolk County Department of Health Services permit (issued July of2003) and the variance granted by the Town of Southold Zoning Board of Appeals (issued June of2003). Our exemption request meets all of the standard requirements relating to hardship exemptions from moratoriums. A. We will suffer hardship beyond any harm to the Town or the general public welfare which would result from granting this hardship exemption. We purchased the property in April of 2002 with the hopes of building our . primary residence on it and under the belief that such dreams were possible. At that time, your Board was issuing permits and there was no moratorium in effect. Since April of2002, we have made many sacrifices to make our dream a reality, both personal and financial. Some of these efforts include: 1. Retention of an architect and engineer to draft and redraft plans for a modest home that satisfied the criteria of the Town Zoning Board of Appeals and that was keeping with the character and aesthetics of the community; 2. Retention of a surveyor to survey, resurvey and make further revisions on numerous occasions at the behest of the NYSDEC, the Suffolk County Department of Health Services, and the Town Zoning Board of Appeals; 3, Applying to the NYSDEC for a wetlands permit; 4. Applying to and lengthy negotiations with the Suffolk County Department of Health Services for a variance/permit, as well as an appeal which was granted unanimously; . . . . 5. Applying to the Suffolk County Water Authority for an extension of the water main ftom New Suffolk Road down Grathwohl Road and lengthy negotiations resulting in an agreement by the Suffolk County Water Authority to extend the water main, at their expense, providing the alternative of public water to us and our neighbors; 6. Applying to the Town of Southold Zoning Board of Appeals for a variance to build our home as far away ftom the NYSDEC wetlands line as possible (further than many of the existing homes); and 7. Obtaining a "single and separate" title search to prove that the property was not merged or part of a subdivision and, therefore, does not fall under the jurisdiction of the Planning Board (which it does not). At no time during the process of applying for the above permits and hearings did we receive any objections ftom our neighbors. In fact, we have had numerous discussions with our neighbors who have expressed support for us and look forward to welcoming us into the community. Due to the fact that every other agency has approved our application to build except for this Board, the Southold Town Building Department has indicated that our building permit will be issued as soon as we obtain a wetlands permit ftom the Board. As such, the existence of this moratorium and, as a result our inability to obtain a permit ftom the Board, has rendered this property unbuildable. Notwithstanding our dreams of building our home and raising our family in this community, if the financial burden of owning an unbuildable lot were to force us to sell it, we could not do so, due to the moratorium. In other words, since the moratorium renders the lot unbuildable, it has no value to us or any potential buyer. Based on these facts, we urge the Board to consider the dire nature of our situation and issue a hardship exemption, thereby alleviating the burdens of the moratorium so that we may build our modest home. B. The granting of this exemption will have no adverse impact upon any of the Town's goals or objective's contained in the comprehensive planning objectives of the Town and the Town's Local Waterfront Revitalization Program and the Peconic Estuary Comprehensive Management Plan. As can be seen by the NYSDEC approval of our project and the language set forth in their permit annexed hereto, the size and the location of our proposed home and the safeguards we have agreed to employ will have no adverse impact on the wetlands. Our home will be located at its closest point, 83 feet ftom the flagged wetland boundary. Moreover, we have covenanted to maintain a 20 foot deep "buffer zone" along the ftont of our property between the house and the wetlands boundary. In fact, we have already purchased thirty-five Northern Bayberry plants which we have been nurturing to maturity . . . in anticipation ofrevegetating the buffer zone to enhance its aesthetic appearance. We would also note that none of the other properties on Grathwohl Road (approx. '!. mile) has a 20 foot buffer zone in front oftheir house. In fact, almost every other home maintains an ordinary grass lawn all the way to the road--even those houses closer to the wetlands, directly across from the water, Lastly, under Article II Section 97-20 (B) of the proposed revisions, the Trustees may waive the wetlands permit requirement if the operations do not substantially adversely affect the wetlands of the Town. Based on the NYSDEC's analysis of our project coupled with the fact that a paved road (Grathwohl Road) exists between our property and the wetlands boundary, it is clear that our project will have no adverse impact on the Town's goals in preserving the wetlands and will, in fact, enhance the surrounding neighborhood. Time is critical to our situation and the rejection by the Board of this hardship application will irreparably harm us. Although the moratorium came into effect in January of this year, whether or not we are permitted to begin building our home in the next month, rather than some time next year is crucial. Based on the finances we have expended thus far, the impending winter and the pursuit of permits to build (which are limited in time), if we are not permitted to begin construction prior to the winter months we will be unable to pursue the project at all. Based on the above, we respectfully request that the Board grant us a hardship exemption from the moratorium. Any work, disturbance, and storage of construction materials shall be confined to within the "Limit of clearing, grading and ground disturbance" as shown on the approved plan. 2, Prior to commencement of any construction activities, a continuous row of straw bales shall be staked end to end along the limit of ciearing, grading and ground disturbance line as shown on the approved plans, The bales shall be maintained, repaired and replaced as often as necessary to ensure proper function, until all disturbed areas are permanently vegetated. The average useful life of a bale is approximately 3-4 months. Sediments trapped by the bales shall be removed to an approved upland location before the bales themselves are removed, 3. Straw bales shall be recessed two to four inches Into the ground. 4. All equipment and machinery shall be stored and safely contained greater than 100 feet landward of the regulated wetland or water body at the end of each work day. This will serve to avoid the inadvertent leakage of deleterious substances into the regulated area. Fuel or other chemical storage tanks shall be contained and located at all times in an area greater than 100 feet landward of the regulated wetiand or water body. If the above requirement cannot be met by the permittee, then the storage areas must be designed to completely contain any and all potential leakage, Such a containment system must be approved by NYSDEC staff prior to equipment, machinery or tank storage within 100 feet of the regulated wetland or water body. 5. All fill shall consist of clean soil, sand and/or gravel that is free of the following substances: asphalt, slag, flyash, broken concrete, demolition debris, garbage, household refuse, tires, woody materials including tree or landscape debris, and metal objects. The introduction of materials toxic to aquatic life is expressly prohibited. 6. All areas of soil disturbance resulting from this project shall be seeded with an appropriate perennial grass, and mulched with straw immediately upon completion of the project, within two (2) days of final grading, or by the expiration of the permit, whichever is first. Mulch shall be maintained until a suitable vegetative cover is established. If seeding is impracticable due to the time of year, a temporary mulch shall be applied and final seeding shall be performed as soon as weather conditions favor germination and growth, 7. Suitable vegetative cover is defined as a minimum of 85% area vegetative cover with contiguous unvegetated areas no larger than 1 square foot in size. 8. All existing cleared areas within the 20-foot wide natural vegetation buffer shall be replanted with Northem bayberry (Myrica pennsylvanica) and / or Eastern red cedar (Juniperus virginiana), 3·feet to 4-feet in height and planted 6-foot on center in a grid pattern. 9. Any demolition debris, excess construction materials, and/or excess excavated materials shall be immediately and completely disposed of on an approved upland site more than 100 feet from any regulated freshwater wetland. These materials shall be suitably stabilized so as not to re-enter any water body, wetland, or wetland adjacent area. 10. This indemnification does not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any claims, suits, or actions naming the DEC and arising under article 78 of the New York Civil Practice laws and Rules or any citizen suit or civil rights provision under federal or state laws, ItemB: Permittee's Contractors to Comply with Permit The permittee is responsible for informing its independent contractors, employees, agents and assigns of their responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee, ItemC: Permittee Responsible for Obtaining Other Required Permits The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may be required to carry out the activities that are authorized by this permit. ItemD: No Right to Trespass or Interfere with Riparian Rights This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. GENERAL CONDITIONS General Condition 1 : Facility Inspection by the Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. Determination It was a 3 to 0 determination of the Board of Review (Board) to grant the request for the variance to construct the dwelling and utilize the existing sewage disposal system, The sewage disposal system is located such that groundwater flow is away fi'om surrounding affected wells. This variance is granted subject to connection of the new dwelling to the community water supply and subject to submittal of an accurate survey showing the Szymczak well to the south. As per §760-609 of the Suffolk County Sanitary Code (Sanitary Code), the approval of the variance is in hannony with the general purpose and intent of the Sanitary Code to protect groundwater and drinking water supplies, surface water and other natural resources, and public health, safety and welfare.
