The house is more than 40 feet above grade and the only work proposed within your jurisdiction is to existing structures. You approved the permit but requested that we relocate the existing fence. Enclosed is the plan last revised 4-21-05 which relocates the existing fence to along the bank. The owners are anxious to begin the renovation of the existing house and pool and have submitted the plan in order to obtain a building permit for the renovations. We respectfully request that the permit be issued in accordance with the plan. However, at the next Board meeting (or as soon as possible), we would respectfully request that the condition that we relocate the fence be reviewed. The fence was originally located landward of the bulkhead to protect the property from trespassers, particularly with the dangers of a swimming pool. In addition, the bath house has been vandalized in the past. We do not want to leave this property unsecured behind the bath house. The existing fence is heavily landscaped, and the toe of the slope is stable with dense mature vegetation. My client is concerned that removing the fence may undermine a very vegetated stable toe of the slope. Given both the security and environmental concerns we would request that you reevaluate the condition that the existing fence be removed. Ve-". my yours, Patricia C.
