SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in 3his application and determines that this review falls under the Type II category
of the State's List of Actions, without an adverse effect on the environment if the project is
implemented as planned.
The Zoning Board of Appeals held a public hearing on this application on April 22, 2004, at
which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board finds
the following facts to be true and relevant:
REQUEST MADE BY APPLICANT:
The Applicant-Owner-Resident, Carol Santacroce, requests a Special Exception as provided
under Article III, Section 100-31 B, sub-section 13 of the Zoning Code, to establish an Accessory
Apartment within the existing principal building. The original house was built in 1971, and
Certificate of Occupancy #Z-5928 dated May 24, 1974 was issued for a private one-family
dwelling.
PROPERTY FACTSIDESCRIPTION: This property is 32,880 sq. ft. with 105 ft. on the east
side of Kerwin Boulevard, Greenport. The property is improved with an existing one-story frame
residence, shown on a survey dated 11-10-03, revised 1-7-04 by Stanley J. Isaksen, Jr. The
existing house (heated area) is 1454.49 sq. ft. and garage is 498.62 sq. ft.
FINDINGS OF FACT
In considering this application, the Board has reviewed the code requirements set forth pursuant
to Article III, Section 100-31B(13) to establish an Accessory Apartment and finds that the
applicant complies with the requirements for the reasons noted below:
1. The Accessory Apartment is proposed with a livable area of 1033.91 sq. ft. The Apartment
unit will be meet the code requirement of less than the 40%. The total house after the addition
and renovations will be 3,630.24 sq. ft., including 498.62 sq. ft. for the garage and 3131.62 sq.
ft. of (heated) living area. The primary residence will consist of 2098 sq. ft. and the apartment
area of 1033.91 sq. ft.

2. The applicant-owner will occupy the primary dwelling unit (both second and partial first-floor
areas as proposed).
3. The applicant's plans comply with the on-site parking requirements and provide for a total of
three (3) parking spaces, two for the principal use and one for the Accessory Apartment,
utilizing the open yard and driveway areas.
4. The project meets the requirements of Section 100-13 as an existing dwelling unit. After
completion of the renovations and addition, the dwelling will contain 3,132.62 sq. ft., as shown
on the revised plans prepared by Penny Lumber 2/10/04 floor plans, and Penny Lumber letter
dated 4/27/04 confirming the square footage breakdowns, requested by the Board at the
4/22/04 public hearing. (The original Penny Lumber Plans dated 4/10/04 were replaced at the
4/22/04 public hearing by the applicant, with applicant's 2/10/04 set of plans. The older version
contained only small variables in the square footages of the floor areas for the apartment and
primary unit.
5. The plans indicate that exterior entry to the Accessory Apartment of the existing one-family
dwelling will retain the existing appearance of a one-family dwelling.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony,
documentation, and other evidence, the Zoning Board determined the following Findings of Fact
to be true and relevant:
1) The Accessory Apartment, as applied for, is reasonable in relation to the District in which is
located, adjacent use districts, and nearby and adjacent residential uses.
2) The Special Exception use is accessory to the principal use and will not prevent the orderly
and reasonable use of adjacent properties.
3) This accessory use will not prevent orderly and reasonable uses proposed or existing in
adjacent use districts.
4) No evidence has been submitted to show that the safety, health, welfare, comfort,
convenience, order of the Town would be adversely affected.
5) This zoning use is authorized by the Zoning Code through the Board of Appeals, as noted
herein, and a Certificate for Occupancy from the Building Inspector is a code requirement before
an Accessory Apartment may be occupied.
6) No adverse Conditions were found after considering items listed under Section 100-263 and
100-264 of the Zoning Code.

7) A Certificate of Compliance or similar document will be necessary for issuance by the
Building Inspector certifying that the premises conforms to Ch. 100 of-Zoning for an Accessory
Apartment use.
RESOLUTION: On motion by Member.Goehringer, seconded by Chairwoman Oliva, it was
RESOLVED, to GRANT the Special Exception application for an Accessory
Apartment, to be used in conjunction with applicant-owner's residence, as applied for,
SUBJECT-TO THE FOLLOWING CONDITIONS:
1. The driveway shall provide sufficient turning area to prevent backing out of vehicles onto
the street.
2. A Certificate of Occupancy or other necessary written compliance document shall be
obtained from the Building Department before occupancy of the Accessory Apartment.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 25, 2004 regarding the above matter:
WHEREAS, Joseph Santacroce on behalf of CAROL SANTACROCE applied to the
Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold
Town Code, the Wetland Ordinance of the Town of Southold, application dated January
30, 2004, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 25, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of CAROL
SANTACROCE to construct a second-floor addition to the existing one-story residence
and outdoor cellar entrance, with the condition a line of staked hay bales is installed
around the construction area on the seaward side of the house prior to construction and
drywells and gutters are installed to contain the roof run-off.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$5.00 per inspection. (See attached schedule.)

ADDITIONAL INFORMATION REGARDING
LETTERS OF MAP AMENDMENT
For Letters of Map Amendment (LOMAs), the Federal Emergency Management Agency (FEMA)
bases its determination on the flood hazard information available at the time of the determination.
Requestors should be aware that flood conditions may change or new information may be
generated that would supersede FEMA's determination. In such cases, the community will be
informed by letter.
Requestors also should be aware that removal of.a property (parcel of land or structure) from the
Special Flood Hazard Area (SFHA) means FEMA has determined that the property is not subject
to inundation by the flood having a I-percent chance of being equaled or exceeded in any.givsn
year (base flood). This does not mean the property is not subject to other flood.hazards. The
property could be inundated by a flood with a magnitude greater than the base flood or by
localized flooding not shown on the effective National Flood Insurance Program (NFIP) map.
The effect of a LOMA is that it removes the Federal requirement for the lender to require flood .
insurance coverage for the property. The LOMA is not a waiver of the condition that the property
owner maintain flood insurance coverage for the property. Only the lender can waive the flood
insurance purchase requirement because the lender imposed the requirement. The property owner
must,request and receive a written waiver from the lender before canceling the policy" The"lender
may determine, on its own as a .business decision; that it wishes to continue the flood insurance
requirement to protect its financial risk on the loan. If the lender decides to release the property
owner from the flood insurance requirement, and the property owner decides to cancel the policy
and seek a refund, the NFIP will refund the premium paid for the current policy year,provided that
no claim is pending or has been paid on the policy during the current policy year, The property
owner must provide the written waiver to the property insurance agent or company that is servicing
his or her policy. The agent or company will then process the refund request.
The LOMA provides FEMA's comment on the mandatory flood insurance requirements of the
NFIP as they apply to a particular property. A LOMA is not a building permit, nor should it be
construed as such. Any development, new construction, or substantial improvement of a property..
impacted by. a LOMA must comply with all applicable State/Commonwealth, local, and other
Federal criteria.
Even though the property is not located in an SFHA, as mentioned in the LOMA, it could be
flooded by a flooding event with a greater magnitude than the base flood. In fact, more than 25
percent of all losses in the NFIP occur to property located outside the SFHA in Zones B, C, X
(shaded), or X (unshaded). More than one-fourth.of all policies purchased under the NFIP protect
property located in these zones. That risk is just not as great as the flood risk to property located in
SFHAs. To offer flood insurance protection to owners of such property, the NFIP offers two types
of flood insurance policies: the Standard Policy and the Preferred Risk Policy (PRP). .The PRP is
available at low cost for buildings located outside the SFHA with little or no loss history.
Information about the PRP and how one can apply is enclosed. The Standard Policy is available
for all other buildings. Individual flood risk situations and insurance needs should be discussed
with an insurance agent or company before making a final .decision regarding flood insurance
coverage.
FEMA has established "Grandfather" rules to benefit flood insurance policyholders who have
maintained continuous coverage. In addition, if property owners live outside the fringe of the
SFHA shown on an effective NFIP map and the NFIP map is later revised to expand the SFHA to
include their structure(s), their flood insurance policy rates will not increase as long as the.
coverage for the affected structure(s) has been continuous. Property owners would continue to
receive the lower insurance policy rates.
LOMAs are based on minimum criteria established by the NFIP. State/Commonwealth, county,
and community officials,based on knowledge of local conditions and in the interest of safety,may .
set higher standards for construction. in the SFHA. If the State/Commonwealth, county, or
community has adopted more restrictive and comprehensive floodplain management criteria, these
criteria take precedence over the minimum Federal criteria.
Letters issued to amend or revise maps must be attached to the community's official record copy
of the NFIP map. That map is.available for public inspection at the community's official map
repository. Therefore, FEMA sends copies of all such letters to the affected community's official
map repository.
When a restudy is undertaken, or when a sufficient number of revisions or amendments occur on
particular map panels,FEMA initiates the printing and distribution process for the affected panels.
FEMA notifies community officials by letter when affected map panels are being physically
revised and distributed. In such cases, FEMA attempts to reflect the results of the LOMA on the
new map panel. If the results of particular LOMAs cannot be reflected on the new map panels
because of scale limitations, FEMA notifies the community by letter and revalidates the LOMAs in
that letter. LOMAs that are revalidated in this way become effective 1 day after the effective date
of the revised map panels. _ a

INSTRUCTIONS
a.This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b.Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e.No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter,a new permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of Southold, Suffolk County,New York, and other applicable Laws, Ordinances or
Regulations, for the construction of buildings, additions, or alterations or for removal or demolition as herein described. The
applicant agrees to comply with all applicable laws, ordinances, building code, housing code, and regulations,and to admit
authorized inspectors on premises and in building for necessary inspections. / n
