Dear Mr. & Mrs. Gluckman:
The Southold Town Board of Trustees reviewed the survey dated January 22, 2002 and
last revised April 6, 2002 and determined the proposed patio and reconstruction of the
existing single-family dwelling to be out of the Wetland jurisdiction under Chapter 97 of
the Town Wetland Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your. project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

referenced property. The Gluckman's have proposed a
concrete & masonry patio along the rear of their existing
residence. The patio appears to be outside of your
jurisdiction, however, the building department will
request that you make this determination. Therefore, we
would request a letter that no permit is necessary.

and Board:
East End Drafting has advised me that the owner's
house requires immediate repairs to the existing
foundation and construction of block foundation under the
existing house. Enclosed is a survey which shows the
location of the house at @103 feet from the Bulkhead.
Pursuant to section 100-239.4 (B) we are required to
be set back 75 feet from the bulkhead. However,
according to chapter 97 we must be located 100 from
wetlands. Given the discrepancy in the code we want to
be sure that you look at this and grant a ~'waiver" so
that we can proceed with the repairs and construction of
the foundation under the existing house.
Attached is a copy of the survey with yellow
highlighter which identifies the area of the house which
will be worked on.
