Dear Mr. Herrmann:
The Southold Town Board of Trustees reviewed the survey prepared by John C. Ehlers
last dated January 24, 2005 and determined the proposed additions to the existing
single-family dwelling to be out of the Wetland jurisdiction under Chapter 97 of the Town
Wetland Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

Dear Mr. Krupski:
We represent Joyce Friedland, who plans to construct a one-story house and deck addition to an
existing two-story, one-family dwelling on the captioned property, as depicted on the enclosed
site plan prepared by John C. Ehlers, last dated January 24, 2005.
Because all work will occur more than 100 t~et from wetlands associated with both Cutchogue
Harbor and Haywaters Cove, no wetlands permit will be required from the Board of Trustees
pursuant to Sections 97-12(C) of the Town Code. Therefore, would you kindly issue a Letter of
Non-Jurisdiction for the project at your earliest convenience.
Also enclosed for your reference are recent photographs of the site and a letter from Ms.
Friedland authorizing Eh~Consultants, Inc. to act on her behall~
