Suter: The following action was taken by the Board of Town Trustees during its regular meeting held on August 23, 2000 regarding the above matter: WHEREAS , BOBETTE SUTER applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated June 29 , 2000, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations , and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 23, 2000 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this .application, and, WHEREAS, the structure complies with the standard set forth in Chapter, 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of BOBETTE SUTER for a 41X 38 ' dock, 3 . 6 'X 16 ' ramp, 6 'X 16 ' float and 2 pilings, with the condition that when the dock is reconstructed, this Board has to be notified and that the outward limit has to be in-line with the adjacent neighbors . BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Over the years I have seen docks built, repaired and altered on our Haywaters creek. P Southold, New York 11971 JUS / 12000 Attn: Al Krupski r Re: Suter Dock Fisherman's Beach Road Cutchogue, N.Y. 11935 Dear Chairman Krupski, There was an existing dock on the referenced property in 1959 when I bought my house on Fisherman's Beach Road. Rambo replaced the mooring piles in the early 701s. The dock was built by Herm Johnson. He had built the Suter's house, the Perrones house, and the Shank's house which is adjacent to the Suter's dock. 'The dock is probably inside the subdivision creekside tie line and it's not unlikely that the Trustees, at the time, believed the bottom was owned by the creekside property owners. At that time, the only house on the creek was the Shank bungalow. I do not question the Trustees ' jurisdiction about the tie line, but bring it up as a local historical oddity.
