Dear Ms. Thompson,
The Southold Town Board of Trustees reviewed the survey dated
and received in our office on January 5, 1999, amd determined
that your proposal to demolish an existing garage ~ and to add
an addition to existing house, to be out of the Trustee Wetland
jurisdiction, under Chapter 97, and the Coastal Erosion Hazard
Area under Chapter 37 of the Town Code.
However,
project
permits
any activity within 75' of the Wetland line, or any
seaward of the Coastal Erosion Hazard Line would require
from this office.
This determination is not a determination from any other agency..
If you have any further questions, please do not hesitate to
call.

Based on ~he information you have submitted, the New York State
Department of Environmental Conservation has determined t21at:
the property landward of ~he bulkhead greater than 100 ft.,
constructed prior to September 1977 as ~hov~ on the survey prepared
by Va~ T~yl & Son dated 3/13/68 a~d last amended 12/19/68 is beyond
the jurisdiction of Article 25 Tidal Wetlands.
Therefore, in accordance with the current Tidal Wetlands Land Use
Regulations (6NYCRRPart 661) no permit ie required under the Tidal
Wetlands Att . Please ~e advised, however, that no construction,
sedi~enta=ion, or disturbance of any kind may ~a~e place seaward of
the =idal wetlands jurisdictional bo~dary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
o~har alteration or disturbance to ~ha ground surface or vegetation
within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
Please be further advised t/tat t/tis letter does not relieve you of
the responsibility of obtaining any necessary permits or approvals
from other agencies.
