The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, April 17, 2013:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Administrative
Amendment to Wetland Permit #-4559 to include one (1) 6'x20' floating dock or jet ski
float; one (1) 3'x12' ramp leading to dock; cut back existing fixed catwalk approximately
12' to have end of catwalk even with water tine, not to extend beyond the edge of
marsh; remove existing walkway through non-disturbance buffer; lights on catwalk to be
located at the beginning and the end of the structure; re-vegetate non-disturbance
buffer area with local plantings and subsequently maintained; and as depicted on the
project plan prepared by James Orioli, received on March 13, 2013 and stamped
approved on April 17, 2013.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

STIPULATION OF SETTLEMENT
WHEREAS, petitioners commenced this Article 78 proceeding to challenge the
respondent's denial of their application for an amendment to wetland permit #4559 for their
premises located at 495 Halls Creek Drive, Mattituck, New York; and
WHEREAS, the petitioners have agreed to modify their application in accordance with
the terms provided herein below; and
WHEREAS, the parties desire to settle this proceeding due to the uncertainties of
litigation and the considerable expense that will be incurred in conducting the litigation; and
WHEREAS, this agreement is being entered into for settlement purposes only and shall
not constitute a precedent with respect to any future permit applications by the petitioners or
others in the Town of Southold;
NOW, in consideration of the settlement of this matter, the parties agree as follows:
1. Upon the stipulation being signed by both parties, the petitioners shall present it to
the Court to be "so-ordered".
2. Upon the stipulation being "so-ordered" by the Court, the petitioners shall file a
modified application to amend permit//4559 in accordance with the following requirements:
a) the existing 130 foot catwalk shall be shortened by at least 12 feet so as
not to extend beyond the edge of marsh. Petitioners can place walk lights
that project the light downward at the beginning and end of the catwalk
but there shall be no walk lights in the protected area; and lights along
walkway must be removed.

than 12 feet;
c) construction of a 6' x 20' floating dock with two (2) 6" diameter pilings; or
a jet ski float not to exceed 120 square feet, but not both.
d) requesting of approval of the as-built pool, drywell and backwash;
e) requesting of approval of the as-built pergola planting as required by the
current permit four (4) 6" wide oak trees;
f) re-vegetation of the non-disturbance buffer area and around the pool in
accordance with a new plan to be submitted;
g) removal of walkway in the non-disturbance buffer area; and
h) electric/lighting at the beginning and end of catwalk used only when in
active use.
3. Upon receipt of the modified application to amend permit//4559, the respondent
shall review the submittal for compliance with the terms set forth above. If compliant, the
respondent shall issue a wetland permit within 30 days thereafter without any further public
heatings thereon.
4. Counsel for the petitioners will thereafter prepare a stipulation of discontinuance,
with prejudice and without cost to either party, to be executed by counsel for the parties, counsel
for petitioners shall file the fully executed stipulation with the Court.
5. Upon special counsel for respondent's receipt of proof that the stipulation of
discontinuance has been filed, the amended permit shah be released to the petitioners.

Dear Mr. & Mrs. Orioli:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., February 22, 2012:
WHEREAS, JAMES ORIOLI & SUSAN MAGG applied to the Southold Town Trustees
for an Amendment to Wetland Permit #4559 under the provisiohs of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated December 1,2011, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and specifically Inconsistent with the following
coastal policy: Policy 6.3 - Protect and restore tidal and freshwater wet/ands, and,
WHEREAS, the as-built 130' catwalk and proposed 3'X 6' ramp, 6'X 30' floating dock
with two (2) 6" dia. pilings to secure dock, and one (1) seasonally removed 8'X 18' jet-
ski floating dock do not comply with previously issued wetland permit(s) as well as the
standards set forth in Chapter 275-11 Construction and Operation Standards of the
Southold Town Code, and,
WHEREAS, the as-built 130' catwalk and the one 8' X 18' jet ski floating dock were the
subject of code violations adjudicated in Southold Town Justice Court, and,
WHEREAS, the Board has determined that the as-built 130' catwalk and proposed 3'X
6' ramp, 6'X 30' floating dock with two (2) 6" dia. pilings to secure dock, and one (1)
seasonally removed 8'X 18' jet-ski floating dock will affect the health, safety and general
welfare of the people of the town, and,
NOW THEREFORE BE IT,
RESOLVED, for the foregoing reasons, and based upon the application's failure to meet
the standards contained in Chapter 275 of the Town Code, that the Board of Trustees
deems the proposed project to be Inconsistent with the Local Waterfront Revitalization
Program pursuant to Chapter 268-5 of the Southold Town Code, based on the size of
the existing and proposed structures, the adverse affect on the views, viewsheds and
vistas important to the community, and the overall impact of the proposed project on the
tidal wetlands, and,
BE IT FURTHER
RESOLVED, that the Southold Town Board of Trustees DENIES the Amendment to
Wetland Permit #4559 for the as-built 130' catwalk with extended walkway; a proposed
3'X 6' ramp; a 6'X 30' floating dock with two (2) 6" dia. pilings to secure dock; and one
(1) seasonally removed 8'X 18' jet-ski floating dock, as applied for.

during its regular meeting held on February 28, 1996, regarding
the above matter:
WHEREAS, SUSAN MAGG, applied to the Southold Town Trustees
for a permit under the provisions of the Wetland OrdiDance of
the Town of Southotd, application dated November 9, 1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on Februar~ 28, 1996, at which time
all interested persons were given an opportunity to be heard,

WHEREAS, the Board members have personally viewed and are

documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,

Dear Sir/Madam;
During a recent inspection, Department staff noted a potential violation at 495 Halls
Creek Drive, Mattituck (Suffolk County). Specifically, Clearing of vegetation at the 10' contour
line in elevation. These are regulated activities within the Department's Tidal Wetland
jurisdiction and therefore, require a permit from the Department.
Conducting regulated activities without the required NYSDEC permits is a violation of
Article 25 ofthe State's Environmental Conservation Law. Such violations may be subject to a
maximum penalty of $10,000 per day per violation.
At this time, the Department is issuing this warning letter in lieu of further enforcement action
against you. We now consider this violation resolved. You are reminded, however, that any future
regulated activity at or below the 10' contour line in elevation will require the appropriate permits.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed as built
3'x6' ramp and 6'x30' (180 square foot) platform is not a permissible action pursuant to 275-11
Construction and operation standards, A (6) and is INCONSISTENT with LWRP Policy 6.3 (below) and
therefore, INCONSlST£NT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and ether lands under their jurisdiction

275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of the
Trustees C. (2) (c) [b] [i[:
b] If any part of a residential dock structure includes a float or floating dock, the
float or floating dock portion shall be designed so that, with the exception of the
pilings:
[il It is no larger than six feet wide and 20 feet long except on Fishers
Island if the need is demonstrated; or of equal square footage as
determined by the Trustees; [Amended 12-18-2007 by L.L. No. 23-2007]
The 3'x6' ramp and 6'x30' (180 square foot) platform were constructed without a permit pursuant to
Chapter 275 Wetlands and Shorelines of the Southold Town Code. It is recommended that the
structures be removed.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
