Box 2003 Bridgehampton, NY 11932-2003 RE: DAREN PFENNIG SUNSET BLUFF LANE, CUTCHOGUE SCTM#72-2-2.3 Dear Mr. Barron: The Southold Town Board of Trustees reviewed the survey prepared by Joseph A. Ingegno last dated September 2, 2005 and determined the proposed construction of a single-family dwelling, deck, swimming pool, and sanitary system to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 25' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 97 and/or Chapter 37 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office. Sunset Bluff Lane Cutchogue; Town of Southold, NY 1000-072-02-002.3 This Firm represents Darren Pfennig, owner of the above referenced property, who wishes to construct improvements thereon. Mr. Pfennig is proposing to construct a 40' x 69' dwelling located 244' from the tidal wetland boundary (AHW) and 130' landward of the top of binff, a 15' x 69' deck located 230' from AHW and 118' landward of the top of bluff, a 20' x 40' pool located 220' from AHW and 107' landward of the top of bluff, a sanitary system located 320' from AHW and 209' landward of the top of bluff, and a driveway located 302' from AHW and 190' landward of the top of bluff. As evidenced on the enclosed survey, all proposed improvements are to take place no closer than 107' ± landward of the top of bluff. Likewise, all proposed improvements are landward of the Coastal Erosion Hazard Line. By way of this correspondence and pursuant to Chapter 97-12 (C) (3), I hereby request a Letter of Non-Jurisdiction for the proposed improvements on the aforementioned property. Enclosed herewith for your review please find the following materials: ( I ) Survey of subject parcel prepared by Joseph Ingegno dated January 9, 2002 and last revised September 2, 2005, depicting the proposed improvements (one [1] copies); (2) Check in the amotmt of $50.00 Kindly forward the requested Letter of Non-Jurisdiction directly to this office.
