Box 162 Mattituck, NY 11952 RE: 1475 POINT PLEASANT RD., MATTITUCK SCTM#1 '14-1-5.2 Dear Mr. Dumblis: The Southold Town Board of Trustees reviewed the survey prepared by John T. Metzger last dated July 21,2005 and determined the proposed covered porch to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 25' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 97 and/or Chapter 37 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office. 2 This determination is not a determination from any other agency. Box 1179 Southold, New York 11971 John P Durnblis PO Box 162 Mattituck, NY I August 25, 2005 Dear Members of the Board of Town Trustees: The following is in regards to my residence, located at 1475 Point Pleasant Road (also known as Home Pike), Mattituck, a single family home located along Mattituck Creek. I anticipate construction of a covered deck (or 3 seasons room) along the east face of the existing house, an area currently the location of an existing elevated deck covering part of the area in question. The new deck will replace the existing deck and connect to another existing covered porch on the south face of the house, creating a continuous "L" shaped covered area along both the east and south sides of the house. Copies of 2 surveys showing both the existing deck and proposed expansion area are enclosed for your information. As you can see from the second survey, dated July 25, 2005, the area in question ranges from between 115' and 130' from the designated saltwater tidal wetlands boundary, as determined and flagged by Mr. Rob Hermann of EN Consultants on October 13, 2004, in compliance with Southold Town standards and code, with which Mr. Hermann is well-acquainted. As this area is clearly beyond to usual 100'jurisdiction of the Trustees, I request your written concurrence that the project need not be officially reviewed and approved by your office. (Note that the area is also above the 10' contour and I already have a letter of non-jurisdiction from NYSDEC). As a matter of information, I envision little if any excavation for the project, probably limited to the setting of several foundation footings under the deck. Any storm water runoff both during and after construction will be confined to the immediate area of the deck and there will be no sedimentation of the tidal wetland or adjacent creek as a consequence of this action. Further, little if any native vegetation will need to be disturbed or removed. All required Building Department permits and approvals will also be obtained.
