That the said Board of Trustees and the Town of Southold are released from any and all damages, cc claims for damages, of suits arising directly at indirectly Is a result of any oper- ation performed pursuant to this permit, and the aid Pe®itt a will, at his or her own expense, defend say aad all such wits initiated by third parties, and the said Permittee assama full liability with respect thereto, to the complete exclusion of the Board of Tr orm of the Town of Southold 2. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that auth- orization was originally obtained 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as it result of the wort herein authorized. G. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal azi/or alterations . in the location of the work herein authorized, or if, in the opinion of the Board of Trosoees, the. work shall cause unreasonable obstruction to free navigation, the said Permittee will be requited, upon due notice, to remove or alter this work or project herein rated without expenses to the Town of Southold . 8. Avolese: The following action was taken by the Board of Town Trustees during its regular meeting held on August 23 , 2000 regarding the above matter: WHEREAS, SEBASTIAN & ROSEMARY AVOLESE applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of. the Town of Southold, application dated Juiy ? . 200s, and WHEREAS, said application was referred to the Southold '[own .'onservation Advisory Council for their findings and recommendations , and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 23 , 2000 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97 of the Southold Town Code, 0 0 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of SEBASTIAN & ROSEMARY AVOLESE for a one-story addition to the existing single-family dwelling and a new wood deck along the north, south, east and west side of the existing and new addition. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will. expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Perhaps I can address your concerns with the following information. 1. You are not lm adjacent neighbor who is legally entitled to notice. This is the way the Town Code was written. It is not a lapse by the Avolese's. 2. The Avolese's property was seriously damaged, with no prior notice to them and no subsequent rectification, as follows: a) The roadway was torn up; b) Roadway debris was deposited on their lawn; c) Their shrubbery was physically ripped out by machine and discarded on their property; d) Their surveyor stakes were removed or buried multiple times; e) The roadbed was widened on to their property; t) Three Suffolk County Water Authority vaults were installed on their lawn, several feet inside their property line; g) Their property, as well as the roadway, has suffered serious erosion due to water runoff. 3. They made personal attempts to discuss this matter with their neighbors to resolve it amicably. When this failed, the fence was their only protection. Whitney Posillico July 24, 2003 Page —2- 4. I would like to please have the following comments entered for the record. As a property owner who utilizes this right of way I firmly believe that all of the owners should have been notified prior to the erection of this new fencing. My family has utilized this right of way for over 50 years without incident. I believe that Dr. Avolese should have had the common courtesy of notifying his surrounding neighbors before the installation of this fencing was complete. As far as I know, only one neighbor within close proximity to Dr. Avolese was informed of this installation. Since the erection of this fence is there enough clearance for a fire truck to proceed down the driveway without obstruction. There must be Town codes with reference to safety for the residents? I would appreciate it if someone would please contact me regarding this matter. Gentlemen/Ladies: On behalf of Dr. Avolese, who owns the above property, we request a waiver of jurisdiction letter as to the "as built" fence site constructed less than 100 feet landward as shown on the enclosed map in triplicate. The fence was constructed by the Avolese's contractor in order to resolve a critical driveway situation resulting from the adjoining property owner ripping up the long standing stable road surface, removing shrubbery from the Avolese property (much of which was within the bounds of your jurisdiction), and filling the road area and beyond with sand. The Avoleses needed to contain the encroachments and replace their shrubbery without the likely occurrence of the neighbor's construction vehicles ruining it again. Repeated cordial attempts to resolve the situation with the neighbors were unsuccessful, and in fact the situation worsened over the past few months. The fence is a simple split rail fence, which we believe will help prevent road encroachment and runoff towards the wetlands. The existing types of shrubbery,primarily forsythia and similar plant material, will be maintained to the North of the fence.
