Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office. Reply o Please Rec:ycle . Comments: AI: I've discussed the situation again with the Richards family, and following is a sketch that I hope might resolve all problems. If we flip the float to an "L" shape rather than a "T", and shift it off the Oiestad property line by just 20', the dock would be located entirely within the extended riparian property line (as DEC and DOS view the wortd); would be located more than 75' away from the Oiestad dock, even as presently permitted; and should still be "out of the channer' area, as it will still be 30' or so to the north of its originally proposed location. This would allow us to successfully amend the other agency permits without involvement by Oiestad and hopefully satisfy the Board's concerns. If you can, please take a hard look at this proposal before Wednesday, as I'd really love to finish this one off this month, as would the Richards. Give me a call to discuss it beforehand if you'd like, or if you feel we should visit the site.. ..again, Thanks, Rob. Please note, however, that although the landward end of the dock would be offset more than 30' ITom the Richards/Oiestad property boundary, the seaward extension of the dock will cross their riparian-extended mutual property line. Therefore, please advise whether the Board will require written consent fÌ'om Ms. Oiestad and if so, whether the Board could vote to approve the project contingent upon receipt of such authorization. On January to, 2000 the U.S. Army Corps of Engineers infonned us that the proposed activities could be authorized by Regional General Pennit. Although the project would occur within the State designated Cutchogue Harbor Significant Coastal Fish and Wildlife Habitat, we do not anticipate that the proposed activities would adversely affect the resources of this habitat. Therefore, based on our detennination that the State designated habitat would not be negatively affected and the Corps of Engineers' detennination that the proposed activities are eligible for authorization by Regional General Pennit, no further review of your project by our office is required. By copy of this letter, the U.S. Army Corps of Engineers is being notified that our concurrence with you consistency certification is not necessary.
