Box 1179 Southold, New York 11971 Fax (631) 765-6145 Telephone (631) 765-1800 southoldtown.northfork.net OFFICE OF THE TOWN CLERK TOWN OF SOUTHOLD THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 214 OF 2004 WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON MARCH 9, 2004: RESOLVED that the Town Board of the Town of Southold hereby approves the request of applicants Ralph and Patricia Pugliese to substitute a Certificate of Deposit in the amount of $5~500.00 in lieu of a performance bond or letter of credit, relating to applicants' minor subdivision. Neville Southold Town Clerk THIS AGREEMENT made in the Town of Southold, Suffolk County, New York, on March 3, 2004, between the TOWN OF SOUTHOLD, hereafter referred to as the "TOWN" a municipal corporation located at 53095 Main Road, Southold, New York 11971, and RALPH PUGLIESE and PATRICIA PUGLIESE, hereafter referred to as "PUGLIESE", residing at 2705 Bridge Lane, Cutchogue, New York 11935. WHEREAS, PUGLIESE is the owner of certain real property situated in the Town of Southold, Suffolk County, New York, more particularly described as Suffolk County Tax Map number 1000-97-1-12.6, 12.7 and 12.10, and WHEREAS, for and in consideration of the granting of subdivision approval entitled "Minor Subdivision of Ralph and Patricia Pugliese" by Resolution dated January 12, 2004, and as a condition of granting said approval, the Town of Southold Planning Board required submission ora bond, letter of credit, or its equivalent in the amount of $5,500.00, with acceptance of same by the Town Board to guarantee the construction and/or installation of certain improvements, including roads, within the subject subdivision, and WHEREAS, in accordance with said requirement PUGLIESE deposited a Certificate of Deposit #1130030974 in the Office of the Town Clerk on March 3, 2004 in the amount of $5,500.00, and WHEREAS, the Town Board of the Town of Southold by Resolution adopted on July 30, 1991, RESOLVED that, "effective immediately, passbooks shall not be accepted as a performance bond for any reason whatsoever; the Town of Southold will only accept cash, Letters of Credit, or Performance Bonds from a recognized bonding company:, and WHEREAS, the parties herein have had further discussion concerning the acceptance of said Certificate of Deposit, and the Planning Board has requested, by memo fi'om Jerilyn Woodhouse, Chairperson, dated March 8, 2004 to the Town Attorney, that an exception be made due to the fact that the applicant has sold development rights upon the property and it would be in the best interest of the parties to accept said Certificate of Deposit together with the within agreement. NOW, THEREFORE, it is mutually agreed as follows: THE TOWN BOARD accepts Certificate of Deposit # 1130030974 deposited with the office of the Town Clerk on March 3, 2004 as a guarantee that the required improvements will be made. THE TOWN BOARD acknowledges that any interest earned in said Certificate of Deposit shall remain the property of PUGLIESE and that PUGLIESE shall be entitled to receipt of said interest without further notice of the TOWN BOARD. That PUGLIESE acknowledges and agrees that certain improvements are to be made by PUGLIESE in accordance with final subdivision approval granted on January 13, 2004. As a guarantee that the improvements be made as set forth in said bond estimate of $5,500.00, the Certificate of Deposit shall remain at the office of the Town Clerk of the Town of Southold and if PUGLIESE shall carry out all the terms of said bond estimate, this Agreement shall become null and void, that PUGLIESE shall be entitled to receive the Certificate of Deposit from the Town Clerk, otherwise said Agreement shall remain in full fome and effect. That in the event the improvements are made and it should be detcm-nined by the Town of Southold that said improvements are not in accordance with the standards adopted by the Town of Southold, or if the improvements are not made, THE TOWN BOARD, after public notice and notice to PUGLIESE by certified, return receipt mail, at their address set forth in this Agreement shall be entitled to use the principal of said Certificate of Deposit or a portion thereof in order to carry out said public improvements. No other party other than THE TOWN BOARD shall have any rights hereunder as against PUGLIESE. The aggregate liability of PUGLIESE shall not exceed the sum of $5,500.00 for any cause or reason whatsoever. That PUGLIESE shall be entitled to draw interest at anytime without notice to the Town Board, but at no time shall PUGLIESE withdraw principal from Certificate of Deposit # 1130030974 except as provided for in paragraph 4 above. That the parties herein agree that a copy of this Agreement shall be provided to the Bank. That the parties agree further that upon notice to the TOWN, PUGLIESE shall have the fight, from time to time, to transfer said account to the bank of their choice. The parcel is designated in the SCWA's Five Year Water Supply Plan for the North Fork as eligible to receive public water service. Accordingly, a Letter of Water Availability is issued. The nearest water main in located on Leslie Road. In order to serve this pamel, a water main extension of approximately 127 feet wound be required. The water main can be installed under the terms of our Construction Contract, which would require a deposit of approximately $5,300.00, which is a tentative estimate of the cost of installation. This Letter of Water Availability is not to be considered an action by SCWA as defined by the New York Environmental Quality Review Act or a determination that the parcel is approved for building. You are responsible for obtaining any other permits or approvals that are required for the proposed project. SCWA shall not be required to provide water for the parcel until all of the other approvals have been obtained. By way of a copy, SCWA is forwarding this letter to the Town of Southold to reiterate the findings of the environmental review for the SCWA's Water Supply Plan. These findings fbcused, in part, on opportunities for reducing demand for water in the Town of Southold. Opportunities include: l. Permitting the irrigation of only 15% of the area on any single lot 2. Requiring the use of low flow plumbing fixtures in accordance with the latest codes. 3. Adopting methods to reduce the potential of degraded water from recharging to the aquifer. This could include limits on the amount of fertilizer dependent vegetation maintained on a lot. Consistent with its Findings Statement, SCWA encourages the Town to impose appropriate conditions on the project to reduce the potential impact this project will have on the water resources of the Town of Southold. These conditions could be memorialized in the form Covenants and Restrictions on the project that are recorded with the Suffblk County Clerk. SCWA will provide water service to the parcel upon payment of the applicable tees. The tees include a tapping fee, a key money charge and if applicable, a water main surcharge, l-apping fees stai-t at $950.00 for a 1" service. Key money fees start at $3,000.00 tot' a I" service. Surcharge amounts vary. depending on the location of the proposed service. The tapping fees and the surcharge may be financed for e.,cisting homeowners. Please contact our New Construction Department during our normal business hours at (631 ) 698- 9500, 8:30 a.m. to 5:00'p.m. Monday through Friday to proceed with this project and to obtain a contract and firm cost estimate.
