The blue 2005 Suffolk County Tax Map books were handed out to Ray Blum, Fred Lee, and Bill Edwards. Adoption of Meeting Minutes: · Adoption of minutes from August 9, 2005 MOTION made by Craig Arm, seconded by Fred Lee, to accept minutes of the August 9, 2005 meeting. Motion carried 4/0. The members entered into EXECUTIVE SESSION. Applications: · FLOWER HILL BUILDING CORP. [executive session re: offer] MOTION made by Ray Blum, seconded by Craig Arm, that as per discussions through e-mail and personal contact made prior to this meeting, to increase the committee's offer per acre, in accordance with the request of the landowner, and all other conditions on this purchase/sale are to remain the same. Motion carried 4/0. · MEYER PROPERTY SCTM #: 1000-102-2-23.5 Location: 31025 Route 25, Cutchogue Total Parcel Acreage: 20.1666 acres TPDR Acreage: +9.0 acres Unprotected Acreage:+11.1666 acres (GIS 11.0 acres) Offered PDR: +5 acres Zoned: A-C & R-40 FWet: +0 acres CPF: Yes Reviewed appraisal. [executive session re: appraisal/offer] MOTION made by Ray Blum, seconded by Fred Lee, to authorize Melissa Spiro to recommend an offer to landowner for a development rights easement on 5 (possibly 6) acres of agricultural land with no road frontage, as presented by landowner at a meeting with Melissa Spiro and John Sepenoski. Any future ag structures are restricted to placement within the easement area towards the easterly boundary as was indicated by the landowner. The purpose for this acquisition, located with the AC zoning district, is for farmland protection and septic credits are not applicable. Motion carried 5/0. END OF EXECUTIVE SESSION PETER HARBES PROPERTY (EWH Limited Liability Co) SCTM #: 1000-120-3-11.12 Location: 5645 Aldrich Lane, Mattituck Total Acreage: 39.40 acres PDR Acreage: +35.3 Zoned: A-C FWet: 3.37 acres CPF: Yes Reviewed status. This property is an operating greenhouse/nursery. Melissa Spiro met with landowner several times while owner undergoing site plan approval for ag structure with the Planning Department. Site plan approval has now been granted. Landewner's original intent was to create some residential lots but he has now decided to explore the option to sell his development rights to the Town without doing subdivision. Landowner has applied to County for PDR and the County commissioned an appraisal on this property and made an offer to the landowner; however, he would rather work with the Town rather than the County. The Town received a grant from NYS and this property is eligible for grant. He has presented a new plan to Melissa Spire in which no residential lots would be created, and he would request a reserve area of approximately 4 acres surrounding the existing office/nursery operations building. Future greenhouses may be added to those already existing on the property and would be located within the development rights easement. If acceptable, landowner would like to close as soon as possible. LPC members looked favorably upon the project. MOTION made by Ray Blum, seconded by Craig Arm, to direct Melissa Spiro to commission an appraisal, or contact the Suffolk County Division of Real Estate for the purpose of obtaining information from their appraisal, and updating same. Motion carried 5/0. ADDITIONS TO AGENDA: Inquiries: · SHUR PROPERTY SCTM #: 1000-94-3-1.6 Location: 4050 Soundview Avenue, Mattituck Total Acreage: 16.71 acres (GIS 17.11 acres) Zoned: A-C & R-60 FWet: 0 MWet: 0 CPF: Yes Presentation by Tim Caufield, Vice President of Peconic Land Trust. Tim Caufield explained that property is for sale and there may be an opportunity to preserve farmland. Pecenic Land Trust is trying to be proactive in regard to preservation, and suggested the LPC commission an appraisal (or appraisal update) so as to gather more accurate value information should preservation opportunity arise. MOTION made by Ray Huntington, seconded by John Sepenoski, to direct Melissa Spire to commission an appraisal, or request and updated appraisal, on the Shur property. Motion carried 5/0. JOHNSON PROPERTY (PLT easement) SCTM #: Location: Total Acreage: PDR Acreage: Zoned: RNet: MWet: CPF: 1000-184-1.3 27153 Route 25, Orient +16.89 acres +14 easement gifted to PLT; +2 acres remains to preserve R-80 0 0 Status Update. Tim Caufield updated LPC members on status of project to include the residential development area remaining from the existing 14-acre easement previously gifted to Peconic Land Trust by expanding the easement to cover the entire 16 acre parcel. LPC said they were in favor of recommending purchase of development rights easement on this additional acreage based upon a rough estimate per acre purchase price in line with other pending development rights easement purchases. Tim Caufield to continue in his efforts to seek means to preserve this parcel. Inquiries continued: · PALMERIPROPERTY SCTM #: 1000-56-5-12.1 Location: 945 Budds Pond Rd, Southold Total Acreage: 0.56 acre (GIS) Zoned: R-40 RNet: 0 MWet: 0.53 CPF: No Reviewed inquiry re: potential preservation. Landowners have made several inquiries to the Land Preservation Department to purchase this property. Melissa Spiro directed Marian Sumner of Peconic Land Trust to respond to landowners for further details. Marian was contacted by landowners' attorney that they would offer this property for sale to the Town for a specified sum. LPC members looked favorably upon this purchase but await confirmation from landowners' attorney as to the purchase price before proceeding further. · SCHWARTZ PROPERTY SCTM #: 1000-56-4-17.1 Location: 63745 Route 25, Southold Total Acreage: +0.33 acre Zoned: Mil FWet: 0 MWet: 0.01 CPF: Yes Review: property for sale/adjacent to Town open space Melanie Doroski gave report on findings from Aurichio/Town open space acquisition concerning the driveway encroachment, mowed area and right of first refusal on the Schwartz property that is now being offered for sale. File documentation indicates that a right of first refusal was denied to the Town. A sworn affidavit signed by Therese M. Schwartz acknowledges that she makes no claim to property outside her property boundaries other than to an easement to the portion of the gravel driveway that exists beyond the boundary (that now exists on Town owned open space). LPC members directed Melanie Doroski to draft a letter to Ms. Schwartz and her broker, Beninati Associates, for review and to be sent by the Town Attorney, reminding Ms. Schwartz of her sworn affidavit and that no further improvements, other than gravel maintenance, be made to that portion of the gravel driveway beyond her property line including, but not limited to, pavement of any kind or driveway edging. ADDITION TO AGENDA: Inquiries continued: · FIRST BAPTIST CHURCH OF CUTCHOGUE PROPERTY SCTM #: 1000-96-1-13.1 Location: Route 46, Cutchogue Total Acreage: +0.24 acre (GIS 1.52 acres) Zoned: R-40 FWet: 0 MWet: 0 CPF: No Property is for sale (sale price unknown). Discussed possible preservation. Supervisor Horton has made a request to Town Board through his memo dated 9/6/05 for the use of 2% Community Preservation Funds for the purchase of the church for possible use as a museum. At this time, it is known that the parcel is not listed on the Community Preservation Project Plan nor is it labeled as a historic structure. Melanie directed to review the SPLIA list for its possible inclusion there. The LPC members will review this inquiry at a later date after further information is obtained. General: · Update - Town Board discussions re: TDR Mark Terry of the Planning Dept. (halo and receiving areas), Patricia Finnegan, Town Attorney (legislative), John Sepenoski (mapping) and Melissa Spiro (mapping and receiving areas) have been working along with the Town Board on the transfer of development rights program. Melissa & John discussed possible complications of the TDR's. A Code Committee meeting is to be held on Thursday, September 8, 2005, at 2:00 p.m., in the Executive Board Room in the Town Hall Annex and have invited LPC members to attend. The members re-entered into EXECUTIVE SESSION. Melissa Spiro's status report [executive session status of offers] Melissa's confidential status report on LPC projects handed out discussed. but no END OF EXECUTIVE SESSION Informational: · Manzi (Oregon Landing I) - closed Wednesday, August 24, 2005 17.02 acres development rights easement @ $24,500/acre = $359,047.50 Code Committee Meeting - to be held on Thursday, September 8, 2005, at 2:00 p.m., in the Executive Board Room in the Town Hall Annex to discuss sending areas for the transfer of development rights.
