The property owner agrees not to clear the property except to the extent permitted by the Southold Town Code and, in addition such limits, to remove such trees and vegetation that are dead or extensively diseased or damaged. The clearing restriction shall not apply to those portions of the property that are in active agricultural production. B. A portion of Lot 1 is encumbered with a Drainage and Conservation Easement granted to the Town of Southold as shown on the approved map and is subject to the terms and conditions of the filed agreement. Foster is the applicant and agent of the site plan designated as North Fork Industrial (Foster) also known as North Fork Foster Yard; and WHEREAS, on May 23, 2005, a formal site plan application was submitted for approval; and WHEREAS, on June 23, 2005, The Architectural Review Committee reviewed the associated site plan materials, and acknowledged that there are no architectural elements upon which to comment; and WHEREAS, on June 27, 2005, the Southold Town Building Inspector reviewed and certified the site plan for a "Contractors Yard" use; and North Fork Industrial Park (Foster) - Pa.qe Two - 9/13/05 WHEREAS, on July 12, 2005, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.6, performed a review of this unlisted action, and as lead agency, made a determination of non-significance and granted a Negative Declaration; and WHEREAS, on July 15, 2005, the Suffolk County Department of Planning responded after review of the site plan that this matter to be for local determination and there appears to be no significant county wide impact; and WHEREAS, on August 16, 2005, the Cutchogue Fire District indicated adequate fire protection conditionally, as long as the subdivision provides for a minimum of 500 g.p.m. at each electric well or Suffolk County Water Authority hydrant, and the Planning Board has accepted this recommendation for approval; and WHEREAS, on August 30, 2005, the Southold Town Engineer commented on the site plan and the Planning Board has accepted his recommendation for approval; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, the following items are incorporated and included in the site plan: 1. That the owner, applicant and agent comply with the Subdivision filed Declaration of Covenants and Restrictions dated January 3, 2005 and recorded in the Suffolk County Clerk's Office on January 20, 2005 in Liber #12367. 2. All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Status: Will be in violation of non-conformance of the approved site plan. The approved site plan will expire on 9/30/05. Mr. Corrazini submitted a landscape plan for the PB review and indicated all planting will take place this fall. It was disclosed that the site will have the following changes: pavement/asphalt instead of the proposed gravel parking lot / entrance and the circulation / crossover access to the Warren Corazzini site will be on the north side of the building which is the rear yard. Recommendation: That the Planning Board reviews the proposed landscape and approves three month site plan extension from 9/30/05 to 12/30/05 which will allow the owner to submit the as built site plan for review and complete all site work. We will require an as built site plap to reflect changes in the site build out prior to the site changes to occur.
