6:00 p.m. - Kaloski Michael & Irene: This proposal will subdivide an 8.30-acre parcel
(SCTM#1000-102-4-6.2) into 2 lots where Lot 1 equals 2.02 acres and Lot 2 equals
5.35 acres. In addition, a lot line change will transfer .402 acres from SCTM#1000-102-
4-6.2 to SCTM#1000-102-4-7.1. Following the transfer, SCTM#1000-102-4-7.1 will

The Southold Town Planning Board, at a meeting held on Monday, September 12,
2005, adopted the following resolutions:
The public hearing was closed.
WHEREAS, this proposal will subdivide a 8.30-acre parcel, SCTM#1000-102-4-6.2, into
2 lots where Lot 1 equals 2.02 acres and Lot 2 equals 5.35 acres. In addition, a lot line
change will transfer .402 acres from SCTM#1000-102-4-6.2 to SCTM#1000-102-4-7.1
which, following the transfer, will equal .918 acres; and
WHEREAS, the Southold Town Planning Board granted conditional sketch approval on
January 12, 2004 on the map, dated as last revised, October 10, 2003; and
WHEREAS, on February 14, 2005, the Southold Town Planning Board classified this
proposal as a Standard Subdivision and allowed the application to enter the process at
the preliminary approval stage; be it therefore
RESOLVED, that the Southold Town Planning Board grant preliminary approval upon
the map dated June 11,2002 and last revised on October 10, 2003, subject to the
following conditions:
1. Submission of the final map containing the Health Department stamp of
approval.
2. Submission of the final application and fees.
3. Submission of the Park and Playground Fee in the amount of $7000.
4. Submission of the LWRP Coastal Consistency Review Form.
5. Submission of the agreement or other legal instrument between the property
owner and the Town of Southold regarding the Drainage and Conservation
Easement.
6. Submission of the final map containing the Health Department stamp of
approval and the following map revisions:
a. Details of the Drainage and Conservation Easement need to be
depicted on the map. The total area of said easement must be
provided and will be considered unbuildable lands for the purposes of
yield calculations.
b. The title of the map must be revised to read "Final Plat for the
Standard Subdivision of Michael Kaloski."
c. The building envelope on Lot 2 must be revised to be located outside
of the Drainage and Conservation Easement.
7. Submission of draft Covenants and Restrictions containing the following
additional clauses:
A. Specify the clearing restriction for Lots 1 and 2 pursuant to Chapter
A106-56 of the Southold Town Code. The property owner agrees not
to clear the property except to the extent permitted by the Southold
Town Code and, in addition such limits, to remove such trees and
vegetation that are dead or extensively diseased or damaged. The
clearing restriction shall not apply to those portions of the property that
are in active agricultural production.
B. A portion of Lot 1 is encumbered with a Drainage and Conservation
Easement granted to the Town of Southold as shown on the approved
map and is subject to the terms and conditions of the filed agreement.
C. Paragraph 4 should be revised to indicate that the Covenants and
Restrictions can only be modified with approval of a majority plus one
of the Planning Board, subject to a public hearing.
D. Prior to any construction activity, the project will require a General
Permit for the storm water runoff from construction activity (GP-02-01)
administered by the New York State Department of Environmental
Conservation under Phase II State Pollutant Discharge Elimination
System (SPDES) Program.
This approval is valid for six (6) months from the date of the resolution unless an
extension of time is requested by the applicant and granted by the Planning Board.

Dear Mr. Foster:
The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, September 12, 2005:
The final public hearing was closed.
WHEREAS, the site plan application was submitted for approval proposing a re-
handling yard including stockpile of fill, topsoil and mulch for resale to contractors on a
3.24-acre parcel in the LI Zone located on the s/e intersection of Commerce Drive
and Corporate Drive also known as 350 Commerce Drive in Cutchogue; and
WHEREAS, Tide Group, Inc. is the owner of the property; and
WHEREAS, Arthur P. Foster is the applicant and agent of the site plan designated as
North Fork Industrial (Foster) also known as North Fork Foster Yard; and
WHEREAS, on May 23, 2005, a formal site plan application was submitted for approval;
and
WHEREAS, on June 23, 2005, The Architectural Review Committee reviewed the
associated site plan materials, and acknowledged that there are no architectural
elements upon which to comment; and
WHEREAS, on June 27, 2005, the Southold Town Building Inspector reviewed and
certified the site plan for a "Contractors Yard" use; and

WHEREAS, on July 12, 2005, the Southold Town Planning Board, acting under the
State Environmental Quality Review Act (6 NYCRR), Part 617.6, performed a review
of this unlisted action, and as lead agency, made a determination of non-significance
and granted a Negative Declaration; and
WHEREAS, on July 15, 2005, the Suffolk County Department of Planning responded
after review of the site plan that this matter to be for local determination and there
appears to be no significant county wide impact; and
WHEREAS, on August 16, 2005, the Cutchogue Fire District indicated adequate fire
protection conditionally, as long as the subdivision provides for a minimum of 500 g.p.m.
at each electric well or Suffolk County Water Authority hydrant, and the Planning Board
has accepted this recommendation for approval; and
WHEREAS, on August 30, 2005, the Southold Town Engineer commented on the site
plan and the Planning Board has accepted his recommendation for approval; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, the following items are incorporated and included in the site plan:
1. That the owner, applicant and agent comply with the Subdivision filed Declaration
of Covenants and Restrictions dated January 3, 2005 and recorded in the Suffolk
County Clerk's Office on January 20, 2005 in Liber #12367.
2. All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the light
in such a manner as to contain the light and glare within the property boundaries.
It is a general principle of the town that parking lot lights should be turned off or
reduced in intensity between 11:30 p.m. and 4:00 a.m. The lighting must meet
Town Code requirements.
3. All signs shall meet Southold Town Codes and shall be subject to the approval of
the Southold Town Building inspector.
4. The applicant shall guarantee the survival of all required landscaping for a period
of five years from the date of final site inspection.
5. The applicant shall obtain a SPDES General Permit (NYR-10H057) for Storm
Water Discharges (General Permit Number GP-02-01 ) from the New York
State Department of Environmental Conservation for the construction
Activities; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; be it therefore
RESOLVED, that the Southold Town Planning Board has reviewed the proposed action
under the policies of the Town of Southold Local Waterfront Revitalization Program and
has determined that the action is consistent provided that the best management

practices outlined in the September 6, 2005 memo prepared by the LWRP coordinator
are implemented; and be it further
RESOLVED, that the Southold Town Planning Board grant final approval on the site

the Chairperson to endorse the final site plans.

The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, September 12, 2005:
The final public hearing was closed.
WHEREAS, the applicant proposes an amended site plan for a proposed addition to the
existing restaurant to 250 seats on a 1.519 acre parcel in the LB Zone located on the
n/s/o State Road 25, approximately 532' w/o Shipyard Lane in East Marion. SCTM#
1000-35-2-14; and
WHEREAS, Hellenic Land, LLC, is the owner of the property: and
WHEREAS, on January 13, 2003, a formal amended site plan application was
submitted for approval; and
WHEREAS, on December 30, 2004, the East Marion Fire District recommended that the
fire protection is adequate and the Planning Board accepts this recommendation; and
WHEREAS, on May 12, 2005, the Southold Town Zoning Board of Appeals reviewed an
application for a front yard variance and granted approval under Appeal Number 5699
with one condition which the Planning Board incorporates in this approval; and

WHEREAS on June 24, 2005, the Southold Town Building Inspector reviewed and
certified the site plan for "Restaurant" use; and
WHEREAS, on July 11, 2005, the Southold Town Planning Board, acting under the
State Environmental Quality Review Act, established itself as the lead agency and, as
lead agency, made a determination of non-significance and granted an amended
Negative Declaration; and
WHEREAS, on July 27, 2005, The New York State Department of Transportation
approved a Highway Work Permit #10-05-0256 (SR 25, Main Rd), East Marion; and
WHEREAS, on August 30, 2005, The Southold Town Engineering Inspector reviewed
and approved the proposed drainage and the Planning Board has accepted his
recommendations; and
WHEREAS, on September 6, 2005, The Architectural Review Committee reviewed and

Submission of draft Covenants and Restrictions that contain the following
clauses:
a. Lots 1 and 2 on the approved map are subject to a 50' wide non-
disturbance and no-grading vegetative buffer from the top of bluff line.
Said buffer shall remain undisturbed with the exception of the removal
of dead or noxious vegetation. Such removal of vegetation shall only

of time is requested by the applicant and granted by the Planning Board. Upon
fulfillment of the conditions, the Planning Board will issue final approval and authorize

Dear Mrs. Moore:
The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, September 12, 2005:
WHEREAS, the proposed action involves an amended site plan for a new boat storage
building of 28,480 sq. ft. and new 2-story office of 6,778 sq. ft. on an 8.5-acre parcel in
the M-II Zone located approximately 210' n/o Freeman Avenue on the w/s/o Wickham
Avenue, known as 2255 Wickham Avenue, Mattituck, SCTM#1000-114-3-1; and
WHEREAS, on March 14, 2005 the Southold Town Planning Board started the lead
agency coordination process on this Unlisted Action; and
WHEREAS, on September 9, 2005, the applicant's agent has not submitted any new
supplemental information for review and the Planning Board agreed to allow additional
time for the submission of supplemental information prior to the Southold Town
Planning Board issuing a determination of significance; and
WHEREAS, on August 8, 2005, the Southold Town Planning Board has established
itself as lead agency pursuant to SEQRA; be it therefore
RESOLVED that the Southold Town Planning Board, pursuant to Part 617 of the
Environmental Conservation Law acting under the State Environmental Quality Review
Act, leaves the significance determination open pending submission of supplemental
information.

The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, September 12, 2005:
WHEREAS, the proposed action involves a site plan that proposes 17 boat racks
storing 9 boats per rack for a total of 153-boat capacity, 10 wet boat slips, use of an
existing restaurant and storage building on a 3.25-acre parcel in the Mil Zone located
on the e/s/o First Street approximately 32' s/o King Street known as 650 First Street in
New Suffolk. SCTM# 1000-117-8-18; and
WHEREAS, pursuant to NYSCRR Regulations Part 617 (SEQR), on May 11, 2005, the
Town of Southold Planning Board informed the New York State Department of
Environmental Conservation that the Town of Southold Planning Board requested to
establish itself as Lead Agency for the proposed action; and
WHEREAS, on September 9, 2005, the applicant's agent has not submitted any new
supplemental information for review and the Planning Board agreed to allow additional
time for the submission of supplemental information prior to the Southold Town
Planning Board issuing a determination of significance; and
WHEREAS, pursuant to Article 617.13 of the State Environmental Quality Review Act
the applicant will be financially responsible for costs of preparing the Environmental
Impact Statement; and
WHEREAS, the Southold Town Planning Board has established itself as lead agency
pursuant to SEQRA; be it therefore

Action: Review planting schedule and revised site plan as submitted.
Status: Will be in violation of non-conformance of the approved site plan. The approved site
plan will expire on 9/30/05. Mr. Corrazini submitted a landscape plan for the PB review and
indicated all planting will take place this fall. It was disclosed that the site will have the
following changes: pavement/asphalt instead of the proposed gravel parking lot / entrance and
the circulation / crossover access to the Warren Corazzini site will be on the north side of the
building which is the rear yard.
Recommendation: That the Planning Board reviews the proposed landscape and approves
three month site plan extension from 9/30/05 to 12/30/05 which will allow the owner to submit
the as built site plan for review and complete all site work. We will require an as built site plap
to reflect changes in the site build out prior to the site changes to occur.

Action: Review of the Town Engineers comments dated 8/30/05 (a-1) and LWRP Coordinator
comments dated 9/6/05 (a12-a5). The applicant has requested that the pb consider waiving

Status: Public Hearing set for September 12, 2005.
Recommendation: That the Planning Board accepts the comments and incorporates them
into the final approval.
