July 12, 2005

A Special Meeting of the Southold Town Board was held Tuesday July 12, 2005 at the
Southold Town Hall, Southold, New York. Supervisor Horton opened the meeting at 12:00 P.M. with
the Pledge of Allegiance to the Flag.

SUPERVISOR HORTON: Good afternoon and welcome to the July 12th Special Meeting of the
Southold Town Board. Please rise and join with me in the Pledge of Allegiance. Today's Special
Meeting was called at the last Town Board meeting in an effort to facilitate movement on some
important initiatives. We held a work session this morning at 11:00 A.M. and we discussed progress
of the Southold Town Animal Shelter, the hamlet planning initiative and number of other, a couple of
other items that were on our agenda today. We are moving, we just moved to the public portion of this
meeting, where we will vote on resolutions that we have before us on the agenda. We do afford the
opportunity for the public to address the Board on specific resolutions that are on our agenda this
afternoon. Prior to doing so, I just ask that if you do address the Board, you do so from one of the two
microphones located at the front of the room and state your name and residence clearly into the
microphone so that we can incorporate that into our public record. Moving forward, we do have
resolutions 435 through 445 that we will address today. Would anybody care to address the Town

Moved by Councilman Edwards, seconded by Councilman Wickham, it was
WHEREAS, the Town Board of the Town of Southold is considering the proposed construction of a
new animal shelter facility on a 1.52 acre Town-owned parcel of land at Peconic Lane in the Town of
Southold;
IT IS HEREBY RESOLVED, that pursuant to 6 NYCRR §617 the Town Board of the Town of
Southold establishes itself as lead agency for the uncoordinated review of this Unlisted Action; and be
it further
RESOLVED, that pursuant to 6 NYCRR §617 the Town Board of the Town of Southold adopts Part
1 and Part 2 of the attached Full Environmental Assessment Form and issues a negative
declaration for this Unlisted Action.

RESOLVED, that the Town Board of the Town of Southold hereby accepts the bid of Hawkeye
Construction in the amount of $142~750.00~ as part of the renovation of the Solid Waste
Management District Transfer Station, as modified in accordance with the recommendations of
L.K. McLean Associates, P.C., as reflected in the attached Memorandum, and authorizes and directs
Supervisor Joshua Y. Horton to sign an agreement with Hawkeye Construction effectuating the
acceptance of such bid and completion of such work, subject to the approval of the Town Attorney.
Vote of the Town Board: Aye: Councilman Edwards, Councilman Ross, Councilman Wickham,
Supervisor Horton.

RESOLVED, that the Town Board of the Town of Southold hereby accepts the bid of Robbins and
Cowan Inc. in the amount of $2~929~972.58~ as part of the renovation of the Solid Waste
Management District Transfer Station, as modified in accordance with the recommendations of
L.K. McLean Associates, P.C., as reflected in the attached Memorandum (See resolution V436
attachment), and authorizes and directs Supervisor Joshua Y. Horton to sign an agreement with
Robbins and Cowan Inc. effectuating the acceptance of such bid and completion of such work, subject
to the approval of the Town Attorney.

RESOLVED, that the Town Board of the Town of S outhold hereby accepts the bid of W.H.M.
Plmnbing and Heating in the amount of $43~178.00~ as part of the renovation of the Solid Waste
Management District Transfer Station, as modified in accordance with the recommendations of
L.K. McLean Associates, P.C., as reflected in the attached Memorandum (see resolution V436
attachment), and authorizes and directs Supervisor Joshua Y. Horton to sign an agreement with
W.H.M. Plumbing and Heating effectuating the acceptance of such bid and completion of such work,
subject to the approval of the Town Attorney.
SUPERVISOR HORTON: I want to say in reference to these past three bids, past three resolutions,
this is an initiative undertaken by the Southold Town Board after several years of planning and
discussion about the condition and the layout of the Southold Town transfer station. The public will
recall, we have changed the entrance and exiting pattern for the transfer station in an effort to increase
public safety. Moving forward with this project we believe is essential to the community in as much as
having a safe, environmentally responsible facility for handling this community's refuse. This is a
project, facility, that the community will be proud of and we will no longer, upon the completion of
this facility, we will no longer experience bags and trash and cardboard and other refuse blowing out of
the transfer station across Route 48 and into the farm fields. So I look forward to breaking ground on
this project. This is long overdue. Also we have structured this in a way such that as we move
forward with this, we expect to reimbursed for 50% of the capital outlay for this project by New York
State because much of this project has to do with recycling, so there is a 50%, actually up to 70% but
we have conservatively budgeted in our expectations 50% of the project reimbursed by the State
recycling program. In addition, we expect the remainder of the project to be funded through fees that
are incurred on an annual basis, usage fees, at the transfer station, so we don't expect to see this capital
project impact the tax rate as we move forward. It is a fiscally responsible, environmentally
responsible project; that is again, long overdue. And I congratulate the Town Board and the leadership
to recognize this issue, take it seriously and take action.

RESOLVED that the Town Board of the Town of Southold hereby appoints Paul Dh-nos to the
position of Seasonal Laborer~ at an hourly rate of $12.17 per hour, in the Department of Public
Works, effective June 27, 2005.

RESOLVED that the Town Board of the Town of Southold hereby rescinds resolution #434~
adopted at the July 5~ 2005~ regular Town Board meeting~ that read as follows:
WHEREAS there has been presented to the Town Board of the Town of Southold, Suffolk County,
New York on the 5th day of July, 2005, a Local Law entitled "A Local Law in Relation to the
Architectural Review Committee", now, therefore, be it

RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid
Local Law at the Southold Town Hall, 53095 Main Road, Southold New York on the 2nd day of
August, 2005 at 8:00 p.m., at which time all interested persons will be given an opportunity to be
heard.
This proposed "Local Law in Relation to the Architectural Review Committee", reads as follows:
Local Law No.
I. Purpose- The purpose of this Local Law is to require that all residential site plan applications be
referred to the Architectural Review Committee for their recommendations. Further, this Local Law
will eliminate the requirement that members of the committee be appointed from each hamlet, and
require that two members be appointed from the Town of Southold at large. This Local Law creates the
position of Fishers Island liaison to the committee, to assist with Fishers Island matters. These changes
in the composition of the committee are intended to enable the committee to function more effectively.
II. Code Amendment
§ 100-258. Architectural Review Committee.
A. The Architectural Review Committee shall consist of five members appointed by the Town

§ 100-257. Architectural review standards.
Site plans, includinR Residential Site Plans, shall be reviewed for conformance with the following
criteria:
§ 100-259.1. Standards for residential site plans.
C. Within ten (10) days after completion of the SEQRA review, the Planning Board shall forward the
application to the Architectural Review Committee for review. The Architectural Review Committee
shall make a written recommendation to the Planning Board on the site plan within ten (10) business
days of receipt of the referral. If the Committee fails to make a recommendation within this time
period, the project shall proceed to the Planning Board for consideration without Committee view.
tg~D. Preliminary hearing requirement. Prior to and in addition to the public hearing required by §
100-254H, the Planning Board shall hold a separate preliminary hearing on the application with notice
provided pursuant to Chapter 58.
G.E~ Affordable housing requirement. Every new residential site plan involving the creation of five
or more dwelling units shall comply with the requirements of § Al06-11B(2)(c) of the Code of the
Town of Southold, Subdivision of Land, pertaining to the provision of affordable housing. The

requirements applicable to lots within subdivision in that subsection shall apply equally to dwelling
units in affected residential site plans.
~.F. Park and recreation requirement. The provisions of § A106-60 of the Code of the Town of
Southold, Subdivision of Land, pertaining to the reservation of parkland in subdivisions, shall apply
equally to residential site plans approved under this chapter, except the fee per lot therein shall herein
be applicable to each dwelling unit.
~G~ Performance bond requirement. The provisions of Article IX, Bonds and Other Security, and
Article X, Required Public Improvements; Inspections; Fees, of Chapter Al06, Subdivision of Land,
of the Code of the Town of Southold, shall apply equally to residential site plans approved under this
chapter. Pursuant to Municipal Home Rule Law § 10, § 100-259. lB, C and D herein supersede and
amend New York State Town Law § 274-a regarding site plan review to the extent that the Planning
Board is empowered to impose affordable housing, park and recreation and performance bond
requirements in the residential site plan review process.
t~. H~ Phased development. The Planning Board shall permit the phased development of residential
properties that meet all other applicable standards, but shall condition the approval of the development
of any permitted phase upon the maintenance of the undeveloped phases in their undeveloped
condition, and shall prohibit all clearing and site preparation on such undeveloped phases until such
time as development is permitted.
G.I~ Planning Board authority to vary requirements for setbacks, building length and separation and
courts.
III. Severability. If any section or subsection, paragraph, clause, phrase or provision of this law shall
be adjudged invalid or held unconstitutional by any court of competent jurisdiction, any judgment
made thereby shall not affect the validity of this law as a whole or any part thereof other than the part
or provision so adjudged to be invalid or unconstitutional.
IV. This Local Law shall take effect immediately upon filing with the Secretary of State.

RESOLVED that the Town Board of the Town of Southold hereby finds that the adoption of the
Town of Southold "Hamlet Study" dated July 5, 2005 is classified as a Type II Action pursuant
to SEQRA Rules and Regulations, 6 NYCRR Section 617.5, and is not subject to review under
SEQRA.

Moved by Councilman Wickham, seconded by Councilman Edwards,
WHEREAS, the Town Board of the Town of Southold has engaged in extensive and comprehensive
planning regarding the highest and best uses for the hamlet areas that exist within the Town; and
WHEREAS, the comprehensive DGEIS, prepared for and adopted by the Town Board in 2003,
recommended that the hamlets and hamlet locus zones (HALO zones) of the Town be clearly
designated to advance proper planning, land use and development throughout the Town and to
strengthen and support the unique character of Southold's hamlets; and
WHEREAS, the Town Board of the Town of Southold engaged Cleary Consulting to coordinate an
intensive Hamlet Stakeholders planning process, intended to provide the community of each individual
hamlet with the responsibility of recommending the course of planning and growth to be encouraged
and accommodated within its respective hamlet area; and
WHEREAS, Cleary Consulting, in conjunction with the community stakeholders, and with the input
of the Town Board and the Planning Board, has compiled a Town of Southold Hamlet Study dated July
5, 2005 ("Hamlet Study") that incorporates the findings of this collaborative hamlet planning process

and consists of a Town-wide analysis as well as individual hamlet studies for Mattituck, Cutchogue,
New Suffolk, Peconic, Southold, Greenport West, East Marion and Orient; and
WHEREAS, the Hamlet Study seeks to apply Hamlet Sustainability principles to achieve the Town's
smart growth principles and goals consistent with the ideals of community development,
environmental protection, economic development and natural resource conservation; and
WHEREAS, the Planning Board has made comments and recommendations as contained in a
memorandum dated May 23, 2005, and receipt of the memorandum is acknowledged; and
IT IS HEREBY RESOLVED, that the Town Board of the Town of Southold adopts the Hamlet
Study as an official Town planning document as part of the Town's comprehensive planning efforts;
and
IT IS FURTHER RESOLVED, that the Town Board of the Town of Southold determines that, as
part of its comprehensive planning process, it will consider the Hamlet Study and comments therein in
implementing new legislation and Town programs, and
IT IS FURTHER RESOLVED, that the Town Board of the Town of Southold will consider the
recommendation of the Planning Board in conjunction with the Board's intentions to incorporate the
Hamlet Study into legislation.
COUNCILMAN WICKHAM: I would like to say how pleased I am with the participation of the
stakeholders in all of the hamlets in Southold.
SUPERVISOR HORTON: Likewise. A number of you are here today, but this process incorporated
more than 90 participants that volunteered their time throughout the community and I know that there
were bumps in the process and there were tensions in some of the rooms and that is part of the process
of bringing people together, taking several points of view and putting them into a document that is
usable for planning in the town. So you all experienced what we deal with on a regular basis and I
applaud you for sticking with it and for putting so much time and so much energy into it. And this is
something that the implementation, as I mentioned at the work session, will take quite a bit of time, it
will take quite a bit of heavy lifting; it will take, without a doubt, I say this for each Board member that
is serving on this Board today, that is present today, and Board members that will be here in the future.
This will take a tremendous amount of political will. This is a road map for the proper growth of our
community and with that comes conflict and with that comes opposing points of view and we have
come a long way since the studies of the late 80's and the early 90's and in this document what I see is
our community voicing its will to put forth the smart growth strategies that have been reviewed
through the stands of time, over the past 20 years. So thank you for your participation and I
enthusiastically call for a roll call vote on this resolution.
COUNCILMAN EDWARDS: Well, I won't enthusiastically vote yes, I think it is wonderful when
you can get this tremendous participation from every single hamlet. This is the kind of consultants you
like to hire. Yes.

Moved by Councilman Edwards, seconded by Councilman Wickham,
WHEREAS the Town Board of the Town of Southold has adopted legislation designed to address the
affordable housing crisis in the Town (Town Code Chapter 98, 100-50 and Al06); and
WHEREAS the legislation calls for the Town Board to establish rental rates and home sales prices for
dwelling units created pursuant to the Town's affordable housing programs; and

WHEREAS the Town Board received recommendations on pricing from the Special Projects
Coordinator who has researched the issue, and the Town Board discussed the recommendations at a
work session; and it is hereby
RESOLVED that the Town Board of the Town of Southold establishes the following Rental Rates and
Home Ownership Sales Prices for dwelling units created through the Town affordable housing
programs, which will be reviewed and updated annually by the Town Board:
RENTAL RATES
For 2005
· Efficiency - $777
· One bedroom- $833
· Two bedroom- $1000
· Three bedroom - $1155
· Four bedroom- $1288
(Based on the U.S. Dept. of HUD-Nassau/Suffolk LOW HOME rental guidelines indicating that rents
may not exceed those levels.)
HOME OI;FNERSHIP SALES PRICE
Housing Providers Utilizing Public Funds (i.e. grants/subsidies, etc.):
Sales pricing cannot exceed:
· 3 times the 80% level of the HUD median income of a family of four for
Nassau/Suffolk counties
For 2005, the sales price cannot exceed $213,300.
Housing Providers not Utilizing Public Funds:
When housing developments yield more than one unit of housing, the Town Board requires that
housing providers off'er a pricing range between:
· 3 times the 80% level of the HUD median income of a family of four for Nassau/Suffolk
counties and,
· 2.5 times the 120% level of the HUD median income of a family of four for Nassau/Suffolk
counties
For 2005, this would set the sales price range between $213,300 - $266,500. No housing unit sales
price can exceed $266,500.

RESOLVED that the Town Board of the Town of Southold will hold a public hearing to consider to
appropriating $2.6 raimon for construction of a new Town of Southold Animal Shelter on the site
of the existing Animal Shelter located at Peconic Lane, in the Town of Southold and including
demolition of said existing Shelter, and authorizing the issuance of $2.6 million in serial bonds of
the Town of Southold to finance said appropriation; such hearing will be held at the Southold

construction of new Town of Southold Animal Shelter at Peconic Lane, in the Town, being the site of
the existing Town Animal Shelter. The estimated maximum cost of such construction, including
demolition of the existing Animal Shelter, purchase of the original furnishing equipment, machinery
and apparatus required and grading and improving the site, is $2,600,000 which amount shall be
financed by the issuance of $2,6000,000 serial bonds of the Town.
All persons interested in this project will be heard at said hearing and all written communications will
considered.
Vote of the Town Board: Aye: Councilman Edwards, Councilman Ross, Councilman Wickham,
Supervisor Horton.
This resolution was duly ADOPTED.
SUPERVISOR HORTON: At this point, 1 bring this meeting to a close and I thank the Town Board for
coming in in the middle of the day for a special meeting.
