HomeMy WebLinkAboutTB-07/26/2005-SSOUTHOLD TOWN BOARD SPECIAL MEETING July 26, 2005 11:00 A.M A Special Meeting of the Southold Town Board was held Tuesday, July 26, 2005 at the Southold Town Hall, Southold, New York. Supervisor Horton opened the meeting at 11:00 A.M. with the Pledge of Allegiance to the Flag. Present: Supervisor Joshua Y. Horton Councilman John M. Romanelli Councilman Thomas H. Wickham Councilman Daniel C. Ross Councilman William P. Edwards Deputy Town Clerk Linda J. Cooper Town Attorney Patricia A. Finnegan Absent: Justice Louisa P. Evans SUPERVISOR HORTON: Welcome to the Special Meeting July 26, 2005 of the Southold Town Board. Please rise and join with me in the Pledge of Allegiance. We only have, we have only one resolution on the agenda today and the purpose for calling this special Town Board meeting is to work within the confines of legal requirements that relate to a petition from KACE, LLC, the annexation of their property from the Town into the Incorporated Village of Greenport. So keeping with those legal guidelines of noticing this petition within 20 days of receipt, we called a special meeting to affect that motion. Before I move forward with this, it is customary that I off'er the floor to the public to address the Town Board on this specific resolution. The resolution is this and this only, setting a public hearing for August 23rd at Greenport High School at 7:00 P.M. It will be a joint public hearing, attended by both the Southold Town Board and the Greenport Village Board. Would anyone care to address the Board on that resolution? (No response) Then I will put forth this resolution. July 26, 2005 Special Town Board Meeting 2 #465 Moved by Supervisor Horton, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of Southold will hold a joint public hearing, together with the Board of Trustees of the Village of Greenport, to consider the Petition for Annexation filed by KACE LI, LLC, requesting the annexation of the territory encompassed by SCTM # 1000-40-3-1 from the Town of South old to the Village of Greenport, such hearing to be held at the Greenport High School, 75955 Route 25, Greenport, New York, on the 23rd of August, 2005 at 7:00 p.m. at which time all interested persons will be given an opportunity to be heard; and the Town Clerk is hereby authorized and directed to publish and post a notice of such hearing, no less than 20 days prior the date ofthis hearing, and to cause a copy of such notice to be mailed to each person or corporation owning real property in the territory encompassed by SCTM #1000-40-3-1 and known as 62600 County Route 48 as shown by the last preceding assessment roll and to any and all persons residing in such territory qualified to vote for officers ofthe Town; and the Town Clerk is hereby authorized and directed to cause a copy of such notice to be mailed not less than 10 days prior to the date of such hearing to the school authorities of the Greenport School District and the board of commissioners each fire district, district corporation, public benefit corporation and town improvement district situated in the territory proposed to be annexed. The notice of such hearing shall appear in substantially the following form: TOWN OF SOUTHOLD NOTICE OF PUBLIC HEARING July 26, 2005 Notice is hereby given that the Town of South old has received a Petition for Annexation proposing the annexation ofthe territory encompassing approximately 17 acres of vacant, residential land identified by SCTM #1000-40-3-1 and known as 62600 County Route 48, from the Town of South old to the Village of Green port. The Town Board ofthe Town of South old will hold a joint public hearing, together with the Board of Trustees of the Village of Green port, at 7:00 o'clock p.m. on the 23rd day of August, 2005, at the Greenport High School, 75955 Route 25, Greenport, New York, at which time and place the Town Board and the Board of Trustees will hear testimony and consider evidence and information concerning the Petition. All persons interested in this proj ect will be heard at said hearing and all written communications will be considered. SUPERVISOR HORTON: And attached with this resolution is the public notice that will be published in both the Suffolk Times, the Traveler Watchman and in Newsday. Vote of the Town Board: Aye: Councilman Edwards, Councilman Ross, Councilman Wickham, Councilman Romanelli, Supervisor Horton. This resolution was duly ADOPTED.
