SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 14,436 sq. ft. parcel has 152.86 feet along Village Lane and 94.35 feet along the northerly side. The property is improved with a single-family, two-story frame house with deck and accessory (one-story and 2-story)frame barn, as shown on the 10/20/2004 survey prepared by John C. Ehlers, L.S. BASIS OF APPLICATION: Building Department's November 12, 2004 Notice of Disapproval, citing Sections 100-242A and 100-244, in its denial of a building permit to construct a proposed addition enclosing deck which is less than 10 feet from a single side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 20, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to enclose a 14' x 16'4" section of the existing deck, which new construction is located within the nonconforming side yard at less than the code required minimum of 10 feet. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing deck is six (6) feet from the side line instead of the code required 10 feet, resulting in nonconformance of the four linear feet. The existing 25 ft. rear setback of the deck will remain unchanged. It is only this side yard section of the Page 2—February 3,2005 • • ZB Ref.5642—D. and K. Constant CTM ID: 25-2-5.4 deck within 10 feet of the property line that requires a variance, and the purpose is to build an one- story, unheated porch. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. It is common for homeowners to place a porch at the rear of the dwelling, and the applicants have chosen use of an existing rear deck for this purpose. 3. The variance granted herein is substantial. The code requires a minimum of 10 feet on a single side yard, and the porch enclosure utilizes an existing deck, resulting in a nonconformance of approximately 65 sq. ft. of porch area (4' extending within the side yard restriction). 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 5. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of enclosing the deck for a new porch, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Orlando, and duly carried, to GRANT the variance as applied for, as shown on the 11/3/04 plan prepared by James Garretson, A.I.A. and within the proposed setbacks of the existing deck shown on the 10/20/2004 survey prepared by John C. Ehlers, L.S., SUBJECT TO THE CONDITION that the porch enclosure remain as a seasonal enclosure, not to be converted as heating living space. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Vote of the Board: Ayes: Members Oliva (Chairwoman), Orlando, Dinizio, and Simon. Absent was Member Goehringer. This Resolution-was duly adopted (4-0). 1f1-t(SdJ t Ruth D. Request for a Variance under Sections 100-242A and 100-244, based on the Building Department's November 12, 2004 Notice of Disapproval, concerning a proposed addition enclosing deck which is less than 10 feet from a single side yard, at 555 Village Lane, Orient; CTM 25-2-5.4. The Board of Appeals will hear all persons, or their representatives, desiring to be heard at each hearing, and/or desiring to submit written statements before the conclusion of each hearing. Dated: January 4, 2005. BY ORDER OF THE ZONING BOARD OF APPEALS TOWN OF SOUTHOLD RUTH D. OLIVA, CHAIRWOMAN By Linda Kowalski • • FORM NO. 3 r NOTICE OF DISAPPROVAL DATE: November 12, 2004 TO: Douglas & Karin Constant PO Box 225 5"4' !f/ Orient, NY 11957 Please take notice that your application dated November 5, 2004 For construction of an enclosed porch over an existing rear deck at Location of property 555 Village Lane, Orient, NY County Tax Map No. 1000 - Section 25 Block 2 Lot 5_4 Is returned herewith and disapproved on the following grounds: The proposed construction, on this non-conforming 14,374 square foot parcel in the R-40 District, is not permitted pursuant to Article XXIV Section 100-242A which states. "Nothing in this article shall be deemed to prevent the remodeling, reconstruction or enlargement of a non-conforming building containing a conforming use, provided that such action does not create any new non-conformance or increase the degree of non-conformance with regard to the regulations pertaining to such buildings." The existing deck has an existing side yard setback of+/- 6 feet. The proposed enclosure will maintain that setback. Pursuant to the ZBA's interpretation in Walz (#5309), such additions and alterations thus constitute an increase in the degree of non-conformance. Therefore, the proposed construction is not permitted pursuant to Article XXIV, Section 100-244 which states that non-conforming lots, measuring less than 20,000 square feet in total size, require a single side yard setback of 10 feet. a , 9 Authon ed Sit CC: file, Z.B.A. Note to Applicant: Any change or deviation to the above referenced application may require additional review from the Southold Town Building Department. • J • .0 I ' r ' ! ` sop r APPLICATION TO THE SOUTHOLD TOWN BOARD OF APPEALS ac-Jinni - For Office Use Only 61Y-01. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application 'and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 14,436 sq. ft. parcel has 152.86 feet along Village Lane and 94.35 feet along the northerly side. The property is improved with a single-family, two-story frame house with deck and accessory (one-story and-2-story)frame barn, as shown on the 10/20/2004 survey prepared by John C. The existing deck is six(6)feet from the side line instead of the code required 10 feet, resulting in nonconformance of the four linear feet. The existing 25 ft. rear setback of the deck will remain unchanged. It is only this side yard section of the . The benefit sought by the, applicant cannot be, achieved by some method, feasible for the applicant to pursue, other than an area variance. It is common for homeowners to place a porch at the rear of the dwelling, and the applicants have chosen use of an existing rear deck for this purpose. •3. The variance granted herein is substantial. The code requires a minimum of 10 feet on a single side yard, and the porch enclosure utilizes an existing deck, resulting in a nonconformance of approximately 65 sq. ft. of porch area (4' extending within the side yard restriction). 4. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or,environmental conditions in the neighborhood. (Public Hearing held 6/23/83) TOs4r. -and Mrs. Doug Constant Agpellant(s)] -555' Village Lane _ Orient, NY 11957 i Mr. Kenneth Strachan (Builder) Hogs` Pond Road, Orient, NY 11957 At a Meeting Of the .Zoiing Board of Appeals held on J ne 23, 1983 the above appeal was considered, and the action indica ed below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article ' , Section [X] Request for Variance to the Zoning Ordinance Article III , Section 100-31 [ ] Request for The public hearing concerning this application w s also held on June 23, 1983. Upon application for DOUG AND KARIN CONSTANT, 55 Village,Lane, Orient, NY for a Variance to the Zoning Ordinance, arti le III, Section 100-31 for permission to construct addition to dwelling with an insuffi- cient rearyard setback, at 555 Village Lane, Orient, NY County Tax Map Parcel No. 1000-25-2-5.1. The board made the following findings and determ nation: By this appeal, appellants seek permission to co struct a new 4' by 24' addition at the rear of the dwelling, which w uld leave an insufficient rearyard setback of 21 feet. The present etback of the subject dwelling is 25 feet from the rear property line Also exist- ing _on the premises ,is- an accessory barn structure loca ed south of the dwelling in the rearyard area, approximately, one fo t from the rear property line. It is the opinion of the board tha due to the narrowness of the lot and the location of the duelling hat tnere is minimal rearyard area; and that the relief requested is reasonable and practical under the circumstances. In considering this appeal, the board determines t at the variance request is not substantial; that the, dircumstances here'n are unique; that by allowing the variance no substantial detriment o adjoining properties will be created; that the difficulty cannot e obviated by a method feasible to appellant other than a variance; at no adverse effects will be produced on available governmental favi ities of any increased population; that the relief requested :will be in harmony with and promote the general purposes of zoning; and th t the interests of justice will be served by allowing the variance as i dicated below. On motion by Mr. Douglass, seconded by Mr. Sawick , it was RESOLVED, that Appeal No. 3141, application for DPUG AND KARIN , CONSTANT for permission to construct addition with an i sufficient setback from the rear property line of 21 feet, BE AND REBY IS APPROVED AS APPLIED FOR. Vote of the Board: Ayes: Messrs. Goehringer, Do en, Douglass and Sawicki. (Member Grigonis-was absent.) This resol tion was unanimously adopted.) DATED: June 29, 1983.
