REITERS (OLD BARGE RESTAURANT) Property Location: 750 Old Main Road (NYS Route 25), Southold CTM Parcel: 56-6-8.7 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Unlisted Action category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The property consists of 1.42 acres with 252.01 feet along the south side of the Old Main Road in Southold. The property is improved with a single-story restaurant building, as shown on the August 6, 1998 survey, amended September 20, 2004, by Peconic Surveyors, P.C. BASIS OF APPLICATION: The applicant has requested a Special Exception under Zoning Code Section 100-1216(1) pertaining to alterations and new construction relative to the pre-existing restaurant use, and confirmation that the Building Department in its October 2004 determination (Notice of Disapproval) correctly stated that a rear yard setback variance is not required based on changes in the property's deed and survey, as corrected, and conversations with the Southold Board of Assessors. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 16, 2004 and January 20, 2005, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPOSED NEW CONSTRUCTION: The additions, which does not cover the entire existing first story, are measured at 24.8 feet wide by 64.8 feet, plus an upper observation deck 13.2 feet wide by 30.2 feet. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1) The applicant seeks approval for second-story additions with alterations to the existing building to be used in conjunction with the dining room facilities of the present restaurant. The existing building has been used as a restaurant for many years. It is the determination of this board that the expansion to the upper level in conjunction with the continued operation of the restaurant in this Marine II Zone District will not in any way alter the character of the neighborhood or district. The new construction will not increase the present 120 person seating area of the restaurant. 2) Section 100-1216(1) authorizes proposed additions and alterations to restaurants. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts. C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not be adversely affected by the proposed fitness facility use and its location. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. F. That all proposed structures, equipment and material shall be readily accessible for fire and police protection. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Dinizio, and duly carried to GRANT a Special Exception, as applied for, and to CONFIRM that the Building Department's determination that a rear yard variance is not necessary is correct, based on the survey corrected/amended September 20, 2004 by Peconic Surveyors, P.C., and details on the S-1, A-1, A-2 Diagrams prepared by Fairweather-Brown Design Associations dated September 23, 2004. The restaurant is located close to the shoreline and rear lot line of the property. The location of the restaurant structure is legal and nonconforming. The owner has decided to add to the restaurant by constructing an upper level. The upper level is designed so that it is set back further from the rear lot line than the existing restaurant structure. The only way to add to the restaurant structure without increasing lot coverage or setback nonconformities is to construct an upper level as proposed, i.e., set back further than the existing restaurant structure on which it is located. Owner has received approvals from the New York State Department of Environmental Conservation ("DEC"), the Trustees of the Town of Southold, and the Suffolk County Department of Health Services. Copies of the DEC's approval and the Trustees' approval are annexed. The Health Department approval is noted on another set of plans which have not been submitted to the Board.
