Goehringer ; -Page - March 10, 2005 • ZBA Ref. 5661 —Whitney Armstrong CTM ID: 2-1-11.3 house, leaving the extensive landscaping, and including the (1927) footprint of the former dwelling that was fire-damaged. This bank contour varies from one end of the property to the other. The bank is a gentle slope to the water. The new dwelling will be of low-profile design to take advantage of the existing landscape with extensive shrubbery and at least 113 feet from the approximate high water mark of the Fishers Island Sound. It would also be very costly to relocate the extensive plantings or to move the building, which would disturb the well-established landscape and abundant shrubbery. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant wishes the build a one story house the replace the two-story house that was destroyed by fire. To gain the square footage lost by not constructing a second story, the plan submitted under ZBA 5577 (approved 9/7/04) was revised by applicant to expand the first floor area, beyond the original foot print. 3. The variance granted herein is substantial, representing a 40% reduction from the code require- ment of 100 feet from the top of the bluff or bank. The property contains a bank area that is stable and gently sloping with abundant landscaping. • 4. The difficulty has been self-created. 5. No evidence has been submitted to suggest that a variance in thig residential community will have an adverse impact on the physical or environmental conditions'in the neighborhood. The property is extensively landscaped with gardens and gently rolling topography. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the plan prepared December 21, 2004 by Thomas Phifer and Partners. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In order to accommodate a bedroom in the main wing it will require an expansion of the original approved footprint to extend the main wing 57 ' to the east which places it 60 ' from the top of the bank or bluff at its closest point . If the applicant were to extend the dwelling to the west it would destroy the existing stonewall and detract from the existing landscaping and still require a variance because it would be within 100 ' of the top of the steeper bluff on the westerly side of the property. (4) CONTINUED. high water which is 113 '± from the proposed house . The slight slope in this area is highly vegetated with large mature trees and shrubs . The result being there will be no adverse impact on existing conditions as there is no erosion in this area. (6) CONTINUED. applicant has decided to replace the dwelling with a low profile with a one-story modern house which is designed to compliment the existing magnificent landscaping and garden area on the property. The proposed house emphasizes the existing axial structure of the garden surrounding it . The house will be 12 ' in elevation with each room in the main wing having a direct connection to the existing garden. It is debatable whether there is a bank or a bluff on this northeast corner of the property, but at its closest point it is approximately 14 ' above mean sea level and slopes upward to about 24 ' at the elevation of the proposed house. This bank or bluff area is stable and is protected by heavy vegetation and trees . As a result there has been little or no erosion on this property. A granting of a variance to construct the house 60 ' from the top of the bank is reasonable considering the nature of the topography in this area and all of the balancing tests as set forth in Town Law §267 . Lark 28785 Main Road Cutchogue,New York, 11935 Dear Dick, The house for our Fishers Island property that Tom Phifer has designed for us, which we hope to build on the site of the house destroyed by'fire in December, 2004, is a remarkable fulfillment of our:desire to have a home devoted to contemporary.art with continuous views-of the surrounding garden. -A§you know;the garden,'open to.the_-,-; public, is a major aspect of the property which will be'featured in the April issue of Martha Stewart Living. The garden has been developed over a period of fifteen years with particular attention to the planting and care of specimen trees. The wooded areas of Fishers Island are heavily populated with undistinguished locust and wild cherry. Most of the land was farmland and pasture until the mid-1930's and there are surprisingly few outstanding trees on the island, especially when compared to the wooded areas of Connecticut and Long Island. It has been our objective to develop a garden within the matrix of special trees. To accomplish this,we have planted over 15 different magnolias, and remarkable examples of holly, hawthorn,hornbeam, Japanese maple,'oak, flowering trees:including a `large'stand of Sargent cherry and'trees of unusual interest;2particularly'paper bark maple, monkey puzzle (very unusuallot zone,6);variegated'=dogwood; weeping.plum,.weeping purple beech, styrax and cypress. The-plari for the new house does not disturb any planting of trees. We are currently seeking to extend the footprint of the old house to satisfy the new plan. I feel it is important to note that if we can not extend the footprint to accommodate the requirements of the planned one-story home, a collection of valuable trees will have to be destroyed by a revised plan. These include a willow oak(2 foot caliper), three ornamental crab apples over 20 feet tall, and one of the largest Norway maples on Fishers Island, over 50 years old, at least five foot caliper. Trees are very important to our survival and this would be a tragic loss. I sincerely hope the deliberations concerning the extension of the footprint will take into account that if the design must be altered, we will necessarily lose important, established trees, irreplaceable in our lifetime.
