the Cutchogue Fire Department to continue to earn additional credits beyond the

DISTRICT SECRETARY
I, Matthew J. Martin, fire district Secretary of the Cutchogue Fire District, in the
Town of Southold, County of Suffolk, State of New York, HEREBY CERTIFY
that I have compared the annexed copy of the Certificate of Inspectors of Election
as to the results of the voting at special referendum election duly called and held
in said Fire District on August 22, 2005 with the original thereof, which was filed
with the Board of Fire Commissioners in my office as Fire District Secretary,
following said special election, and the same is a tree copy of said original
Certificate and of the whole thereof so far as the same relates to the vote for the
following:
To allow participants to continue to earn additional credits beyond
the age of Sixty-Five (65).

in the Town of Southold

August 22, 2005
WE, THE UNDERSIGNED, BEING CHAIRMAN, inspectors of election and Ballot
Clerks, respectively, at a special election referendum of the qualified voters of the
Cutchogue Fire District, in town of Southold, County of Suffolk, New York, held a the
firehouse, 260 New Suffolk Road, Cutchogue, New York, between the hours of 6:00 p.m.
and 9:00 p.m. (prevailing time) on December 14, 2004, HEREBY CERTIFY that we
have canvassed the votes at said special referendum in said Fire District for:

WE, THE UNDERSIGNED, having been designated to act as Chairman,
Inspectors of election and Ballot clerks, for the purpose of conducting a Special
election of the qualified voters of the Cutchogue Fire District, in the Town of
Southold, County of Suffolk, New York, held at the firehouse, 260 New Suffolk
Road, Cutchogue, New York at 6:00 p.m. to 9:00 p.m. (prevailing time) on
August 22, 2005, DO SOLEMLY SWEAR that we will support the Constitution
of the State of New York, and that we shall faithfully discharge the duties of
offices of Chairman, Inspectors of Election and Ballot clerks at such Annual
election called to a vote as set forth and described in the Notice calling the Annual
election.

1)
Mark only with a pen having blue or black ink or with a pencil having black
lead.

To vote "YES" make a cross X mark or a check ~ mark in the square
opposite the word "YES".
3)
To vote "NO" make a cross X mark or a check ~' mark in the square
opposite the word "NO".
4)
No other mark than the X mark or the ~ mark may be used for the purpose
of voting, and any other mark or writing, or any erasure made on this ballot
outside the voting squares provided for voting will void this entire ballot.

Shall the Resolution of the Cutchogue Fire District in the
Town of Southold, County of Suffolk, State of New York, entitled:
."BOARD RESOLUTION OF THE CUTCHOGUE FIRE DISTRICT IN THE TOWN OF
SOUTHOLD, COUNTY OF SUFFOLK, STATE OF NEW YORK, ADOPTED JULY ll,
2005, AUTHORIZING THE AMENDMENT OF THAT CERTAIN BOARD RESOLUTION
OF THE CUTCHOGUE FIRE DISTRICT IN THE TOWN OF SOUTHOLD, COUNTY OF
SUFFOLK, NEW YORK, WHICH WAS ADOPTED ON SEPTEMBER 23, 1991, AND
PASSED BY SPECIAL ELECTION REFERENDUM OCTOBER 23, 1991, AND WHICH
EST~LISHED A DEFINED BENEFIT SERVICE AWARD PROGRAM FOR THE
VOLUNTEER FIREFIGHTERS OF THE CUTCHOGUE FIRE DISTRICT; BY
ALLOWING PARTICIPANTS TO CONTINUE TO EARN ADDITIONAL CREDITS
BEYOND THE ENTITLEMENT AGE OF SIXTY-FIVE (65), AS PREVIOUSLY
APPROVED; AT AN INITIAL ESTIMATED COST OF $38,947.00 BASED ON THE
EXISTING NUMBER OF FIREFIGHTERS, WITH A TOTAL ESTIMATED ANNUAL
COST OF SUCH AMENDED PROGRAM OF $168,954.00 WHICH INCLUDES AN
ESTIMATED ANNU~2L ADMINISTRATIVE FEE OF $3,140.00. THE SERVICE
AWARD PROGRAM SHALL CONTINUE TO BE A DEFINED BENEFIT PROGRAM WITH
THE AMOUNTS PAID TO VOLUNTEER FIREFIGHTERS AT TWENTY DOLLARS
($20.00) PER MONTH FOR EACH QUALIFIED YEAR OF ACTIVE FIREFIGHTING
SERVICE NOT TO EXCEED THIRTY (30) YEARS; PAYMENT WILL COMMENCE
WHEN THE ELIGIBLE FIREFIGHTER REACHES THE ENTITLEMENT AGE OF
SIXTY-FIVE (65); EACH ELIGIBLE VOLUNTEER FIREFIGHTER WILL RECEIVE
CREDIT FOR UP TO FIVE (5) QUALIFIED YEARS OF ACTIVE FIREFIGHTING
SERVICE; THE PAYMENT OF THE BENEFIT SHALL BE IN THE FORM OF A
LIFE ANNUITY WITH 120 PAYMENTS GUARANTEED; DEATH AND DISABILITY
PAYMENTS TO BE AUTHORIZED TO COMMENCE UPON THE DATE OF THE
AMENDMENT OF THE SERVICE AWARD PROGRAM, AND REGULAR DEFINED AWeD
PAYMENT TO BE AUTHORIZED TO COMMENCE ONE YF2%R THEREAFTER AND
APPROPRIATING SAID AMOUNT THEREFORE."
