THE'CHAIRMAN: Is there anyone present-who wishes to speak
for this application? That would he.you Mr.~ Anderson.
MR. ANDERSON: Present.
THE CHAIRMAN: Do you have anything you would like to
add to the application?
MR. ANDERSON: We have already started to paint and we have
been looking for'a roofer~ and we have started working on the
exterior of the building.
THEC~AIRMAN: Are there any questions?
MR. BERGEN: How much land g~es wit~ this building?
MR. ANDERSON: The land is 85 feet by 155 feet.
THE CHAIRMAN: The houses immediately to the south and
north, are they one family dwellings or two family dwellings?
MR. ANDERSON: They are one family dwellings.
~4ECHAIRMAN: Do~athe road there is a motel.
MR. HULSE: Mrs. Vail took guest~for~y~rS.
THE CHAIRMAN: There is also about a half of dozen
individual cottages in this area.
MR. ANDERSON: Down toward the water there is a couple
of summer cottages.
THECHAIRMAN: So, within a few hundred yards there is
multiple residences and tourist houses.
MR. BERGEN: How many rooms are in this dwelling?
MR. ANDERSON: ~here are five bedrooms, living room~ dining
room, two baths and two porches.
MRS. ANDERSON: There are four bedrooms on the first floor,
and two living rooms. There is one bedroom on thesecond floor.
MR. HULSE: Your~only problem is if you wanted to build
a garage. There won't bea,enough room between the property line
and the garage.

MRS. ANDERSON: Is there a side yard requirement?
MR. HULSE: Yes. Accessory buildings have to staythree
feet from the back'and side property line. If-the garage
was'attached to the house yQu would have to maintain your
10 feet and 15 feet side Yards.
MR. ANDERSON: A garage would be best in the back yard.
THE CHAIRMAN: Is there anyone present-who wishes to
speak in opposition to this application?

After investigation and inspection the Board finds that
the applicant request-permission to convert an existing budding
into a two family dwelling. The Beard finds that this same
existing structure was once used as a two family dwelling.
The building is large enough to accommodate ~two families.
The use of this building as a two family dwelling will not
change the character of the district in view of the fact there
are other multiple residences-uses in this immediate vicinity.
The proposed use~will not advers~affect~the property
values of surrounding properties. The Board finds that there
will be no changes on the exterior of the dwelling to be
converted.
The Board finds that the public convenience and welfare
and justice will be served and 'the legally established or
permitted use of neighborhood propErtyand adjoining'use
districts willnot be permanetly or substantially injured
and the spirit of the Ordinance will be observed.

an existing structure into a two family dwelling on property

to the following condition:

application of A.A. Cooke, Nassau Point Road, Cutchogue, New
York, for a variance in accordance with theZoning Ordinance,
Article III, Section 300, Subsection 6, for permission to locate
an accessory building in the front yard area. Location of
property: east side of a private road of way off the south side of
Nassau Point Road, lot NO. south ½ of 82, all of lot no. 82A and
82B in the Nassau Point~Club~Properties, Inc., Cutchogue, New

THE CHAIRMAN: If there is no one here to speak for it, I
will. The location is as described.~ The only one of the few
suitable areas that could be used fora studio is the one that
has been chosen. This would not be setting a precedent. We
have done this in at least two other instances.
MR. HULSE: In this area?
THE CHAIRMAN: Once in this area and once in Brown's Hill.
MR. DOYEN: Is this an artist studio, writer, or what?
THE CHAIRMAN: The application is in here. I don't know
what he does. Maybe Mr. Terry knows.
HOWARD TERRY, Building Inspector: He is a writer.
MR. HULSE: Does he plan to have living facilities in t~is?
MR.' BERGEN: You can't do too much living-in 16 feet by 20 feet.
THE CHAIRMAn,: I am wondering what-this will look like. Have
you seen the plans on this?
HOWARD TERRY: I haven't seen the construction plans.

THE CHAIRMAN:'Is there anyone present who w ishes to
speak in opposition to this application?
(There was no response.)
After investigation and inspection the Board finds that
the applicant request permission to erect a studio forwriting
in his front yard area. The Board points out that the
location chosen by%the applicant for the studio is the only
feasible location. The propertyin question slopes down on
all sides and to-~ard the water. The Board has granted
variances in other cases for accessory uses in the front
yard area where the property has waterfrontage. The pro-
posed studio building is to be 16 feet by 20 feet. In
gnntral, the Board is in agreement with the reasoning of
.the applicant as setforth in the application to the Board
of Appeals.
The Board finds that strictapplication of the Ordinance
will produce practical difficulties orunnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinityof this property'-
and in the same use district; and the variance does observe
the spirit-of the Ordinance and will not'change the character
of the district.
On motion by Mr. Bergen,~seconded by Mr. Hulse, it-was
RESOLVED. that A. A2 Cooke~'-Nassau Point Road~ Cutchogue~
New York, be granted permission to erect a studio building
in his front yard area on property located east side of a
private road off the south side of Nassau Point Road, subject,
however~ to .the following conditions:
1. The proposed building shall not be used foE-residence
or dwelling purposes, or 'for a guest house,on a temporarybasis.
2~,The building shall not be-located Closer than 20 feet
to the private right of way.

THE'CHAI~WP~N~ I have seen this sign and it-isnot~aS
conspicuous as I thought it-would be. The cone is ~painted
the ~color of an ice cream cone and the ice cream is white.
This sign probably be permitted if he had a peek type roof.
The~sign has no lettering on it.

After investigation and inspection~he Board finds the
applicant wishes to erect a sign, in the shape of an ice
cream cone, on the front of the building. The sign will be
more than 30 inches above the roof, higher than permitted
by the zoning Ordinance. The sign wilI have no lettering
~"~i~0~it;~The Board is of the opinion that this advertising
not be offensive. The Board po ints out that
~i~:~ld be permitted in a case where the construction to
consbruction has a flat roof a special exception is required.

Article III, Section 300t Subsection 1, for permission to
expand a non-conforming use. Location of property: north side
Main Road, East'Marion, New York, bounded north .by-Dzenkowski,

IRVING PRICE:,i ESQ.: Mrs. Woersdoerfer purchased this
property in 1957, just before or after zoning~ she wasn't
sure. The work which is the subject of this heating'was
done in 1960. I have a couple of aerial maps which the

previous owner got-his hands on somewhere and when he sold
her the house he sold her these photographs. (FAR. Price
pointed out the location of the buildings onthe property,
using the airial phot0graphas a diagram.) There are 'three
buildings in a sence~. ~-She changed the roof on the garage
the back shed andthe so called two story~cottage.
THE CHAIRMAN: The two story cottages was the barn?
IRVING PRICE, ESQ.: The old barn is the thing refered
to as the shed attached on the rear. She changed the 'roof
line. She has made it more attractive than what itwas.

The building looks like it is on th~ne.
IRVING PRICE~' ESQ,: I~s right on the line. These thr~e
buildings were always thare and always attached. The cottage
was used-by the previous owner as a summer rental and was
used by her until 1960. In a sence you are extending the
number of rental units. You are not adding to any'building.
THE CHAIRMAN: This is the way it looks now. ~ointing
to photograph). I guess this is a peek~roof.
IRVING~PRICE, ESQj: I think she has ~attened that out.
This is one building made into two units. It isn't the
usual expansion of the use. There is no expansion of the
area or anything.
THE CPtA/_RMAN: The structure.has not changed?
IRVING PRICE: It has the same area.
THE CHAIRMAN: You are not sure if it was bought before
or after zoning?
IRVING PRJICE, ESQ,': No.
THE'CHAIRMAN: I think it was after zoning. I remember
the fellow who_use to live there. He had a road side
vegetable stand.
IRVING PRICE, ESQ.: That was in the aerial pk~ograph.
T~E CHAIRMAN: I have never heard any objection to this.
MR. DOYEN: This has been rented in the past?

THE CHAIRMAN: ~S~e has changed the roof structure?
IRVING PRICE: She has improved it.
THE CHAIRMAN: I thought it was originally two units. She
has just added one unit?
IRVING PRICE, ESQ.~: Yes. This was used before zonisg.
MR. DOYEN: You are adding one unit in fact.
THE CHAIRMAN: This was a garaged and this was a shed,
and this has been changed into two small motel units.
(The Chairman was pointing to a sketch)
IRVING~PRICE,ESQ.': They are not cottages, they are like
motel units.
MR. HULSE: There are no kitchen facilit~s?
IRVING PRICE: No.
MR. HULSE: What' is the size ofthe lot?
MR. BERGEN: You can see its a big lot.
MR. PRICE, ESQ.: I would say it is about 75 feet by
200 feet.
(The Board viewed the ~x map to determine the size of
the property in question.)
THE CHAIRMAN: I am curious to know why "she went ahead
with this without permission"]~X from anyone.
IRVING'PRICE, ESQ.': I neverknew her until she came into
mY office. Its one of those things that is hard to describe.
If you knew the lady you wouldn't.be surprised. I don't want
to be-derrogatory in any sence.) Shes probably more intelligent
than I am, as far as legal matters, they are the last thing
in her mind.
THE CHAIRMAN: We might be permitted to wonder .why the
building inspector didn)t see this before. I never saw it.

IRVING'PRICE~~ ESQ.: She said she ask Mr. Terry why this
was 3ust being brought up now~ and Mr. Terry said itwas
the first time he saw it.
TPIE'CI~AIRMAN: The same thing applies 'to two families
housesl They only way you could find out is if one of the
neighbors complains.
IRI~ING PRICE., ESQ.: I don't think there was any
attempt to conceal.
THE CHAIRMAN: Are there ahy otherI questions?

THE CHAIRMAN: If the Board wants to reserve decision
we can reserve decision until latter. Its my opinion that
we might as well make the decision now.
Is there anyone present who wishes to speak in
opposition to this application?
(There was no response.)
After investigation and inspection the Board finds that
the applicant wishes to expand her non-conforming use, which
is the rental of motel units. The area of the property
involved is approximately one half acre. There is and will
not be any exterior expansion of the buildings involved.
The Board points out~uat the non-conforming use of the
property, by the previous owner, existed before the
enactment of the Zoning Ordinance. The previous owner of
the property accommodated tourist in his home and in a
separate structure in the rearyard area. The previous
owner also sold vegetables on his front lawn, profitably.
The Board is further of the opinion that it is not the
purpose of the Board of Appeals to punish an individual
who fails to follow the proper zoning proceedure. The
Board points out that the existing use of the property
will not change the character of the neighborhood~ and to
the Board's knowledge this operation is not objectionable
to the residents in the immediate vicinity.
The Board finds that strict application of the Ordinance
will produce practical difficulties or unnecessaryhardship;
the hardship created is unique and would not be shared by
all property alike in the immediate vicinity of thisi2property

and in the sameuse district; and the variance does observe
the spirit of the Ordinance and will not.-change %he character
of the district.

RESOLVED that'Lilli N. Woersdoerfer, Main Road, East
Marion, New York., be gr~nted permission to expand a non-
conforming use onpropertylocated north side of the Main

Mrs. Dellano,~ North Road, Southold, appeared before
the Board for an informal discussion in regard to a sign
of her's that is less than five feet setback from the
propertyline. There was some question as to where the
exact property line is. The Board advised Mrs. Dellano
that she should have a su=v~y of her'property~at the
night of her hearing so that the Board may take action
on her application.
