There were present: Messrs: Robert'W. Gillispie, Jr. Chairman; Robert Bergen, Charles Grigonis~ Jr.~ Serge Doyen~ Jr., Fred Hulse, Jr. PUBLIC HEARING: Appeal No. 849 - 7:30 P.M,~.D.S. To), Upon application of Baker and Fickeissen, Southold, New York, a/c Ilie Wacs, Sound Drive, Greenport, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 307, for permission to reduce the side yard requirement. Location of property: Lot no. 105 in Eastern Shores at Greenport, Section IV, Greenport, New York. Fee paid $5.00. The Chairman opened the hearing by reading application for. a variance legal notice of hearing, affidavit attesting to its publication in the official newspaper, and notice to the applicant. The Chairman read the following letter: "To Whom it may'Concern, Please be advised that Ir the undersigned~ owner of lot 106 adjacent to the lot owned by Itie Wacs at Eastern Shores, Greenport, have no objection to Mr. Wacs havin~ his building line 7 feet instead of the legal 10 feet from my property line. Once you start~iving variances on a filed map there is no end to it. I am involved with two subdivisions and our lots are layout in such a way that you don~t need any'variance. THE CHAIRMAN: You are objectimg on genera-t~principles. You are objecting to this becuase you heard it read? MR. OLSEN: I read it in the newspaper, that's why I'am here. One a map is layoute~~ it should sta~' that way. You are liable to get,variances all over the place. THE'CHAIRMAN: This lot in question is 440 feet deep. MR. OLSEN: Must be able to put a house on that the other way. T~E CHAIRMAN: The house is running the same direction as the lot. The variance is requested on this side here~ next to the Rosenbergs. MR. ~OLSEN: My objection is only one thing. If you give a variance in one case there will be no end to it. THE CHAIRMAN: I think we will have to postpone decision on this until Fir. Fickeissen gets here. MR. OLSEN: I am objecting because of the principle. don~t think there should be any'variances once a map is approved. ~- THE CHAIRMAN: Is there anythi~ further on this application? ~There was no response.) The Board viewed the Building Permit application attached to the application to the Board of Appeals. THE CHAIRMAN: Is there anyone present whowishes to speak against this application? CThere was no response.) THE CHAIRMAN: Weneed more information than what is submitted on the application, therefore we will have to postpone decision on this application. Southold Town Board of Appeals -4- June 16, 1966 PUBLIC HEA~ING:' Appeal No. 851- 8:00 P.'M~'(E.D.S,T,'), Upon application of Assunta and Peter Giordano, Gin Lane, Southold,~ New York,.~ for a special exception in accordance with the Zoning Ordinance, Article III, Section 300, Subsection ~(a), for per- mission to convert a one family dwelling into a two family dwelling. _ Location of property: Lots no. eight ~(8) and nine C9) in Bay Haven at Southold~ Southold, New York. Fee pa~$5.00. The Chairman opened the hea~gby reading application for a special exception,, legal notice of hearing, affidavit attesting to its publication in the official newspaper~, and notice to the applicant. THE CHAIRMAN: The application is accompanSed by a petition signed by the lotsowners in the area, stating they have no objection to a two family dmelling. There are 23 signatures on the apetition. At this time is there anyone present who wishes to speak in favor of this application? MR. GIORDANO: All I can do is repeat myself. ~hen I bought this property in 1960, I'~had no idea I would make this request, however-we hm~e no alternative. We would like to come out to Southold to live year around. THE CHAIRMAN: Are you just a summer res~ent now ? MR. GIORDANO: We come out'here almost every.we~k end in the winter. I have -five children~ and seven grandchildren. Ordinarilywe could have 15 to 20 peoplehere if"the situation was different. If this application is granted we would have fewer people here. If anyone told me in 1960 that this would happen, that I wouldhave to come before you gentlemen and praticallybeg, Iwould say-theF<~were out of their mind. We are in no position to do anything e]se. THE CHAIRMAN: How would this variance help you? MR. GIORDANO: It wouldhelp me physically._ I sell juu~nile furniture direct to the home. I have just been told they are goingto take me out of'Nassau County and put me in SUffolk:County. The demonstation proceedure-X)r~( takes 2½ to-3 hours. Appointments are made for after dinner'which is usually around 8:00, and it's about 11:00 when I am finished. Southold Town Board of'Appeals -5- June 16, 1966 THE CHAIRMAN: This juvenile furniture, what does it consist of. MR. GIQRDANO: We sell cribs, high chairs, playpens~ carriages, and strollers. It's a package deal. We write to wom~ who are expecting babies. It is my job to call these people and make an appointment. I represent the ~ company. .I have all o~ Suffolk County mysetf. I was in Riverhead two weeks ago. The chances are you can't get-anyone to listen to you until between 7:30 P.M. and 8:00 P.M. It would be easier for me to drive 15 miles than 60 miles to my other'home. THE CHAIRMA~_: Would it be better for you to have one home instead of two. Would you still need this variance then? MR. GIORDANO: If this request is not granted~we m~y. be forced to do that. I have a young boy of 18 and I can't just disrupt him immediately. THE CHA~: You have sufficient area for a two fanuly dwelling as far'as the lot size goes. You don't have sufficient area for occupancy. I don't see the dimensions of the house on the application. MR. GIORDANQ: It's over 12~00~ square feet. THE CHAIRMAN: You need 850 square feetof'living area for one family~ so for a two family dweliing you would need 17,000 square feet of living area. MR. HULSE:' Actually this house is situated on Lot-no . 8. It's conceiveable that you could sell lot no. 9. THE ~HAIRRAN: We could put a condition of this, if it is passed, that lot no. 9 would not be sold, MRSj GIORDANO: We do not want to sell lot 9. This could be-a condition, that we would not sell this lot. THE CHAIRMAN: If this was granted it would have to be on a temporary'basis. Would you occupy-the home part time? MRS. GIORDANO: There will just be the two of us there. M y so~ will be going to college. We will have fewer people in the $outhold Town ~oard or'Appeals -6- June 15, 1966 THE CHA~.: When do you expect this situation will be cleared up so that you wouldn't need the two family dwelling? MRS. GIORDANO~ A year'or two years. We will either have to sell the house or try to make it. Perhaps it-will be within a year. I don't know what are circumstances are going to be. un THE CHAIRMAN: This is an/usual hardship due to physical difficulty and that iS one of the reasons why we have a Boa~d of Appeals. We coUld not grant it on financial hardship because everyone is believed t6 have some financial hardship. Is there anything else to be said for this application? ~There was no response.) THE~CHAIRMAN: Is there anyone present who wishes to speak against this application? MRS. FLORENCE JOHNSON: Isn't'this a major improvement in the interior of the house? THE CHAIRMAN: We are only concerned with the interior of the house when it is going to be changed to be a two family dwelling. MRS. FLORENCE JOHNSON: Doesn't it require a building permit? THE CHAI~4AN: No. MRS. FLORENCE JOHNSON: I don't underst~.d whythis extra' lot is required. TME CHAIRMAN: The house is on lot no. 8. They also own lot number 9. TheZoning Ordinance was recently changed to permit this Board~ in certain cases, to grant-permission forltwo family dwelling provided there was 25,000 square feet of land available in the~roperty concerned. That is whywe would putt he condition that lot number 9 could not be sold. If it was this permission would be cancelled. MRS.' JOHNSON: The part they.wantto use for living quarters is next to another house, no on the side of the additional lot. THE CHAIRMAN: That'doesn't make any difference. They have the total area. Southold Town Board of Appeals -7- Jume 16, 1966 MRS.' FLORENCE JOHNSON: If this petition is granted how would this affect the taxes of the houses in the area? THE CHAIRMAN: You would have to ask the assessors about that. MRS. FLORENCE JOHNSON: How would'this house be sold? THE CHAIRMAN: The permissionwould expire when they sold it. It-could not be sold as a two family house. It would be required in this'case because of the unusual nature of the application and the house is a little small for a two family dwelling. This right would cease when the hardship ceases. The new owner would be required to use the house for single dwelling. MRS. JOHNSON: What is going to s~op Other people from making the same reques.t~ THE CHAIRMAN: They would have to have a legal reason. There was alot of Old houses in the Town of'Southold that were vacant · for a good manyyears. When the ordinance was passed it was made possible to convert this old dwellings into two family dwellings with this Board's permission. It-was better to have these occupied and used as two family or t~reefamily dweilings on a' large plot of land, rather than to have them vacant. MRS. JOHNSON: When we bought this property we bought because it was a one family dwelling neighborhood. Myhus~and has been ill fox ma~y years. I had a heart attactmyself this past winter. Ifwe had wanted to live in a Cwo family dwelling neighborhood we would have bought there in the first place. THE CHAIRMAN: There are many two family dwelling neighborhoods. MRS. JOHNSON: That is why~we chose this place to live. THE CHAIRMAN: They~ave enough land area to permit this application~ b~{S. JOHNSON: Does this Board Put~a time limit on it? THE~PL%IRMAN: Yes we do,. and I am trying to determine what would be a reasonable time limit under the applicant's circumstances. MRS. GIORDANO: As far as making this place a Coney Islandt I think that is far fetched and very unrealistic. After'being ill for a period of two years and spending every dollar that ~ have~ we are asking for a lega~elping hand. Southold Town Board of Appeals -8- 16, 1966 MRS. FLORENCE JOHNSON: This is nothing personal, this is just'a general Statement. MRS. GIORDANO: We have the front part of the house rented -for August ~o a docter. We ask him if he would object-to us coming out for the weekends and in the summer, and he has ~ho objection. Actually you will be having fewer people coming out here. MRS. PIE?.RN"POPIST?.: I also live in Bay'Haven. You have answered certain questions to my s~tisfaction. I would like to know, in the future, how we ma~e be-made aware of what is going on. Should it be sold as a two family dwelling, or the circumstances don~t work out~ how do we know when this permisionis up? THE CHAIRMAN: We would put a time limit on it. It would be a condition of granting this appliCation. It may not be used by any'one else for a two family dwelling. If this was granted on a two year basis, after't hat'time thepermission would expire. MRS. HELEN POPISIL: I would not want the character of the neighborhood changed. THE CHAIRMAN: You think the granting of this application would change the neighborhood? MRS.' HELEN'POPISTT.: I feel that we have a wonderful neighborhood. We are in a residential area. I would not want to loose my house to have somebody else come along and change it. Also, I am living on a pension. THE CHAIRMAN: I don'tthink this'will change the character of the neighborhood. Southold ToWn Board o~ppeals -9-- Ju~%e 16, 1966 After investigation and inspection the Board finds that the applicant request permission to convert a one .family dwelling into a two family~dwelling. The area or'the p~o_perty in question is in accordance with the landarea prescribed by. the Zoning Ordinance of theTown of Southo-~/ for a two family dwelling. The Board finds.that-the applicant suffers a physical hardship thus needing to cnnvert-his home fortwo family occupancy. It is the opinion of the Board that the character of'the nieghborhoodwill not be changed in view of the fact that no exterior changes will be made on the ~r~house in question. The Board finds -that strict'application of the Ordinance will produce practical difficulties or unnecessaryhardlfaip; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity ofthi~ property and in the same use district; and the variance does observe the spirit' of the Ordinance and will not change the character of the district. On motion by'Mr. Gillispie,~ seconded by Mr. Bergen, it was RESOLVED thatAssunta and Peter Giordano, Gin Lane,-Southold, New York, be granted permission to cnnvert a one family~dwelling into a~two family dWelling on property that is described as being lots numbers eight (8) and nine (9) in Bay Haven at -Southold, Southold, New York~ subject,however, to the following conditions: 1. That the permissive us~ is granted for two~2).years only. 2. That the permissive use wilt expire if'any part of lot number eight (8) or nine ~9) is sOld. 3. That in the event the applicant should sell the house before the~wo year time limit.is up, the permissive use will expire with the sale of the house in question. Location Of property: north side-Main Road, Southold, New York, bounded north, by'FjP. Rich, east by'Fire'Department, south by Main Road, west by F.P. Rich. Fee paid $5.00. WALTER KAPP'~ESQ'.': May I say something at this point. I am here in favor oflthis application. I don~t see any'one opposed to it. The application is quite lenghty. I would be willing to waive the reading of the application if the Board wishes to. BERGEN: Mm. Kapp, when this was set up was there a plan submitted to the Town Board? Had they'accepted it in writing? WALTER KAPP%ESQ.: We do have an Open Development~Area. Your new Ordinance, I understand,, was a stop gap to.prevent multiple dwellings until the Master' Plan comes out. We have plenty of area there, hut it doesn't meet the new requirements. This was designed for the elderly, citizen who wants to retire in Southold Town. It~ right adjoini~gto the Fire Department. There are some two bedroom units in here. There are no pets~allowed. This is just what,the Town needs. It's good for t~e Town and it is good for these people. But-to limit the area as the new ordinance does, it makes it impossible to continue with this. ~ HULSE: Are the roads public or private? WALTER KAP~% ESQ.: Theyare pziva~eroads. MR. DOYEN: Is this what you would call clusterhousing? WALTER KAPP~ESQ.': This is different from cluster'housing. THE CHAIRMAN: This application is for this building h~re? WALTER KAPP~EEQj: (pointing to map) This is the one that the permit was revoked on. We are applying for a variance on the whole thing, all cf.~he units. THE CHAIRMAN: Do you have city water here? ~WALTER KAPP,ESQ.: We have city water and all t~e .utilities are under ground. The Board agrees with the reasoning of the applicant as set~ forth in the application to the Board or'Appeals. The Chairman reopened the hearing on Appeal No. 849, upon application of Baker and Fickeissen,-Southold, New York~a/c Ilie Wacs~ Sound Drive~ Greenport, New York, for a variance in accordance with theZoning Ordinance, Article III, Section 307~ for permission to reduce the side yard requirement. Location of property: lot no 105 in Eastez~Shores at Greenport~ Section IV, Greenport, New York. Mr. Fickeissen appeared before the Board to discuss this application. The Board advisedMr. Fickeissen thatthere didn't seem to be sufficient reason for'varing the side yard on this lot. An alternative locatinn for the proposed addition was discussed. to THE CHAIRMAN: Is there anything further/be s~id either for or against this application? i(There was no response.) Afterinvestigation and inspection the Board finds that the applicant request permission to construct a dwelling and vary the side yard requirement from 10 feet to 7 feet. The Board finds that_there is more thanenough area involved in this lot and that some alternative location fOr the addition must be sought. The Board points out'that this lot is on a filed map and there should be no variances granted. Southold Town Board of~Appeals -14- June 16, 1966 After investigation and .inspection the Board finds that the applicant request permission to con, err'an existing dwelling into five apartments with insufficient land area. The Board finds that this structure was built prior to the Zoning Ordinance and was designed as a multi-purpose building. The Board points out that-if this structure was not converted into five at~tments it would remain an eyesore to the neighborhood. Thus the conversion of this structure will enhance the character of the neighborhood. In general~ the Board is in agreement with the reason'ing ofthe applicant as set forth in the application to the Board of'Appeals. The Board finds that'strictapplication to the Ordinance will produce practical difficulties or. unnecessary hardship; the hardship created is unique and would notbe shared by all properties'alike in the immediate vicinity of this prop~ty and in the same use district; and the variance does-observe the spirit of the Ordinance and will not change the character of the district.
